  2. The year 2015 is turning out to be a bad year for journalism in India – the largest democracy in the world. Two journalists have already been murdered in the first six months of the year. In 2014, India lost two journalists to assailants in Odisha (formerly Orissa) and Andhra Pradesh. This year till May, the populous country was relatively peaceful for media persons. However after that it turned depressing for the media fraternity as two scribes belonging to Uttar Pradesh and Madhya Pradesh lost their lives to perpetrators within a month. Quite shockingly the month of June also witnessed some major attacks on media persons across the country. Uttar Pradesh reported the first killing of journalist on 8 June 2015, as Jagendra Singh died after suffering from severe burn injuries at Lucknow civil hospital. The Shahjahanpur based freelance journalist was reportedly doused with patrol and set ablaze by a group of State police personnel on June 1. His family members claimed that the police persons targeted Singh on behest of UP minister Ram Murti Singh Verma in Akhilesh Yadav’s cabinet as the middle aged journalist used to expose his illegal activities through alternate media.Read more at; Journalists’ killing: Should India have a law for protection of scribes?

[h=1]Bring new law in 6 months for protection of witnesses: HC tells Maharashtra govt[/h] Mumbai: The Bombay High Court Tuesday directed the Maharashtra government to frame a new law within six months for protection of witnesses and also consider bringing whistleblowers and RTI activists under its purview. The government had last week informed the High Court that instead of a policy, it would come out with a law to provide protection to witnesses in sensitive cases. A draft of the proposed law was also submitted to the court. The issue of protection to witnesses, whistleblowers and activists was taken up suo moto (on its own) by the court after the murder of RTI activist Satish Shetty. The court was today informed that a committee has been formed to look into the issue and a law for the protection of witnesses would be enacted soon. Amicus curie (appointed to assist the court) Dinyar Madon, however, submitted that the new Maharashtra Witness Protection Act will not provide protection to whistleblowers and activists and may give cover only to witnesses in sensitive cases. A division bench of Justices A S Oka and A K Menon then asked the government to consider including whistleblowers and activists also under the purview of new law. The court directed the government to enact the new law within six months. In October 2014, the High Court, while ordering the government to frame a fresh policy, had also directed that protection should be provided immediately to whistleblowers and witnesses even during the investigation stage, if such a person makes a request for protection. Dear All, The newly appointed Commissioner of Police of Gurgaon Mr. Navdeep Singh Virk IPS has withdrawn the security cover provided to undersigned "to teach me a lesson" for raising the a) issue of Gurgaon Police getting verification of servants & tenants from "Hamari Suraksha" (NGO ) without having any formal agreement/written communication between Police & Hamari Suraksha b) For raising the illegal power being used by Sushant Lok Police Station & DCP(East) Gurgaon straight from Pole/Private Party , c) uploading the FIR daily on Police web-site as ordered by Hon'ble SIC & demanding ladies toilet in all Police Station of Commissioner-ate. It is to pertinent to mention that security was provided to undersigned on the order/directions of Hon'ble CIC recorded in a order, The Hon'ble SIC has been notified. It is also interesting to mention that undersigned volunteered to pay for security as I never wanted State to pay for protection of undersigned. Dear All, Kindly provide your considered view whether CIC/SIC is empowered to issue directions to State Police to provide security to RTI Activist if CIC/SIC is satisfied that RTI Activist life is in danger? The learned CP of our City(Gurgaon) in a frank chat with undersigned told me that SIC/CIC has no power but can only recommend under Section 25(5) of RTI Act 2005 whereas my view is that I believe that the CIC/SIC as already mentioned in the notes in the margin against Sections 25(2) and 25 (3) of the Gazette notification of the RTI Act, is vested with the rights monitor and report the implementation of RTI Act by Ministries and Departments of the appropriate Government besides rights to adjudicate appeals and complaints. This position is further buttressed when Section 25 (3)(f) of the RTI Act calls upon the Central Information Commission to submit a report to the appropriate government indicating the effort put in by the public authorities to administer and implement the spirit and intention of this Act so that the report, as given in Section 25(4) of the RTI Act is laid before each house of parliament by the Appropriate Government at the end of each year, as per provisions in Section 25(4) of the Act. The Sections 25(2) and 25(3) read as given below: (2)……. Each Ministry or Department shall, in relation to the public authorities within their jurisdiction, collect and provide such information to the Central Information Commission or State Information Commission, as the case may be, as is required to prepare the report under this section and comply with the requirements concerning the furnishing of that information and keeping of records for the purposes of this section. (3)……… Each report shall state in respect of the year to which the report relates,— (a) the number of requests made to each public authority; (b) the number of decisions where applicants were not entitled to access to the documents pursuant to the requests, the provisions of this Act under which these decisions were made and the number of times such provisions were invoked; © the number of appeals referred to the Central Information Commission or State Information Commission, as the case may be, for review, the nature of the appeals and the outcome of the appeals; (d) particulars of any disciplinary action taken against any officer in respect of the administration of this Act; (e) (e) the amount of charges collected by each public authority under this Act; (f) any facts which indicate an effort by the public authorities to administer and implement the spirit and intention of this Act; (g) recommendations for reform, including recommendations in respect of the particular public authorities, for the development, improvement, modernization, reform or amendment to this Act or other legislation or common law or any other matter relevant for operationalizing the right to access information. In pursuance of the mandate as given in Section 25(2)(f) of the RTI Act to the Commission , and in order to ensure that facts indicating the efforts being put in by the Public Authorities to introduce more transparency in their functioning and in the implementation of the spirit and intention of the Act with reference to the instant case wherein information sought by an RTI activist who has been allegedly threatened, are reported to the Commission be given Police Protection free of cost/on cost as per the capability of the RTI Activist. harinder dhingra

  13. In an order which has far reaching implication, the full bench of national consumer commission has ruled that an RTI applicant was a not consumer under the Consumer Protection Act. National Consumer Disputes Redressal Commission comprising justice Ajit Bharihoke, Dr BC Gupta and justice VK Jain has finally settled the law on the conflict between the Right to Information (RTI) and Consumer Protection Acts. The commission has held that the person seeking information under the provisions of RTI Act cannot be called a consumer vis-à-vis the public authority concerned or CPIO/PIO nominated by it and therefore consumer fora cannot entertain any complaint regarding violation of the provisions of the RTI Act.   17. I am married with my wife on 2008 March. Wife had a conjugal life of hardly 3 months with me, sometime in my native and for 1 month with me, left matrimonial house in 2009. Although my native place is in Raiganj, i live in Kolkata. She and her parents use to abuse me althrough-out. My father expired on April'2012. Earlier father has filed general diary against my wife, her parents on 2010 with local police station and again reported the same on 2011 giving all the details that she does not live with me, not returned bacl and I stay far away from kolkata. Wife filed dVA and maintanance case against me on May'2012. Lower district court send notice to me along with my widow mother and my brother. during june'12. My widow mother accepted her but denied to take notice addressed to me and my brother as a reason that she is not in contact with her children. I have not received/accepted court notice/summons till date although a letter basis court ex-parte judgement on monthly maintanance of 20K and arranging her to stay in my native house was shared to me via protection officer on July 2013. I handed the same to local lawyer. Now court has ordered warrant against me whose executing order is still pending. My wife with help of protection officer brought police along with protection officer, broke lock and keys of my native home last week where nobody stayed. Wife started living along with her mother regularly. Local lawyers told me that there is nothing to worry as because summons/notice were not sent to me through proper channels. Pasting in my residential place, court did not accept the same. No publication in newspaper as well. Although a court record exists that they have sent the same to my kolkata adrress. But I did not acknowldege the same at any stage nor did I recieve. Local Lawyer has done a RTI to get top of it as how the summons were served Particulars of Information to be sought are:- a) To which address the summary of Mr. Suman Ghosh S/O Late Suprabhat Ghosh the O.P No 1 of case no CR 292/2012 of Ld Addl J.M was sent by the protection officer? b) By which process the summons were sent? c) Whether any summon/notice was sent to the address of working place of the O.P No1 Mr. Suman Ghosh of case no C.R.292/12 by the protection officer before 18-12-2012? If so by what mode? d) Whether any summon or notice of case no C.R 292/12 was served upon O.P Suman Ghosh S/O Late Suprabhat Ghosh personally? e) Was there any impediment/objection to serve the summon on him personally? If so what was the reason? Kindly let me know what may be the outcome and how many days does it take to get informations on RTI. I shall be waiting for expert input on the same. Regards Suman
