Hello, I had filed RTI seeking status of FIR which I filed and copy of Charge sheet filed in the court by the Police , PIO has been replaying asking more time on account administrative challenges in filling the charge sheet in court hence he is unable to provide the copy, now I have exceed time limit its already 3 months , I lost the opportunity file FIRST appeal , should I have to start all over all again with fresh RTI application. what should I have done before correctly

Hello People, I have applied for patta transfer of my land several months back and since they made me run to and fro from one office to another, I filed an RTI query to the PIO in the thashildar office, and he rejected my appilcation without proper grounds So i quoted my initial application and the rejection letter from PIO and appealed to TNSIC Its been more than 2 months, I have not got an acknowledgement from the office nor any other response till now ! How can i proceed from here ?
  5. KOCHI:Gone are the days when information officers returned RTI queries with the lame excuse of ‘file missing’. In what could be termed as a major step towards ensuring proper response to RTI queries under the RTI Act, the State Government has issued a circular warning that improper replies by public information officers could invite penal action, including imprisonment for 5 years. RTI activists welcomed the circular, and opined that it would put an end to the practice of officials purposefully hoarding important files. Director General of Prosecution T Asaf Ali said that public authorities could not refuse any document, which they are legally bound to provide, with lame excuses. “If they say that a particular document was destroyed, it is to be assumed that it was destroyed with the malafide intention to deny access. If a document has ‘gone missing or found to be stolen’, an FIR should be filed,” Asaf Ali said, adding that the circular would bring in a major change in RTI activism. The circular was issued by Special Secretary to the Government P S Gopakumar following a Delhi High Court judgment and an order by the Central Information Commission (CIC). The CIC held that pleas by public authorities stating that files containing the information sought for are missing or are not traceable could not be deemed as a valid exemption under the RTI Act, and that pleas of missing files tend to discourage the very objective of the RTI Act. The circular states that unless proved that a record was destroyed as per the prescribed rules of the destruction/retention policy, it is deemed that the record continues to be held by the public authority concerned. “Claims of files missing/not traceable have no legality. It amounts to breach of the Public Records Act - 1993, which is punishable with imprisonment up to 5 years or fine, or both. A public authority has the duty to initiate action when a public record is lost. Every public authority should prescribe the record retention schedule, and destruction of documents should be carried out under competent administrative supervision, with records showing that the documents were destroyed on expiry of the retention period. The circular also asked all government institutions in the State to formulate a record retention schedule and to ensure that records are destroyed only in accordance with such stipulation, and also to publish the same on the official websites. Hello experts, I am from Tamilnadu, I have given for transfer of patta several months back, every time some one call from office and ask to come in person and then say it is pending in 'X' office or "Y's" office So i filed an RTI applicationto get to know details, .. I pasted 5 nos of 2 Rs Court stamp in the application next to the sender's address along with all the proof of applications for transfer of patta. They responded after 30 days saying the village and survey number is not clearly stated so we cannot reply to your questions Even though its clearly evident in initial application, I responded to their reply stating the survey number and village in words (This time since its a reply, there were no stamps affixed by me) After 30 days of my reply, i have received a response saying that your application is rejected since you did not attach the receipt of RS 10 court fees ! ! Do i have to attach court fees stamp every time ? If the stamp was missing, the PIO should have stated that in his first reply right ? instead he said survey number and village is not clear ! How do i proceed ? Kindly advice
  7. Respected Sir, How can we prove on which date the PIO received RTI request and whether the PIO responded within 30 days? What will be the action taken against the PIO if he miss a 30 day time frame?

MADURAI: A petition has been filed in the Madurai bench of the Madras high court seeking its intervention to get information under the RTI Act on the appointment of 23 district judges in Tamil Nadu. In his petition, Madurai-based K Kathiresan said he submitted an application to the Madras high court registrar (administration), who is the public information officer (PIO), on November 25 last year seeking the copies of application forms and police verification reports of the 23 district judges (entry level) who were appointed in 2013. [h=1]SIC’s Response Criticised[/h] THIRUVANANTHAPURAM: A social activist has cried foul over the State Information Commission’s (SIC) response to his query under the RTI Act which sought information regarding the possibility of receiving documents related to junkets carried out by government servants. Last month, social activist Sabu Stephen from the capital had sought information on whether passports of government servants are available for public scrutiny. In case of their availability, he had also demanded furnishing of government orders, circulars, laws, rules and court orders and directions which facilitated such rights to the populace. However, the SIC, which according to the Act, should have primarily rejected the query in case the information sought for is exempted from disclosure, received it, only to reject it later after an inordinate delay of more than one month. Hello, I have submitted my first appeal regarding ICAR NET with Indian Council of Agricultural Research (ICAR) Hqrs. on 21/1/2015 & it was forwarded to the CONCERNED FIRST APPELLATE AUTHORITY as on 21/01/2015 (Appellate Authority Details :- Telephone Number:- 01125846730, Email Id:- nsrandhawa.icar@nic.in). But until today the authority did not respond to my first appeal. I want to know what I should do as one month from appeal is over, or what is the time limit that first appellate authority should respond. thanks in advance

  17. Hi, I have filed an application for PF transfer (EPFOG/R/2014/60834), this has been physically transferred to Public Authority :- Ro- Gurgaon. Since there is no response even after 30 days, I have tried to file First appeal. But for Ro- Gurgaon office First appeal has to be filed in physical mode. My concern is, when a ticket is raised and not responded, how could my letter will be considered. I am very upset of chasing Government offices, I have also raised request to PM office (PMOIN/R/2015/60186) on the same, but they also transferred the ticket to concerned office. So how to know my information ? Many might get benefit of this RTI online - but for me this is again waste of money and time. Kindly provide your suggestions and help me in getting my information. The Hindu, 18 Jan 15, New Delhi, Mohammed Iqbal RTI reply supplied to lawyer Amit Sahni reveals that there is no written guidelines regarding installation of ACs in Tis Hazari and Patiala House court complexes. However, the RTI reply said the work in this regard was in progress. Mr. Sahni said he had noticed that in Tis Hazari court, ACs were installed in the offices of almost all the clerical staff, but surprisingly, not in all the court rooms. The issue relating to the need for installation of ACs in the two important court complexes in the Capital, visited by thousands of litigants every day, has been brought to the Delhi High Court by a lawyer, who had earlier sought information in the matter through the Right to Information Act.     response time

    Hi All, I have seen in case of many applications that PIO sends the reply by general post which sometime takes months to reach us . I have noticed that in few cases i have recieved the reply after 4 months of actual date of sending the application and by than the response becomes useless . Whats the actual rule and process for the same???
  20. Hi, I do not have practical experience of using RTI. When officials send a response to an RTI query, are they supposed to follow a numbering system, or does any such system exist in actual practice, that could indicate whether the response is a denial or whether it is a memo about forwarding the query to another office or whether it is providing the information requested by the applicant? If such a system is followed, the numbering could further indicate the RTI sections under which the denial or forwarding has been done. If no such system exists, could such a system be proposed? It could help not just the applicants but the apex RTI bodies and the watchdogs too. Regards Mumbai Civic
