New Delhi: Human rights groups have slated the government for failing to give satisfactory replies on Wednesday to several Members of Parliament who sought details of the non-governmental organisations against whom it has taken action. Amid Wednesday’s furore in Parliament, as many as 18 Lok Sabha MPs from different political parties such as the Congress, Samjwadi Party and All India Anna Dravida Munnetra Kazhagam, raised two questions to the ministry of home affairs (MHA) about its ongoing action against foreign-funded non governmental organisations (NGOs). Nayak filed an RTI application in April with four questions to the MHA’s FCRA division. It was returned on 10 July with no answers. His RTI had asked for a complete list of entities that have been placed under government watch, a copy of all correspondence sent to the Reserve Bank of India (RBI), a copy of replies received from the RBI or any other bank and a copy of the complete list of entities whose FCRA registration has been cancelled in April. The Aam Aadmi Party, which aggressively fought for the Right To Information Act, has now started shielding itself from providing information under the same law on issues concerning its own government in the national capital. From employment to appointments, the AAP administration has been dodging questions under the RTI Act. First, the AAP government refused to provide information about the new appointments it had made after taking over in Delhi.   6. The Rajasthan high court has served a notice to the University of Rajasthan asking that why it is charging higher fees for replying to RTI queries while the prescribed amount is only Rs2. Justice Mohammad Rafiq has made this observation while hearing a petition filed by Yashwardhan Singh. Meanwhile, the court has directed the administration of the university to provide attested copies to the petitioner charging fees as per rules.The petitioner informed the court that he was a student of second year studying law. Under the RTI he had demanded an attested copy of answer book. The petitioner learnt from the website of the university that fee of copy was Rs580 instead of Rs2 as per section 5 of RTI. Thus the practice is wrong. Hearing this, the court has issued notices to the university and the state government and sought reply.   11. Hello, About one month ago, I have started filing applications seeking information under RTI Act. I have some doubts/clarifications/comments from RTI Activits. 1. As per DOP&T letter No.1/1/2013-IR dated 21.10.2014, all PIOs are required to upload (from 31.10.2014) RTI Applications/appeals and the replies on their respective websites. Some PIOs have not started so far. Which authority is required to monitor implementation of these requirements. 2. What is the provisions under RTI Act regarding replies to applications/appeals are to made in the same language (Hindi/English/local language) in which the RTI Application was received. 3. Whether hard copy of reply would be received from for the RTI Applications made on online (in spite of the fact that reply has already uploaded on their website). 4. RTI reply would be sent by the PIO – By ordinary post/By Regd. Post/Speed Post/By courier. 5. Section 4 of RTI Act require All PIOs to disclose/upload certain information on suo moto basis on their website. What are the provisions relating to upload information in respect of a specific activities of a Department (UPSC & SSC examination related information, Ministry of External Affairs related to issue of passports, visas and revenue collected etc.). 6. In my RTI application, I requested for information a) how many RTI applications received in Hindi and replied to Hindi b) Number of RTI applications received from residents of Delhi . The reply received from PIO says – Information not maintained in the desired format. 7. What is the provision under RTI Act to provide facility for applicants who wish to submit the application in person (I requested whether a sign board/notice board was available at the office of Public Authority giving relevant details – PIO contact details, fees payable, mode of payment, time frame for reply of RTI application etc.) 8. I requested for total number of RTI applications received in 2014 – under sub-head a) received by post b) online. They have provided details of online applications. Separate information of applications received by post and in person could not be provided by them. 9. There are cases of RTI applications transferred (fully or part of information) to other Public authority and likewise RTI applications received from Public authorities. How such RTI applications are included or not included in the total RTI applications received in a year. 10. In my two RTI applications I have received reply on 21.3.2015from the concerned PIO. Question: Total number of RTI applications received in 2014 Reply : 1720 Question : Number of RTI applications received by post, online and in person in 2014 Reply : 1877 (Online 433 and By hand & by post together 1444) The questions were same, however total number of applications mentioned in their reply is different. Which one is correct and what next I can do. 11. I requested for how many RTI applications could not be replied in the time frame of 30 days. The PIO informed : Information not maintained in the desired format. I am a beginner and I have many more questions relating to RTI. I do not have the intentions to put any pressure on the PIO, who are supposed to RTI related work in addition to his/her routine duties. RTI Act would be completing 10 years in October this year. India is world leader in I.T. Sector. The software provided by DOPT for RTI related work would be in a position to generate reports/replies to such routine queries by click of a button. Or DOPT may invite public suggestions for the improvement of system/software for handling RTI work.

  13. Delhi Education Department's strategy to duck RTI queries -- transfer applications NEW DELHI: The Directorate of Education, complain activists, has evasion down to a fine art. Activists using RTI to obtain collated data that ought to be available with the DoE headquarters have had their applications pointlessly forwarded to the district and zonal offices and schools - even private ones - for replies. The result: no response at all, a deluge of paperwork or information so scattered, it's impossible to draw meaningful conclusions from it. "They can transfer applications to another public body if they don't have information but HQ transfers blindly," says laywer-activist Khagesh Jha. He'd sought land allotment letters of minority schools. "HQ transferred to the districts and they, to zonal offices. I'm getting responses saying the information is "bulky" - each document is no longer than four pages - and that I should visit each zone and examine it personally. That's 28 trips. This defeats the provision." The DoE transfers queries even to private schools though it's well-known they aren't covered by RTI. Mohit Goel, another activist, had filed a query on complaints related to nursery admissions in private schools. "Complaints are registered with the directorate but the query was sent to the individual schools who then replied RTI doesn't apply for them," says Goel. In case of government schools, he's received replies that, taken together, were "junk or camouflaged." "While private schools are outsideRTI, the law empowers the DoE to collect information from them using provisions in any existing act - such as the Delhi School Education Act and Rules, 1973 - but it chooses not to use that power," says Jha who started filing questions under the Delhi RTI Act 2001 (instead of RTI Act 2005) because "that has no provision of transfer." "But the DoE transfers even these queries." Rajiv Kumar of city NGO, Pardarshita believes this practice began when "Heads of school were made APIOs (assistant public information officers)." "That was done to make filing queries easier. Applicants could submit at the nearest school instead of going to districts offices." Kumar had filed a query on complaints on Right to Education Act violations registered through the grievance redress system. "It was addressed to the district office as complaints are registered with and arguments heard by the district's DDE (deputy director, education). That was sent to the zones that keep no such record," Kumar says. Activists also see this as an appalling waste of resources. "To have 200 schools reply individually when that data can fit on a single sheet is absurd. As Rs.17 per speed-post, you have spent Rs.3,400 and wasted paper," adds Kumar. Then, filing appeals becomes difficult; for each level of administration, there's a different appellate authority. "For schools, zones and districts, it's the regional director, education. If all districts refuse to reply, you have to file 13 separate appeals and one more challenging the transfer itself," explains Jha. For queries filed under RTI Act 2005, the appellate authority is the Central Information Commission; for Delhi RTI Act 2001, it is the Public Grievance Commission. If DoE also needlessly forwards queries to aided schools. "In their case, the principal is PIO and manager, the first appellate authority. In short, you won't get anything." "If the department placed more documents in public domain, the number of queries would automatically reduce. It doesn't and behaves like a post office when queries are filed. They don't even read the questions," complains Jha. To test the system, he'd sought the 2012 Shailaja Chandra Committee report (on review of the DSEAR 1973), even though it's available online. He says the reply turning down his request said, "The report is under consideration."
