  1. If the CBSE exam marks are available online now, then there can be no claim of right to privacy for the previous students, the Delhi high court said on Thursday. The court’s observation came during the hearing of the Central Board of Secondary Education’s (CBSE) plea challenging a Central Information Commission (CIC) direction allowing inspection of Union minister Smriti Irani’s Class 10th and Class 12th records to an applicant under the Right to Information (RTI) Act. “Are all the CBSE marks of students available in the public domain today? If it is possible today, then you cannot say there is a right of privacy qua results of earlier students,” Justice Vibhu Bakhru observed. Disciplinary proceedings are not human rights violation and security agencies, exempted from the purview of the RTI Act, need not provide information on such issues, the Delhi High Court has ruled. The ruling by Justice Vibhu Bakhru came on a CBI plea challenging a Central Information Commission (CIC) order directing the agency to provide one of its officers the status and details of disciplinary proceedings against him. The court set aside the CIC’s order of June 9, 2017, saying that the commission “fell in error” by issuing the direction. The verdict assumes significance as agencies which are exempted from the purview of the Right to Information (RTI) Act, are required under the transparency law to provide information they have pertaining to human rights violation and corruption. Even if a public authority has the power to call for certain information, it is not mandatorily required to seek the data to provide it to an applicant under the RTI Act, the Delhi High Court has held. The court said that the authority can only provide information which is available with it to an applicant under the Right to Information (RTI) Act. "The Act is available to make transparent any information that they have. You cannot ask a public authority to mandatorily procure an information, even if they have the power to do so," Justice Vibhu Bakhru observed. The observations by the court came while disposing of a plea challenging an order of the Central Information Commission (CIC) which had declined to direct the Delhi government to call for further information from a private unaided school regarding terms and conditions of service of its employees. In a landmark judgment, the State Information Commission (SIC) on Saturday ruled that the religious or public trusts that are receiving financial aid or grant from government agencies, the amount being less than their actual turnover, cannot be liable to provide information under the Right to Information (RTI) Act. Chief information commissioner (CIC) Ravindra Jadhav issued the order in favour of the trustees of Shri Laxmi Narsinha Devasthan at Nira Narasinhpur near Indapur, around 170 km from Pune. In his order, Jadhav stated that trusts receiving meagre financial aid from the government do not fall under the definition of public authorities and hence are not required to have a public information officer (PIO) nor respond to queries under the RTI Act.   5. The Bombay High Court had rejected a plea by Maharashtra government to review an order passed by the Court asking the State to pay costs of Rs1 lakh to a petitioner. The Bench of Justices Abhay Oka and Anil Menon, in an order said, “This person has helped unearth a scam, a problem within your system and has helped you save on a lot of money. But the State feels paying him is burdensome. The application is rejected.” In November last year, the HC had asked the State government to pay Rs1 lakh to Pune-based Shrikant Karve as cost incurred to obtain vital documents related with the case and appearing in person several times for the hearing. “The orders and the documents placed on record will show that repeatedly he (Karve) took recourse to the provisions of the Right to Information (RTI) Act, 2005 and obtained vital information. Only because of his efforts that fraud played by one officer at Pune could be detected. Considering the nature of prayers made in the Petition, the nature of the directions sought and nature of directions issued, the petitioner has absolutely no personal interest. Expressing displeasure with the revenue authorities for their failure to disclose records pertaining to prime government lands at Kapparada and Marripalem villages in Visakhapatnam district of Andhra Pradesh in spite of a direction issued by the Information Commission, the HC has recently directed the revenue authorities concerned to furnish the information sought by the petitioner with regard to the above lands under the Right to Information Act, and granted four weeks’ time for the purpose. Universities can only levy fee specified as per RTI Act for answer sheets and other documents issued under the Act even if there is a separate regulation for charging higher fees, the Kerala High Court has held. The ruling by a division bench of the court was after considering an appeal (W.A. No. 2193/2017) filed by the University of Kerala challenging an order issued by state information commission. While the university was charging Rs 500 for an answer sheet, it was ordered that only Rs2 can be collected for each page while providing the information under provisions of RTI Act. A single bench had upheld the state information commission's order and the university had filed an appeal, which was considered by the division bench. The university had contended before the division bench that even if an application for obtaining information regarding an answer sheet is filed under RTI Act, the applicant is liable to pay the prescribed fee as the university has framed regulations fixing the fee.   8. The Delhi High Court today asked the President's Secretariat to disclose information on whether it had objected to a high rise apartment complex being built near the Rashtrapati Bhawan here. Justice Vibhu Bakhru, however, said any input received from security and intelligence agencies on the issue need not be disclosed till the Central Information Commission (CIC) decides whether there was any element of corruption in the matter. The observation by the court came in its order disposing of the secretariat's plea challenging the CIC's direction to it to disclose whether it had raised any security concerns regarding the construction. The court said that since the secretariat has admitted before it that it had raised security concerns regarding the high-rise construction, "there was no occasion" for it to deny disclosure of the information. Why should the Narendra Modi government withhold information on a loss of Rs 12,000 crore to the exchequer during the UPA government due to an alleged understating of accounts by six telecom companies between FY 2006-07 and FY 2009-10? With the Department of Telecommunications refusing to act on a query in the matter, the Central Information Commission (CIC) has now issued a show cause notice to its central public information officer (CPIO) demanding to know why action should not be taken against him for denying this information by not attending the hearing. The query had been filed by Harinder Dhingra on June 12, 2017 in which he had sought “a copy of the recovery notice and the reply sent by each telecom companies regarding the demand notice that was issued to six telecom companies (namely Bharti Airtel Ltd., Vodafone India Ltd., Airtel Ltd., Reliance Communication Ltd., Tata Teleservices Ltd. and Idea Cellular Ltd.) for understating their accounts from FY 2006-07 to FY 2009-10, which caused revenue loss of approx. The central information commission (CIC) has directed the finance ministry to reply to a year-old RTI application seeking details of the amount of black money collected by the government after demonetisation. The direction came on an RTI plea filed by Khalid Mundappilly, who had approached the Prime Minister's Office (PMO) on November 22, 2016, after PM Narendra Modi announced a ban on currency notes of Rs 1,000 and Rs 500 on November 8. Solving the black money problem was one of the reasons cited by Modi for the demonetisation move. "Kindly let me know the amount collected as black money," Mundappilly had asked. His query did not receive any response within the mandatory 30-day period after which he filed a complaint against the PMO before the CIC on January 9, 2017. Chief information commissioner R K Mathur, however, spared the PMO from penalty under the RTI Act after its officials tendered an apology for the delay in responding to the RTI application. "The respondent is directed to advise the 'deemed CPIO' viz the in-charge of the section concerned to be careful in future and adhere to the timelines prescribed in the RTI Act," Mathur said.   11. The Supreme Court today disposed of an appeal filed by Goa Raj Bhavan relating to applicability of RTI Act to Governor’s office. Interestingly, the case has its genesis in an RTI application filed in 2007 by the current Goa Chief Minister Manohar Parrikar, who was then the Leader of Opposition in the State. Parrikar had sought copies of the Governor’s reports sent to the President under Article 356 of the Constitution. Raj Bhavan had rejected the application on the ground that Governor’s office did not fall under the scope of RTI Act. The matter then went to State Information Commission, which ruled in favour of Parrikar. Appeal to Bombay High Court also went in favour of Parrikar leading to appeal in the Supreme Court. The matter, which has been pending in Supreme Court since 2011, came up before a Bench of Justices Arun Mishra and Amitava Roy today when the Bench remarked that the matter which was filed in 2007 has become stale and infructuous. The parties agreed to the same and the Court proceeded to dispose of the case while keeping the question of law open. The State Information Commission has said the provisions of the Right to Information Act and directions of the Commission are being violated by the public authorities and public information officers with impunity. Disposing a case, state information commissioner Ashraf Mir directed the PIO, block development officer Budgam, to explain why he has denied the information to the applicant. He said that every public authority is ordained and obligated under the Act to facilitate the right to information of every person residing in Jammu and Kashmir. The Chief Information Commissioner RK Mathur has asked the Prime Minister’s Office to disclose the names of people who accompany Prime Minister Narendra Modi on his international trips, PTI reported. Mathur’s orders came when the Central Information Commission – the final authority to decide Right to Information issues – was hearing two separate cases where RTI applicants said they were not given proper answers to questions about the prime minister’s delegation on foreign trips. When the PMO said it was against giving out this information for “national security” reasons, Mathur rejected it saying, “The Commission is of the view that the name, list of non-government persons [having no connection with the security] who had accompanied the Prime Minister on his international visits...should be provided to the appellant.” Mathur said the PMO need not disclose names of security personnel and people linked to the prime minister’s security detail.   14. The Central Information Commission (CIC) has come down hard on an applicant for filing multiple applications with a view to harass the public authority. Information commissioner Yashovardhan Azad called out the actions of the applicant, who had filed a slew of pleas after a dispute with a neighbour. "The commission notes that the appellant is a habitual litigant and has been raising myriad queries about numerous complaints he has filed before various public offices. CIC Advises Caution As PMO Evades RTI Questions on Reliance Jio Ad with Modi’s Photograph Over a year after Reliance took out an advertisement to announce the launch of Reliance Jio with Prime Minister Narendra Modi’s photograph displayed prominently on it, the Prime Minister’s Office (PMO) is still shying away from replying to Right to Information queries on whether “any permission was taken from PMO by Reliance/Reliance Jio Infocomm Limited for the use of the PM’s photograph in their advertisements in different newspapers and TV channels, etc”. In an order on an application filed by appellant Neeraj Sharma, Chief Information Commissioner R.K. Mathur recently cautioned the central public information officer (CPIO) in the PMO to “be careful and give inputs for reply within the timeline prescribed by the RTI Act”. Since the PMO had not replied to the matter on time and had also diverted the application to another department which had claimed that it was not privy to the information, the CIC also “cautioned” it “to take due care in future in dealing with the RTI application”. State Information Commission has held that legal opinion to the university by the Standing Counsel cannot be termed as privileged and confidential communication by invoking the provisions of the Evidence Act and cannot be denied under J&K Right to Information Act. The decision was taken in two 2nd appeals arisen out of the orders of the First Appellate Authority (Registrar University of Jammu) and the disposal of RTI applications filed by the appellant Dr Sapna Sharma by the PIO of the University of Jammu. The appellant had requested for providing the copies of legal opinion obtained by the university in the regularization matter of Dr Bharti Prabhakar, Dr Pallavi Sachdeva and Dr Sandeep Singh besides the copy of communication of Department of Sociology applying for UGC-SAP and copy of minutes of DAC, Department of Sociology downgrading the post of Reader in 2005-06. While rest of the information was provided to the appellant yet copies of the legal opinions tendered by the Standing Counsel of the university was not given on the ground of being third party information. Central information commissioner Divya Prakash Sinha has issued a show cause notice to the Oulgaret municipal commissioner M S Ramesh, questioning why action should not be taken against him for violating the provisions of the RTI Act, by failing to furnish information within the stipulated time. P Raghupathy filed an RTI on July 8, 2016, seeking Ramesh, who is also the public information officer of Oulgaret municipality, to provide details on the allotment of two shops in the market area to a Congress MLA M N R Balan, where he has opened his office in the commercial premises. Ramesh failed to furnish information within the stipulated time and Raghupathy filed an appeal before the first appellate authority- director (local administration) L Mohamed Mansoor, who passed an order on November 24, 2016 directing Ramesh to furnish information within a week's time. However, Ramesh failed to honour the first appellate authority's order. The activist filed a second appeal on January 6, 2017 before the CIC, which heard the case through video-conferencing and passed an order on January 10 this year. State Information Commission (SIC) has ordered Home department headed by Chief Minister Mehbooba Mufti to provide copy of a report, submitted in 2016 by one-man Commission of Inquiry headed by Justice (retd) ML Koul on the 2010 uprising in which about 120 street protesters, mostly youngsters, were shot dead. In response to the second appeal filed by Advocate Parvez Imroz, who had sought information regarding the copy of the report under JK RTI Act, the State Information Commission (SIC) has directed the Home Department to provide the copy subject to the condition that contents of the report in full or part are not covered by any of the provisions of section 8, as may be determined by the Public Authority, Home Department to exempt the same from disclosure. Noting that all the chief information commissioners appointed were former chief secretaries, the Uttarakhand High Court has observed that there is no such requirement that a former Chief Secretary can only be appointed as State Chief Information Commissioner. A division bench of Justice UC Dhyani, and Justice Sudhanshu Dhulia made this observation while dismissing a challenge against the appointment of State Chief Information Commissioner. The petitioner had contended before the court that the office of the State Chief Information Commissioner has become the ‘dumping ground’ for retired bureaucrats, who are rewarded for their loyalty to the state government. When the appointment itself is a reward for loyalty, then the fairness and credibility of such appointee itself becomes doubtful, he contended before the court.
