Section 9: Grounds for rejection to access in certain cases Without prejudice to the provisions of section 8, a Central Public Information Officer or a State Public Information Officer, as the case may be, may reject a request for information where such a request for providing access would involve an infringement of copyright subsisting in a person other than the State.
  2. Appellant's had requested to provide information which was rejected by the PIO stating, 'appellant paid fee of Rs. 10 in form of court fee stamp which is not proper mode'. Commission observed that; it is clear that fee is not material factor to throw out the RTI request. Non payment of fee is not prescribed ground for rejection of request. The Prime Minister's Office is among the top public authorities to have rejected the maximum number of RTI applications received by them during 2013-14, according to an annual CIC report released on Wednesday. The top slot in the list is taken by Ministry of Corporate Affairs which has rejected 28.85 per cent RTI applications received during 2013-14 followed by the PMO (20.49 per cent) and Ministry of Finance (19.16 per cent). Following them closely are ministries of Power and Home, Cabinet Secretariat, ministries of Personnel and Defence, President's Secretariat, Ministries of Housing and Petroleum and Natural Gas. The data for 2013-14 shows slight change as for the previous three years, Finance Ministry topped the list of public authorities rejecting highest number of RTI applications received by it. Another trend mentioned by the transparency watchdog in its report is that the public authorities are rejecting the RTI applications citing reasons which are other than those listed out in the RTI Act. An RTI application can only be rejected under categories listed out in sections 8, 9, 11, and 24 of the RTI Act which gives various provisions under which information can be denied to an applicant. The analysis by the CIC shows a whopping 44 per cent of RTI applications being rejected by the public authorities in 2013-14 citing reasons as "others" and not giving any of the reasons in the RTI Act for rejecting the requests for information. "This calls for scrutiny and introspection by public authorities to ascertain the reason(s) for rejecting requests for information on the ground instead of judiciously applying provisions of Section 8(1), 9, 11 and 24 of the RTI Act," the report says.

SIC no to making service books of 164 officers public The Madhya Pradesh State Information Commission has quashed the order of first appellate officer in which it was directed topublic information officer to provide free of charge information of service books of 164 officers and employees. Generally, the citizens make second (final) appeal to the Commission against appellate officer and public information officer. In a rare case, a public information officer lodges second appeal against the appellate officer.The Commission in its hearing by its commissioner Atmadeep accepted the appeal and rejected the order of the first appellate officer. The rejection of the order will lead to a stop on making personal information public of more than 150 officers and employees along with principal of Govt.   6. Hi, I sent an RTI to Tamil Nadu Information Commission asking the following questions: a) With reference to Tamilnadu G.O.Ms.No.989, Public (Estt.I & Leg.) Dept., dated 7.10.2005 the applicant can remit the RTI fee through Demand Draft / Bankers cheque / Treasury / Pay and Accounts Office / State Bank of India / Reserve Bank of India. (i) Whether RTI fee can be remitted through District Treasury or not? If yes, What is the procedure to pay in District Treasury? (ii) What is the procedure to remit RTI fee through Sub-Treasury? Whether Sub - Treasury is obliged to give Treasury challan to pay RTI fee or not? (iii) What is the procedure to remit RTI fee through any branch of State Bank of India in Tamilnadu? What challan would be given by SBI to pay RTI fees and Whether it bound to give challan or not? (iv) What is the procedure to remit RTI fee through Pay and Accounts Office? (v) What is the procedure to remit RTI fee through Reserve Bank of India? (vi) The head “0075.00. Miscellaneous General Services – 800. Other receipts – BK. Collection of fees under Tamil Nadu Right to Information (Fees) Rules 2005” [DPC 0075 00 800 BK 0006] is too long to take Demand Draft / Bankers cheque. So many Bankers refuse to give DD and Bankers Cheque in above said Head. Then what action would be taken against Banker under RTI act for violating ART 21, RTI act, GO & e.t.c and what are other remedies to pay the RTI fee? Response The RTI was rejected stating "Procedure to be followed in remitting of fee does not come under the purview of information under section 2(f) of RTI Act, 2005." Can someone please advice me whether should I go first appeal for this reply or should I rephrase the questions in some other way?

    P F withdraw

    Sir I resigned from my company after 27 months, then after 2 Months I submit my PF application to Laxmi Nager, New Delhi, P F office, after 2 Moths I got message from PF office my application was rejected, I ask my company about this but the company saying they are already paid all money to PF office, But I check my balance through web site, balance showing only EE Rs4382/- and ER Rs1341/- only, My individual contribution approximately Rs 16282/- Sir How can I get my PF and what is the next step for this? Dear Sir, I'm having a Oriental Insurance mediclaim policy family floater # 12400/48/2010/29650, under which I made a claim for Rs. 36000/- for my right eye cataract surgery on 5th Jan '11 afternoon, at Hiranandani Hospital, Mumbai. The Raksha TPA was intimated by Fax, email and courier on 7th Jan well within 48 timeline for intimation and all the original docs were submitted to them on 10th Jan. The Raksha TPA website shows that my claim has been rejeted for the following reason. Besides this I ve not received anything in writing from them. "We are in receipt of your claim documents. As per available documents, patient was admitted for Rt.eye cataract. Patient was been admitted on 05/01/2011 and discharged on 05/01/2011.As per policy terms & condition claim should be intimated to TPA within 48 hours from date of hospitalization. Hence this claim stands non payable under Exclusion Clause 5.4" The website also mentions that "24-JAN-2011 BLUE BIRD MAIL SERVICES PVT.LTD(Nonpayable Letter)" which is not received by me so far. I ve made a complain to Oriental Insurance on the same dated 27th Jan as per their website status, and so far not received any comm. from them too. Please advise what should I do next.     Rejection of RTI appln.

    Appellate authority of RBI constituted under the RBI Act rejected my appeal against Ombudsman. When I asked for the information as to why the appeal was rejected withoput granting me hearing I was told that there is a lower officer who examins the appeals and rejects the appeals not found substantive. When I asked the inspecvtion under RTI I found that the case was never seen by Appellate Authority who is the Dy Govorner of RBI. Also I doubt that some papers were attached after I asked the inspection. Most important is that I had asked the data as to how many appeals were rejected without hearing and how many of them were of the banks and how many were of consumers. i received a reply that the data in not maintained in that format. Secondly, I asked an insurance company about the master policy details of a cover note issued by a Master Policy Holder. Insurance company played hide n seek for about an year. After that i asked for the info under RTI. They rejected it as it was a third party info. I asked for the inspection of file of my RTI case which was rejected. They have again rejected the same stating that my application amounted to challenging the rejection and therefore I should approach the Appellate Authority who he is sure would support him being [quite obviously] party and guide to the reply. Could you pl guide me if there are any citations of Supreme Court or CIC to substanciate my appeal in above cases ?

Centre gives babus right to rejection AS reported by Vineeta Pandey, DNA India, Friday, July 11, 2008 Ministry of public grievances tells bureaucrats to turn down wrongly addressed RTI pleas NEW DELHI: The next time you file a right-to-information (RTI) application, do not be surprised if it is turned down with the babu line "not our jurisdiction". Providing an escape route to bureaucrats facing a fusillade of pleas seeking information under the RTI Act, the ministry of public grievances has told its employees not to dig too deep but turn down applications that do not directly concern them. Interpreting the Act in its own way, it told all departments, ministries and organisations in a recent communiqué that if an information sought is scattered and involves more than one public authority, the public information officer (PIO) should tell the applicant to file separate applications to other departments/organisations concerned after releasing information pertaining his/her office. Drawing attention to section 6(3) of the Act, the ministry has concluded that if the receiver of a query thinks there is more than one relevant public authority involved, he or she is under no obligation to transfer the query or gather information. "Collection of information, parts of which are available with different public authorities, would amount to creation of information which a public authority under the RTI Act is not required to do," the communiqué reads. The circular is a clear departure from the present RTI Act practice where PIOs are expected to route an application to the right authority if it is wrongly addressed. But now, there won't be any such obligation. RTI activist Arvind Kejriwal is livid and plans to move court in case the circular is not withdrawn. "Governance is a complex matter and many people file RTI applications to wrong addresses. The onus is on public servants to help an application reach its destination.     will my rti be rejected

    i have given an rti application to the rpo asking of some information. in one of my questions it is framed as such The cause of delay in issuing me the passport? will asking for the cause (since i am a liitle confused that asking "why" makes an application liable to be rejected.please repy so that if it is wrong i can submit another one.i am uploading my complete aaplication which i made to the pio ..plz reply
  13. Hi, Here is my situation - My University here at Indore (Devi Ahilya VV) has a procedure to show answersheets by paying Rs 250 per answersheet. I applied for that and they allowed me to see the answersheet. However, they refused to give me the photocopy or even take digital pictures of it. To me, it doesn't make any sense to just eyeball the answersheet, if I am not able to make a copy and take it home or to a professor to analyze it and understand what mistakes I did. Neither can I do anything if I want to file a case against the University for negligence in evaluating the answersheet. Anyhow, I filed an RTI application to the Univ. asking them for the photocopy and they promptly sent a rejection letter saying rules of the univ. does not permit it. The rejection letter does not mention any appellate authority. Now, my question is whom should I file the first appeal to??? (BTW, I checked out the faq and it gives the details of how to file the first appeal but couldn't find whom should I file it to.) I will appreciate any inputs. thank you, Hanu.
