    Humorous reply of PIO

Appellant had sought information regarding a second MD/MS in another speciality and the list of colleges which allow the same. The PIO replied that the regulations are silent in this regard. He further stated that he is not aware if a particular state council prohibits the same and same will have to be checked through DGCA website, after which a reply can be given. Commission directed the PIO to provide a revised reply to the appellant. CPIO is Deputy Secretary and Legal Assistant, Medical Council of India. CIC_YA_A_2014_000688_M_159550 (1).pdf

As the Right to Information Act completes a decade, Sunday Times takes a look at how India’s landmark transparency law is faring. As the Right to Information Act completes a decade, Sunday Times takesa look at how India's landmark transparency law is faring:How many of us have ever filed a query under RTI? Data mined by the Commonwealth Human Rights Initiative (CHRI) shows that an estimated 40-50 lakh people over the age of 18 used RTI between 2012 and 2014 — that's 0.5-0.6% of the electorate. However, there has alsobeen a 57% spike in first appeals over thelast year, taking them to 94,945. This shows rising dissatisfaction with replies received under RTI.Read more at: http://m.timesofindia.com/india/RTI10-Reply-awaited/articleshow/48036150.cms

Ashwin obtained all documents, related to the case of corruption in the anti-graft ombudsman, under the RTI Act from the Lokayukta Registrar’s office on June 30, the very day he filed a writ petition before the Karnataka High Court. A copy of the Lokayukta’s letter dated June 28 to the State government recommending constitution of a Special Investigation Team (SIT) has also been issued to Ashwin. PIO Reply by email

Hello, several of us have sought information similar information from a an autonomous institute under GoI. The PIO has sent a similar reply to all by email where the header soes not show the email address of the applicant. In the chain mail sent to all applicants the email addresses of the applicants can be hidden by putting them in bcc. Further there is no signature and seal of PIO. We had requested for providing the information by post. Can the PIO take the liberty of sending reply by email. Many of us may not have access to internet services. What are the provisions under RTI act in this regard. Thanks

  11. Dear All, I have been behind authorities in NOIDA for some time now. They have tried not to answer my RTI on this subject twice. Earlier this was because of information not pertaining to our department (i used section 6(3) this time). This time they seems to have found new way. I fail to understand what they actually mean here. Could someone please help me understand this and suggest steps ahead. Here is the reply: Background: We filed a complaint and few reminders to CEO, NOIDA Authority. They did not reply to complaint for 6 months. So we filed following RTI: Questions asked: 1.Date of receipt by my complaint (Appendix A & B) in the office of NOIDA Authority and inward number. 2.Daily progress on my complaint from date of receipt till date of this RTI application. 3.Names, designations, and office addresses of officials with whom my representations were lying during this period and date wise period with each official and details of action taken by him/her. 4. Evidence of receipt and dispatch of my application in the offices of each of these officials. 5.Number of days within which matter of representation should have been resolved according to rules or citizens charter or any other order or public service enactment. Please also provide a copy thereof. 6. Details of action taken by the controlling authority against erring employees, if employees have not adhered to time limit mentioned in rules. 7.If no action has been initiated as above, reasons on record be made known to me, with name, designation and contact details of controlling authority of these employees. [Ref: section 4.1.d of RTI Act]. 8. Present status and date by which this matter will be completely resolved. 9. File notings, if any held on my said representations. 10. Number of complaints received by NOIDA in last one year against the builder/ developer on similar subject. 11.Name, designation and address of Nodal Officer designated to receive and decide on notices under section 80 of CPC relating to your office. 12. Name, designation of head of vigilance department, his address, email Id and phone/mobile number to whom complaint can be lodged by me against your office. 13. Please permit me inspection of relevant records with assistant of my choice. 14.Incase I am not satisfied with your reply then the contact details of the first appellate authority who can be approached for filing the first appeal. regards!
  12. Hello, I filed for inspection of files. I had given specific instructions to call me whenever reply is ready & asked him to keep all documents ready at the time of receiving reply. I said I will come personally. Hence I visited office at least 5 times in 30 days. Finally I went to office with written request to allow me inspection of all documents within 30 days. I went to office on 28th day. Now PIO was on leave for 13 days keeping my application pending. His clerk made reply probably. When I went to office & I asked who is the next authoritative person, nobody came before to meet me. The person who is working under him pointed out to meet clerk. I went to clerk & asked about status. He told me he has made reply. He had misled every queries in that application & forced me to pay only. I told him that I had asked for inspection. he refused me for it. He refused to accept my letter cum request. Finally I had given this letter to official dispatch section. Since PIO was supposed to resume duty after my 30 days limit, It was impossible of compliance of my request. I left office by 4.10 in the evening. The clerk then dispatched reply at 4.45 pm theu registered post by taking sign from same guy who refused me for compliance. In that case what is the status of that reply? He has signed on reply (for PIO). Can reply become legitimate if signed by person other than designated PIO? I faced thus situation twice in last 35 days. In both cases, the designation of signing persons are lower than that of PIO. In same case. signature authority had mentioned his post only without mentioning Public Info officer with his designated post . So can both reply supposed to be legitimate? Can I say that PIO has not sent reply? violation of section 7(1) Any way in both cases I was cheated by PIO deliberately as they will be exposed & may face suspension for their corrupt crimes.

I am having following queries, Kindly guide: 1. '30 Days to reply' : The initial date will be calculated on the basis of date of application or date of payment? Should I go for FAA in my case? 2. Different receiving date: The PIO wrote me 13.04.2015 as receiving date of application, but Indian Post send me successfully delivery message of speed post on 9.04.2015. 22. Information sought on Modi's foreign travel expenses 'too vague and wide' to be revealed, RTI reply from PMO says CHENNAI: "Information sought is too vague and wide." That was the response from the Prime Minister's Office (PMO) to an RTI application about the amount of money spent on foreign visits made by Prime Minister Narendra Modi since he assumed office on May 26 last year. In response to an RTI application filed by TOI, the PMO said Modi made eight foreign trips in 2014, of which he spent a maximum of five days in the US. The reply said Modi had spent four days each in Brazil, Australia and Nepal followed by Japan (three days), Myanmar (two days), Bhutan and Fiji (one day each) in 2014. Nepal is the only foreign country which Modi visited twice -- from August 3 to 5, (state visit) and from November 25 to 27 (to attend the SAARC summit). Of the 220 days in office last year (from May 26, 2014 to December 31, 2014), Modi was abroad for 24 days. This means he was in a foreign country once in nine days since he became the Prime Minister. Modi is currently away on a five-day visit to three island nations - Seychelles, Mauritius and Sri Lanka -- which is also his first foreign tour in 2015. Modi is also expected to visit France, Germany, Canada, China, Russia and Turkey in the next few months. In 2011, the Central Information Commission instructed the cabinet secretariat to disclose the amount spent on the travel of ministers and VVIPs because of 'large public interest' in the matter. Though the PMO now stonewalled queries related to the money spent on Modi's foreign tours, in 2013 it disclosed the amount spent on the then Prime Minister Manmohan Singh's air travels expenses -- Rs 642 crore in nine years. The amount was revealed under the mandatory proactive disclosure clause of the RTI Act. Interestingly, the PMO has disclosed only the domestic tours of Modi on its website under RTI Act without mentioning the amount spent or the list of people who accompanied. The Prime Minister made 48 domestic tours since May 2014, of which 19 were for non-official purposes, according to the website. It revealed that Modi had visited Maharashtra 12 times in the period followed by Jammu & Kashmir (nine), Haryana (seven) and Jharkhand (six). Not surprisingly, all these states had elections in the recent past. The Prime Minister did not visit states like Tamil Nadu, Kerala, Bihar, Odisha, Punjab and West Bengal. These states did not have any major elections in this period.
