  1. Hello, Whether is it proper to 1st appellate authority to direct his sub- ordinate who is below the rank of PIO in appeals to hear 1st appeals? What to be done? An application under RTI as been filed u/s4(1)d for reasons to appellate authority who is PIO to office.

FEROZEPUR: The Punjab State Information Commission (PSIC) has issued bailable warrants against Ferozepur district revenue officer (DRO) for not appearing before it and not disclosing information sought by an applicant under the Right to Information Act. While issuing warrants, the state information commissioner also instructed Ferozepur senior superintendent of police to ensure receipt of warrants by the officer concerned. Complainant Swaran Singh, a resident of Mahmood Khane Ke village, had sought information from the information officer-cum-district revenue officer under RTI Act. KOCHI: State Information Commission has issued notices to two revenue officials in Ernakulam for not providing information under Right to Information Act (RTI) on use of land reoccupied in the eviction drive on MG Road in 2007. The drive against encroachments on MG Road was launched by the district administration while A P M Mohammed Hanish was the district collector. In an RTI query filed to Ernakulam Collectorate, advocate D B Binu, secretary of Human Rights Defence Forum, sought information on how the land that was reoccupied by the government through the 2007 eviction was put to public use. Records related to the eviction, including the sketch prepared for the eviction and the directions issued, were sought by the RTI activist. Further, information was sought as to how many encroachments were evicted on MG Road, from whom all the evictions were made, and for what public use, such as parking, was the reoccupied land used. State information commission said in its order that then deputy collector EJ Gracy, who was the public information officer, and Kanayannoor additional tahasildar C K Venu failed to provide timely and correct information to the applicant under RTI. The commission will take action against the two revenue officials as per section 20 of RTI Act, the order issued by state information commissioner MN Gunavardhanan said. As per section 20, the commission can recommend for disciplinary action under the service rules applicable as well as order the officers at fault to pay a fine up to Rs 25,000. Asking the officials to showcause for not taking action against them, the Commission has ordered the revenue officials to provide the information sought for under RTI within 10 days.   5. Though the ACB finally sent the details sought by C.J. Karira, the activist has questioned the delay of more than three years in furnishing the information. “The sad part is that this kind of information is available on the websites of the Central Bureau of Investigation (CBI) and the Central Vigilance Commission (CVC). I wonder why the ACB initially said it can’t give the information,” he wondered. As per the documents give by Mr. Karira, his Right to Information (RTI) application dated May 12, 2012, was initially rejected by the ACB in its response dated June 16, 2012, in which it stated that the details of the 91 cases were ‘exempted’ from disclosure under section 8(1) (h) of the RTI Act, 2005.’ “Only after three hearings, they finally gave the information.   8. Residents say that in order to buy a Re 1 stamp they have to shell out much more money just to reach the mini secretariat. "It is mandated by law to affix a revenue stamp for every cash transaction that is over Rs 5,000. There are about 36 post offices in Gurgaon but none of them sell revenue stamp which causes lot of inconvenience to the general public as they have to travel a long distance to get the stamp," said Aseem Takyar, who filed a Right To Information application on the issue. He said the issue could be resolved if the state government wanted to. "All it needs to do is agree to pay the commission sought by the postal department like every other state in the country that has agreed to do so," Takyar said. "I filed the RTI in the postal department in Delhi and they in turn forwarded it to several postal offices in the country. Recently, I received over 500 replies from different post offices and all of them maintained that they received 10% commission from their respective state government for every revenue stamp sold," he said. Evaluating the nature of complaints received during his two-day visit to the city, Mr. Babu said performance of the department in addressing the people’s complaints under the RTI Act was poor. “During my visit, I found officials dozing at office, with many chairs empty. Even, the board displaying RTI-related information was stashed away near a trash can and there were no records of any RTI cases,” he said. Most of the times the attendants at DELHI METRO RAIL CORPORATION parking sites fleece the motorists and charge the higher rate of parking fees even if there is a negligible delay of say 5-10 minutes, to extract this additional amount at times they get into arguments or even foul language with the parking users. At times paper coupons(slips) are issued by the parking attendant in place of using the computerized hand held machines to issue parking slips. Apparently this additional amount collected above the value of coupon issued is pocketed by these parking attendants. I had requested that the following information from DMRC, New Delhi under the provisions of Right to Information Act 2005: i. Please provide details of the process of awarding parking contracts at DMRC stations ie. Tender and bidding process etc. ii. Whether these contracts are assigned on one time payment basis to the highest bidder at the time of award of the contract or on the basis of revenue sharing as an ongoing process. Please provide details thereof. iii. Please give specific details of amount/revenue received, for which the contract has been awarded in respect of the 95 DMRC stations as per the list enclosed. Giving the periodicity ie. Annual/Quarterly/Monthly/Revenue Sharing. iv. If the contracts have been awarded on revenue sharing basis what measures are adopted by DMRC to keep a check on the amount of revenue collected by the parking contractors at the respective metro stations. Please provide details thereof. v. Whether any uniform or identity cards have been issued to the attendants manning the DMRC parking sites and whether it is mandatory for them to wear them. vi. Whether it is mandatory for the parking contractor at DMRC parking sites to use computerized hand held machines to issue parking slips. Please provide specific details. vii. Whether it is mandatory for the parking contractor to issue a receipt to the motorist for parking fees collected at the time of exit from the DMRC parking. viii. Please provide details of measures are adopted by the DMRC to ensure that the parking contractors do not park vehicles more than the allowed number at spaces earmarked to them. ix. Please provide details of surprise checks, if any conducted during the last five years at the DMRC parking lots across the city to ensure whether their directions are being implemented by the parking contractors or not. x. Whether the contract details along with the MoU between DMRC and the parking contractors have been provided on the Web site of Delhi Metro under the provisions of Section 4 of Right to Information Act 2005. Please give details thereof. And if not details of persons responsible for willfully not allowing this information in public domain. xi. Please give details of free medical aid, drinking water and toilet facilities being provided at these 95 metro stations. Strange are the ways that these Public Information Officers adopt to hide the wrong doings of their departments. The reply that I got from DMRC in response to my above queries goes as under : Kindly refer to your application seeking information under the RTI Act, 2005 received by PIO 2 cell on 29/08/2011. The information sought by you is voluminous in nature. Therefore, DGM/Civil & Structure who is the deemed PIO as defined under Sections 5(4) & 5(5) of the RTI Act, has informed that you may inspect the available records on 10.10.2011 between 15.00 hrs and 17.00 hrs in Metro Bhawan, New Delhi. May I request the members on this forum to help me in how to proceed further : i. I am not able to make it out that how can simply the information requested for (without copies of documents requested for) be voluminous in nature. ii. Is it mandatory for me to appear before the deemed PIO for a physical look at the information. Simply looking at the information may not help as answer to many questions need to be given by DMRC only. iii. Can I appeal to the Appellant Authority against this requesting for the information to be provided in written form.

    iam new to this site want to know , how to file an rti petition... how to track it... i enetered in to buisiness and want to do it ethically without giving bribes or cheating anyone getting inspired by big names like tatas, infy ... unfortunately i entered into realestate wher bribe has to be paid for every paper....soem one pls suggest me how to file an rti ..my first rti would b y dont ppl in revenue dept give an acknowledge with file num when an application is given to them , in major cases ..they run only on bribes and not on priority basis..soem on efrom banaglore pls respond... i feel india is great just bcoz iam an indian ..if iam an alean from mars who has to live on earth .. ,would never prefer india ... thousands other also wont... lets make india better
