  1. CHENNAI: A public works department (PWD) official, G Parthiban, has threatened an RTI activist who in a plea had sought information about the public servant. The activist A B Saravana Babu, a lawyer in the Madras high court, recorded the abusive conversation and lodged a complaint at the high court police station.   2. SHILLONG: RTI findings hint towards a major discrepancy in the payment of salaries to muster rolls under the Executive Engineer PWD, Shillong Central Division. As per RTI documents, the sectional assistant of the office, who is responsible for payment of salaries, has not maintained the salary register of the muster rolls properly and glaring errors have been detected in the way the names of the muster rolls were written in the register. As per the RTI documents, the names of some of the muster rolls were written in two different ways. For instance, Dhan Bahadur Pradhan was also registered as Dhon Bahadur and Puranam Chettri as Naram Chettri. Read more at: Page not found | The Shillong Times
  3. A government department in Delhi is making a mockery of the Right to Information Act and is bent on denying information to the people. In a recent answer, given to an applicant, the Public Works Department (PWD) refused to furnish information on a small bridge across the river Yamuna under one of the clauses of the act. Jitender, a resident of north Delhi, was shocked to find the reply of the PWD on a question pertaining to the pontoon bridges of the city, particularly the one which links Geeta Colony in east Delhi to Shanti Van on Ring Road. Jitender wanted to know the details of the tender, floated for the construction of the bridge in the last five years. As the bridge is constructed every year after the monsoons, he wanted to know about the cost escalation and who were the competitors. In his reply, the Executive Engineer of the PWD said he had "no knowledge" about the number of pontoon bridges in Delhi. On the tender document, the reply said, "no spare copy of tender is prepared and retained on the office". The shock for Jitender continued in the further reply of PWD. It refused to part information on the pontoon bridge at Shanti Van taking refuge in the Section 8 (1) (d) of the RTI Act, 2005. The Act says, "information including commercial confidence, trade secret or intellectual property, the disclosure of which would harm the competitive position of a third party" can be denied. The reply said the copy of contract being "commercial confidence" is exempted under the said section of the RTI Act. Jitender said, "How can a bridge which is for the general public be commercial in nature. It is ludicrous to know that even such basic information cannot be provided to the citizens of the city". He plans to file an appeal to the higher authorities. Asked about the reply and whether the PWD was in the habit of denying information to the people, PWD minister AK Walia said this could be one of the exceptions. As reported by ASHWINI SHRIVASTAVA at news.outlookindia.com on April 12, 2011 In a bid to speed up its probe, the CVC has asked Chief Vigilance Officers of government departments to prepare a list of officials who were allegedly involved in corruption while executing Commonwealth Games related projects. It has also asked all civic and construction agencies to put documents related to the Games works carried out by them on CVC's website. A special team of the Commission probing the Games related work for alleged graft has found evidence against senior government officials for rigged tender process, undue haste that led to supply of inferior quality products and poor construction of infrastructure related works. Sources said the Commission will make a department-wise list of such 'tainted' people who were involved in the corrupt practises to take speedy corrective action. "There have been several complaints from Non-Government Organisations and whistle blowers claiming that host of government employees were involved in corrupt practises. We have sent the complaints to concerned CVOs for investigation and report," a CVC official said. He said a complaint has also been sent to the CVO of Sports Ministry to probe the role of certain incompetent officials involved in carrying out infrastructure related works. Sources said the CVC has found series of financial irregularities on part of certain government employees from departments like Central Public Works Department (CPWD), Public Works Department (PWD), Municipal Corporation of Delhi (MCD), New Delhi Municipal Council (NDMC), Delhi Development Authority (DDA) and Games Organising Committee among others. They said the watchdog has received a number of complaints alleging that various "incompetent" people were involvement in several projects that led to unjustified cost escalation and corruption. The move assume significance as Prime Minister Manmohan Singh appointed High level Committee under the chairmanship of former Comptroller and Auditor General V K Shunglu has found series of wrong doings by government officials. The Committee has faulted sacked OC chief Suresh Kalmadi and Secretary General Lalit Bhanot for their alleged involvement in irregularities. Besides Delhi Lt Governor Tejinder Khanna and Chief Minister Sheila Dikshit were blamed for alleged inadequacies in CWG projects. According to an RTI filed by PTI, the Commission is looking into at least 40 CWG-related construction and procurement works carried out by different government agencies for alleged financial irregularities. An analysis by Chief Technical Examination Wing of CVC had earlier found alleged financial and administrative irregularities worth about Rs 2,500 crore in 16 construction and procurement projects. Six of them were done by PWD, 3 by MCD, 2 each by CPWD, DDA, NDMC and 1 by RITES, a Government of India Enterprise, a CVC report said.

  6. As reported at zeenews.com on uly 23, 2010 New Delhi: CIC has pulled up Public Works Department for not keeping information related to illegal occupants in government flats. "The Commission finds this very distressing that for a serious charge like illegal occupation of government flats, no attention has been paid in spite of the appellant bringing this to the notice of the public authority. "Citizens will despair of any correction in governance if public authorities continue to adopt an attitude where they refuse to see major illegalities," Information Commissioner Shailesh Gandhi said in his order. Exercising the Right to Information Act, Dinesh Sharma filed an application asking PWD to provide information related to allotment of houses of type 1,2,3 and 4 in Gulabi Bagh government colony in New Delhi. The applicant had alleged illegal occupancy in a number of houses in the colony. Dissatisfied over the incomplete information given by both the Public Information Officer (PIO) and the First Appellate Authority (FAA), Sharma moved the Central Information Commission. While hearing the matter, the Commission pointed out that the appellant has complained that 957 flats out of a total of 2,128 flats are illegally occupied by unauthorised persons. "The PIO has given a list of only about 1,200 flats, mentioning the people who are in occupation and most of the flats where the appellant alleges illegal occupation are not covered in that," the order said. "The respondent states that the process of computerisation is on and, very conveniently, only records of about 1,200 flats have been computerised and the rest are not on the list. "... The respondent states that they are so busy with Commonwealth Games that they have no time to look at matters like illegal occupation of government property... The Commission hopes that some senior officer will look at this and take appropriate action," he remarked. The Commission has also directed PWD to allow the appellant to inspect records of the total of 2,128 flats.

    Rlys cashes in on Games work as reported by Dipak Kumar Dash,TNN, NEW DELHI: Jun 3, 2010 The Indian Railways may have agreed to pay Rs 100 crore to the Commonwealth Games organizing committee (OC), becoming one of the lead sponsors of the event, but it seems to be raising more money from Games-related work than what it is paying for the sporting extravaganza. The railways has demanded Rs 163 crore from the public works department (PWD) for construction of elevated roads and underpasses across railway tracks. But the PWD has contested the bill showing an RTI reply by the railways in which the latter had submitted that it had charged Delhi Metro Rail Corporation (DMRC) much lesser for construction of an elevated Metro corridor above its tracks. In his reply dated May 12, the assistant divisional engineer (ADEN) of Northern Railway had submitted that the DMRC paid Rs 140 crore for construction of overhead Metro lines in 20 locations. "But in our case, they are charging Rs 163 crore for crossing the railway tracks at four locations only. We have put forward our points and concerns,'' said a senior PWD official. He said in the case of DMRC, the railways levied only 2% supervision charges, but they were asking PWD to pay nearly 19%. Senior officials said the earlier practice was that the railways would carry out the construction of any road project in its portion and would also be responsible for its maintenance. But now, the road construction agency builds the entire stretch. "Despite this change, they have been raising charges as per the old norms," an official associated with the Barapulla elevated road project said. The railways has also demanded Rs 103 crore from PWD for a 4-km elevated road project. "They allow us to carry out construction work only when the frequency of trains is less. Despite this, they are demanding block charges of Rs 25 lakh per track per hour. We don't know whether the revenue is actually passed on to the consumers,'' said a senior department official. He said PWD had told the railways that since the entire corridor was continuous in nature, it would maintain the stretch. Hence, the railways should deduct the maintenance charges, he said. PWD sources said for the corridor improvement work on road no 56 and widening of the rail overbridge at Anand Vihar, the railways demanded Rs 32 crore. For the construction of a grade separator on GT Road, it demanded Rs 5 crore. For construction of a stormwater drain near the airport, the railways asked PWD to pay Rs 23.5 crore. As reported by ketan tare at dnaindia.com on January 12, 2010 Mumbai: A major portion of the Arabian Sea has been reclaimed near Badhwar Park in south Mumbai’s Backbay Reclamation — the stretch which came into focus as the landing spot for Mohammad Ajmal Amir Kasab and his aides on the night of November 26, 2008. Shockingly, the guardian institutions of the city — the BMC, the Mumbai city collectorate and the state government — are either pointing fingers at each other or maintaining a mysterious silence over who has reclaimed this land and for what, revealed a Right to Information Act (RTI) query made by Bharatiya Janata Party (BJP) MLC Vinod Tawde. The reclamation work along the stretch has created a large rectangular ground (see picture) to the right of Badhwar Park at the Backbay Reclamation scheme-3, opposite Manora MLA Hostel. The shoreline adjoining the hostel is also being reclaimed for shore protection installations, the work for which is being carried out by the Public Works Department (PWD), said A Dhamne, ward officer, BMC. The reclamation was first noticed by a staff member of Tawde, who has a room in the Manora hostel, in June last year. Tawde sought details under the RTI from the BMC, the city collectorate, the PWD and the urban development department (UDD) in November last year. None of them had any answers. “The BMC replied to my RTI query saying that the reclamation work may have been carried out by the port development department (PDD) under the PWD and the collector’s office. They forwarded my application to the PDD and the collector. I also filed an RTI application to these departments. Shockingly, my application to PDD was returned because no such department existed at the Navi Mumbai address provided by the BMC. The collector has not replied on the application yet,” Tawde said The UDD forwarded Tawde’s RTI application to the Maharashtra State Road Development Corporation (MSRDC) and asked them to furnish details of the reclamation. “The MSRDC replied that the reclamation was not being carried out by them and they have not granted any permission for the same,” Tawde said. Tawde’s staff member, who noticed the reclamation, said, “I have been watching the Arabian Sea at Badhwar Park since the last eight years. The seafront has been shrunk due to the reclamation. Till two months ago, I saw dumpers carrying soil to the sea shore. Since Vinodji filed the RTI application, the dumpers have vanished. But two machines are still working at the sea shore.” Tawde said that he will raise the issue in the budget session of the legislature commencing from March 18. “The replies to my RTI queries clearly indicate that government institutions are hand-in-glove with one another.     Vanishing lake: HC seeks reply from govt

    As reported at timesofindia.indiatimes.com on 26 February, 2009 NEW DELHI: Within six years, the status of a prominent water body in the national capital has changed from a "wet and clean lake'' to "does not exist'' in the revenue records of the Delhi government. This status change of the natural reservoir in Mayapuri has prompted the Delhi High Court to demand an explanation from the state government and ask for its reply on a petition filed by an NGO, Tapas, which alleged that the 18,000 sq m area rich in aquifers was on its deathbed. V K Jain of Tapas based his petition on an RTI reply he received from the PWD last year which denied the existence of the lake and claimed that the water body was never under its jurisdiction. The petition alleges PWD owned the lake till 2003. "Local MLA Karan Singh Tanwar said as per the land records received from SDM (Delhi Cantt) and Patwari of that area in July 2007, it is informed that this was not a water body,'' the RTI reply of PWD said. Arguing before a division bench of HC, Jain, through his lawyer informed court that PWD's stand was in contrast to 2003 when the common effluent treatment plant was being made near Mayapuri lake. The department was asked to create another water body of the same size in Bawana for which the Delhi Jal Board had given an affidavit. "PWD had also submitted an affidavit claiming to have paid money to the MCD for removing encroachment on the lake located on the ring road near FCI at Naraina,'' the petition said. The lake which was spread over an area of 36,000 sq feet was reduced to half to pave way for the CETP for providing clean water in the area, it added. Urging HC to step in to save the water body, Jain said, "If no efforts are taken to save the lake, it would soon meet the fate of several other water bodies which have dried up because of developmental projects. In fact, except tall promises there are no sincere efforts on the part of the government to revive the dying lakes to ensure ecological balance in the water-parched city.''     PIO office in Pune

    I am a resident of Bavdhan, on Pune-Paud Road. Inspite of this area being under the Pune Municipal Corportion, a few days ago, work for a PRIVATE TOLL PLAZA has started on this road, close to Chandni Chowk. I and some fellow residnts have been opposing the work, but without any positive results. On completion this Plaza is going to create a chaos & nuisance in the laready over congested road. Inspite of the Corporation owning land a kilometer further down this road, near the Octroi Post outskirts of Bavdhan, the officials do not want to change the venue. I want to know, isnt it mandatory for the Corporation to ask for suggestions / objections from residents around the proposed Toll Plaza???? How should I gather information about this project??? Whom do I write to, for asking about the authenticity for proposal of the site of the Toll Plaza???

    PWD officers penalised PANJIM, JUNE 28 – Two PWD officers have been fined heavily for causing inordinate delay in providing information applied under the Right to Information Act. The Goa State Information Commission (GSIC) has imposed a fine of Rs 10,000 on P Arlekar, deputy director of administration, PWD and Rs 5000 on A A Parulekar, Superintending Surveyor of Works for causing a delay of 84 days. Arlekar is the assistant public information officer while Parulekar is the public information officer. The director of accounts has been asked to deduct the penalties from salary bills of two officers. Joao Caldeira of Panjim had sought information under RTI act, in respect of filing up of 33 vacancies of junior engineer, PWD — pursuant to the advertisement published in local daily on October 23, 2005. The Assistant Public information officer did not provide information to the applicant even as application was forwarded to him. But when applicant realized that no information was forthcoming despite reminders he approached PIO asking him to supply information latest by December 17, 2006 failing which he would approach the appellate authority. The GSIC comprising of State Chief Information Commissioner A Venkataratnam and State Information Commissioner G G Kambli held that both officers were responsible for delay caused in providing the complete information to the appellant within the time specified and thus imposed penalty on both.     PWD making mockery of the RTI Act

    A government department in Delhi is making a mockery of the Right to Information Act and is bent on denying information to the people. In a recent answer, given to an applicant, the Public Works Department (PWD) refused to furnish information on a small bridge across the river Yamuna under one of the clauses of the act. Jitender, a resident of north Delhi, was shocked to find the reply of the PWD on a question pertaining to the pontoon bridges of the city, particularly the one which links Geeta Colony in east Delhi to Shanti Van on Ring Road. Jitender wanted to know the details of the tender, floated for the construction of the bridge in the last five years. As the bridge is constructed every year after the monsoons, he wanted to know about the cost escalation and who were the competitors. In his reply, the Executive Engineer of the PWD said he had "no knowledge" about the number of pontoon bridges in Delhi. On the tender document, the reply said, "no spare copy of tender is prepared and retained on the office". The shock for Jitender continued in the further reply of PWD. It refused to part information on the pontoon bridge at Shanti Van taking refuge in the Section 8 (1) (d) of the RTI Act, 2005. The Act says, "information including commercial confidence, trade secret or intellectual property, the disclosure of which would harm the competitive position of a third party" can be denied. The reply said the copy of contract being "commercial confidence" is exempted under the said section of the RTI Act. Jitender said, "How can a bridge which is for the general public be commercial in nature. It is ludicrous to know that even such basic information cannot be provided to the citizens of the city". He plans to file an appeal to the higher authorities. Asked about the reply and whether the PWD was in the habit of denying information to the people, PWD minister AK Walia said this could be one of the exceptions.
