  1. Appellant had sought information about action taken report on his father's complaint. CPIO denied u/s 8(1)(e). FAA directed the CPIO to follow procedure u/s 11. CPIO asked to the father of appellant about consent. Appellant's father gave his consent to provide information. But again the CPIO denied it u/s 8(a) stating that information relates to National Security. Commission observed that; in providing the substance of inquiry, the allegation therein, its outcome and action taken, if any, do not impact National Security and directed the CPIO to provide the required information. My question is why CIC even did not warn the CPIO? This is clear and fit case for imposing penalty but Commission remained silence. BHADERWAH, July 6: Believe it or not , an applicant who sought information under Right to Information Act (RTI) from Block Development Office (BDO), Bhaderwah, was asked to deposit Rs 55,000 by the concerned BDO who also is PIO. Details available with Early Times reveal that one Khurshid Ahmed, son of Abdul Hamid Wani of Behote Marmat, Doda, moved an application on January 31, 2015, before the PIO/BDO, Bhaderwah under the Jammu & Kashmir Right to Information Act, 2009 wherein he sought information relating to certain schemes like MGNREGA, BRGF, MPLAD, CDF, MLA, MLC and CDN. The applicant sought details of all the panchyats in Block Bhaderwah. The SIC order reads as: "In view of the aforesaid facts and observations, the PIO/Block Development Officer, Bhaderwah is hereby directed to allow the appellant an opportunity to inspect the record in his office on a working day during office hours and provide him certified copies of the relevant documents, if any requested by the information seeker after inspection of record, free of cost under an intimation to the Commission. The parties are at liberty to settle the date and time for inspection of record which may convenient to them. The appeal is accordingly disposed of." Jammu, May 26: The State Information Commission (SIC) has directed the J&K Cricket Association (JKCA) to provide information related to fees provided to a coach under Right to Information Act (RTI) to an information seeker. Earlier the JKCA had provided incomplete information to the information seeker (RTI Applicant) and after the intervention of SIC , the JKCA has been directed to provide the full details which were sought by the information seeker via his RTI applicantion. Case Details : As per details available with Early Times one Rajesh Sharma filed an RTI application dated: 30-08-2011 before Joint Secretary, J&K Cricket Association, Jammu wing. The information seeker sought the following information under RTI Act : 1. Whether draft bearing No. 786854 dated: 17-02-2011 amounting to Rs. 8000/- had been received by one Madan Mohan Sharma or not. 2. Whether Mr. Madan Mohan Sharma, who was appointed on 29-06-2014 as Coach for Under-25 & Under-14 boys was the same Coach who was appointed as Coach in June, 2009. 3. Hello Friends , I filed an RTI request to Department of post Gujarat circle for one document but CPIO stated in his order that document is in exemption list of disclosure under section 8 (1) (j) so I filed an appeal to the 1st appellate officer and he ordered cpio to provide me the list . Later on I got letter from CPIO that submit 40 Rs to get the document as it contains 20 pages so I submitted and sent it to CPIO of dop gujarat circle. but today I got the reply from CPIO and in his letter he stated that document is 20 pages is attached with this letter but I havn't got any document except the single letter . I also know that CPIO is trying to hiding the truth and don't want to disclose that document so I want to know how can I prove that I haven't got any document with letter and Is there any rule in RTI ACT in which we can directly go to the office ,submit prescribe fees there and get the document .I will also send them letter that I haven't received document but CPIO will stick on this that he has already sent the document letter through register post so what should I do now ? Please help me

  11. NAGPUR: The State Information Commission had pronounced a historic judgement bringing Court of Wards under the ambit of Right to Information (RTI) Act seven months ago. But the collector office has not provided the information so far. RTI activist TH Naidu, who had sought information related to auction of Sonegaon lake, fought a two-year-long battle to prove that the Court of Wards falls under the RTI Act. Following the state information commission's order dated July 7, 2014, the collector office had provided information about Sonegaon lake auction to Naidu after much dilly-dallying. Dear All, Kindly provide your considered view whether CIC/SIC is empowered to issue directions to State Police to provide security to RTI Activist if CIC/SIC is satisfied that RTI Activist life is in danger? The learned CP of our City(Gurgaon) in a frank chat with undersigned told me that SIC/CIC has no power but can only recommend under Section 25(5) of RTI Act 2005 whereas my view is that I believe that the CIC/SIC as already mentioned in the notes in the margin against Sections 25(2) and 25 (3) of the Gazette notification of the RTI Act, is vested with the rights monitor and report the implementation of RTI Act by Ministries and Departments of the appropriate Government besides rights to adjudicate appeals and complaints. This position is further buttressed when Section 25 (3)(f) of the RTI Act calls upon the Central Information Commission to submit a report to the appropriate government indicating the effort put in by the public authorities to administer and implement the spirit and intention of this Act so that the report, as given in Section 25(4) of the RTI Act is laid before each house of parliament by the Appropriate Government at the end of each year, as per provisions in Section 25(4) of the Act. The Sections 25(2) and 25(3) read as given below: (2)……. Each Ministry or Department shall, in relation to the public authorities within their jurisdiction, collect and provide such information to the Central Information Commission or State Information Commission, as the case may be, as is required to prepare the report under this section and comply with the requirements concerning the furnishing of that information and keeping of records for the purposes of this section. (3)……… Each report shall state in respect of the year to which the report relates,— (a) the number of requests made to each public authority; (b) the number of decisions where applicants were not entitled to access to the documents pursuant to the requests, the provisions of this Act under which these decisions were made and the number of times such provisions were invoked; © the number of appeals referred to the Central Information Commission or State Information Commission, as the case may be, for review, the nature of the appeals and the outcome of the appeals; (d) particulars of any disciplinary action taken against any officer in respect of the administration of this Act; (e) (e) the amount of charges collected by each public authority under this Act; (f) any facts which indicate an effort by the public authorities to administer and implement the spirit and intention of this Act; (g) recommendations for reform, including recommendations in respect of the particular public authorities, for the development, improvement, modernization, reform or amendment to this Act or other legislation or common law or any other matter relevant for operationalizing the right to access information. In pursuance of the mandate as given in Section 25(2)(f) of the RTI Act to the Commission , and in order to ensure that facts indicating the efforts being put in by the Public Authorities to introduce more transparency in their functioning and in the implementation of the spirit and intention of the Act with reference to the instant case wherein information sought by an RTI activist who has been allegedly threatened, are reported to the Commission be given Police Protection free of cost/on cost as per the capability of the RTI Activist. harinder dhingra

Jammu, Feb 3: While hearing a second appeal related to information about the alleged Jagti township construction scam being investigated by State Vigilance Organisation (SVO), the State Information Commission (SIC) has directed the investigating agency to reveal all the information under RTI once the final investigation report is submitted before the competent court. Fadnavis urged to provide security to RTI activists MUMBAI: A high-level delegation comprising chief information commissioner Ratnakar Gaikwad and information commissioners D B Deshpande, A K Jain and T F Thekkekara recently called on chief minister Devendra Fadnavis to press their demand for protection to RTI activists. "Targeting of RTI activists is a serious issue in Maharashtra and several were either attacked or murdered in the recent past. On demand, the activists should be given adequate protection on a case-to-case basis on merit. Earlier attacks on activists should be investigated on a war-footing,'' Gaikwad told Fadnavis. Pune-based activist Vijay Kumbhar expressed concern over the spurt in attacks and murders of RTI activists. Out of 20 killed between January 2010 and December 2014, seven were from Maharashtra. "The murders are a serious matter. The BJP-led government will have to draft an action plan for their protection. The government must ensure maximum information is available to the aam admi in a routine course,'' Kumbhar said. Gaikwad said besides the murders and attacks, the delegation told Fadnavis that in the larger public interest, there was urgent need to strengthen the institution of the information commission. "A few posts of information commissioners are lying vacant for long, there is huge pendency. There is also an acute shortage of staff at most commissions,'' Gaikwad said. The delegation urged Fadnavis that state commissions should be equipped with a strong legal wing. Gaikwad said there was an urgent need to implement section 4 of the RTI Act, on proper maintenance of records by public authorities and publication of relevant information of each public authority in all departments. SIC no to making service books of 164 officers public The Madhya Pradesh State Information Commission has quashed the order of first appellate officer in which it was directed topublic information officer to provide free of charge information of service books of 164 officers and employees. Generally, the citizens make second (final) appeal to the Commission against appellate officer and public information officer. In a rare case, a public information officer lodges second appeal against the appellate officer.The Commission in its hearing by its commissioner Atmadeep accepted the appeal and rejected the order of the first appellate officer. The rejection of the order will lead to a stop on making personal information public of more than 150 officers and employees along with principal of Govt. What would be the actual fees to be collected from the students from class V to class X for the recognised schools in GHMC Limits, as per the right to education act and respective provisions of the Govt. rules. Also, kindly let me know the List of Schools along with the addresses at which the recognition for that particular school is availed. 2. Kindly provide the information pertaining to the Prirvate Schools, whether all the requirements, such as rules and regulations relating to amenities, open ground, play area, parking place etc., are fulfilled or not. 3. List of new schools waiting for the recognition. I state that the information sought does not fall with in the restrictions contained in section 6 of the Act and to the best of my Knowledge it pertains to your office.
  19. NEW DELHI: The provisions of RTI Act apply on private schools also which are governed by a law such as the Delhi Education Act, the Central Information Commission has held. The case relates to an ex-employee of Jindal Public School who filed an RTI application with Directorate of Education seeking a certified copy of service book and other details from her past employer. The Directorate provided the information available with them but the school refused to furnish the reply saying RTI Act does not apply on it. information sought by its ex-employee, Information Commissioner Sridhar Acharyulu said the school is duty bound under sections four and eight of Delhi Education Act 1973 to abide by the regulatory conditions of service, payment of salaries as prescribed for which school has to maintain records which provide an "inherent and implied" right to information to their employees.
