A year after the Brihanmumbai Municipal Corporation (BMC) announced to investigate into tuberculosis (TB) deaths across Mumbai, the decision still remains on paper, says Right to Information (RTI) data gathered by the Praja Foundation. [h=2]RTI queries reveal Pune police commissionerate has no compiled data on registered cases.[/h] Applications filed by The Indian Express under the Right to Information (RTI) Act have revealed that neither the cyber crime cell, that started on May 29, 2005, nor any other branch of the Pune police commissionerate has compiled data on cyber crime cases registered in its jurisdiction. [h=1]City bar council slaps notice on Tomar, to probe forgery claims[/h] Spelling more trouble for Delhi law minister Jitender Singh Tomar, the Bar Council of Delhi (BCD) has issued notice to him on a complaint alleging that he used forged and fabricated documents to enroll himself as an advocate. Honorary secretary Puneet Mittal said the council was holding an independent inquiry due to the seriousness of the allegation. The council has asked Tomar to come up with an explanation by March 20. The Delhi High Court had on Friday decided to scrutinise the authenticity of Tomar’s law degree even as the petitioner in the case sought to withdraw his petition that had made similar allegations. Mittal said that the BCD initiated the inquiry after it received a complaint from advocate Ripudaman Singh Bhardwaj against the Aam Aadmi Party (AAP) leader seeking cancellation of his registration and initiation of criminal proceedings. He said the complaint was filed after an RTI query to Dr Ram Manohar Lahia Avadh University, where Tomar had claimed to have obtained an undergraduate degree in science, revealed that it did not have any records of granting any degree to him. The RTI reply, a copy of which is with HT, clearly says that Tomar’s degree, marksheet, and roll number are “completely fake”. “The Bar is of the view that the allegations are prima facie serious. If Tomar fails to give plausible explanation on the issue, we might also register an FIR. However, future course of action will be taken after his appearance,” Mittal said. The complaint received by the Bar said Tomar did not submit his provisional LLB degree nor his attendance certificate while enrolling as an advocate. It said non-submission of requisite documents “show that essential norms as framed by Bar Council of India (BCI) for enrollment purpose have not been complied with”. If the allegations are found to be correct, Tomar will not only lose his licence to practice as an advocate but will also face charges of forgery. If the degrees and certificates turn out to be fake and if Tomar had submitted the same set of documents with the Election Commission while filing his candidature he may lose his seat too. In 2013, the Delhi High Court had said that a false affidavit by a candidate at the time of filing of nomination papers is a ground for setting aside his/her election. Guwahati, May 9: The Krishak Mukti Sangram Samiti (KMSS) today demanded a CBI probe into the alleged multi-crore scam in the allocation of construction material to private companies engaged by the National Highways Authority of India (NHAI) in the state for the East-West corridor project. The KMSS said RTI applications submitted by it had revealed that the Assam forest department has been providing sand, stones and boulders to private companies engaged by the NHAI at government rates.   6. Bharat Lal Meena, Principal Secretary, Department of Higher Education, will inquire into the allegation of “double claims” of Travel Allowance by B.R. Ananthan, former Vice-Chancellor of Rani Channamma University. The inquiry follows a complaint, along with copies of the allowance obtained under the RTI Act, by Dharwad-based advocate and RTI activist Basavaraj Godachi, who shared a copy of the complaint and the RTI-documents with a section of media in Belagavi.   7. Sixteen cameras to cover the premises of the Haveli tehshildar’s office, all installed by a contractor “without being asked to install them”, have raised eyebrows. An inquiry ordered by State Information Commissioner (SIC) D B Deshpande to unravel the mystery behind the installation of the CCTV cameras reveals the contractor had apparently not adhered to the usual procedure of floating tenders. There is no clarity on who sanctioned the installation of cameras, Deshpande had observed when he had directed the Pune divisional commissioner to get an inquiry.   8. [h=1]U'khand Info Commissioner recommends CBI probe in Kumbh Mela[/h] The Information Commission of Uttarakhand today recommended to the Chief Secretary a CBI probe in alleged financial irregularities worth Rs 180 crore during the Haridwar Kumbh Mela in 2010 when the BJP was in power in the state. Information Commissioner Anil Sharma has sent the recommendation on the plea of an RTI applicant who had alleged that there was no account of Rs 180 crore of central funds sent for organising the Kumbh Mela. Through a series of RTI applications trustee of a Dharmshala, Ramesh Chandra Sharma brought to the notice of the Commission that Congress-led UPA Government had given a grant of Rs 565 crore to the BJP government in the state for the conduct of Mela in 2010. He alleged that 54 works for public remained incomplete during the Mela which caused inconvenience to devotees coming from across the world to Haridwar on auspicious occasion. Sharma alleged that CAG of Government had carried out a secret inquiry which showed that out of 311 works worth Rs 565 crore sanctioned to 34 departments of the state government 54 works worth Rs 180 crore remained incomplete. The applicant had alleged that responses to RTI applications show that nodal officers were lackdiasical in not depositing funds in the Mela Officer account. He also alleged that the then state government did not carry out any vigilance inquiry in the matter. In his order, Information Commissioner Anil Sharma took note of the issues raised by Ramesh Sharma and forwarded the complaint with all the annexure to the Chief Secretary with instructions to decide on a CBI inquiry. The Information Commissioner known for his maverick orders on public interests has been facing death threats from the lobbies against whom he had issued similar orders in the past. He was given threats for his directives to carry out CBI inquiry into implementation of NRHM in the state but has not been provided any security cover in Uttarakhand. It is pertinent to mention here that as per the government reply to the Right to Information (RTI) application, the Department has neither record traceable nor any consolidated information with regard to the number of apprentice engineers engaged from time to time in the Corporation. The Corporation in the RTI had also admitted that some of the selected engineers have been terminated after discrepancies were found in their certificates and at least 12 candidates were sent on deputation on Motor Vehicle Department as Motor Vehicle Inspectors. [h=1]Maharashtra govt won’t probe anonymous graft complaints[/h] In a severe blow to whistleblowers in Maharashtra, the BJP-led state government has made it clear that anonymous complaints, irrespective of how serious allegations are levelled in them, won’t be probed. The General Administration Department, headed by Chief Minister Devendra Fadnavis, has issued directives to all state departments stating that complaints not carrying the name and the address of the complainant must be closed without any action. It further states that the same rule should be followed in complaints that carry the name of the complainant, but the allegations levelled in them are “vague” in nature. Even in cases where the complainant chooses to identify himself/herself and the allegations are “verifiable”, the approval of the competent authority should be taken for taking cognisance of such a complaint. After which, it must first be referred back to the complainant to ascertain if he/she owns up to filing the complaint. If nothing is heard from the complainant within a month, such complaints must be treated as “pseudonymous” in nature and discarded without any probe, the directive adds. Sources in the government said the move was to arrest policy paralysis in the bureaucracy. But anti-corruption activists said that it would discourage people from becoming whistleblowers and exposing corruption. The government, on the other hand, has argued that whistleblowers who desire to protect their identity were already protected under the Public Interest Disclosure and Protection of Informers Resolution, 2004, where the identify of a complainant is kept a secret.   12. The State government is contemplating some drastic changes in the RTI rules, which include keeping the Criminal Investigation Department (CID) out of the ambit of the RTI and imposing postal charges on the applicants. On September 22 last year, a meeting held under the chairmanship of the Additional Chief Secretary of the Department of Personnel and Administrative Reforms V Umesh had suggested some major changes.   15. The Lokayukta has refused to provide information about the enquiry into allegations that Leader of the Congress party in the Lok Sabha, Mallikarjun Kharge, had amassed illegal wealth. The state vigilance bureau (SVB) is accused of concealing the findings of an inquiry into a scam in implementing the Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS) in Ambala district. In the case registered in February 2011 in Ambala, the role of several senior bureaucrats and state forest department officials was investigated. The bureau, after completing its report, kept it secret. In the past three months, it headquarters has twice turned down the Right to Information (RTI) Act applications (HT has copies) for details on the grounds that the report is pending with the Haryana government for “final consideration”. Kargil veteran who `leaked' info sacked after fake probe Acourt of inquiry (CoI) that had led to an Army Brigadier's dismissal without court martial after the 1999 Kargil war for allegedly leaking classified documents has turned out to be fictitious, according to information obtained under the Right to Information (RTI) Act. The Army's 3-Infantary Division recently told Brig Surinder Singh, in response to his RTI query days before the 15th anniversary of the Kargil War on July 26, that no such inquiry was ever held. “It has no information about any CoI, as no such inquiry was ordered by this branch during the month September 1999,“ it said. Singh had asked for the name and designation of the officers who had convened the CoI as well. In reply , the 3-Infantary Division said it did not have the information because no such CoI was convened. “The RTI information has vindicated my stand that I had not leaked any classified information,“ Singh said. “I will fight till my honour is restored.“ Singh has now amended his petition before the Armed Forces Tribunal, Chandigarh, saying he was dismissed on the basis of a fictitious inquiry while seeking to have his dismissal set aside.
