  1. Respected members, I had filed an RTI asking for details of MPLAD funds. I received the reply from the PIO that copies run for over 150 pages and have requested me to pay Rs 300. What is the mode of payment of the fees? Can i deposit by postal order only or is there any other way. Kindly help. Thanking You
  2. Hello, Please find attached a copy of an RTI application I had sent to the Teacher in Charge of the college where I work as a teaching stuff. The undergraduate college is in West Bengal and all its stuff receive salary from the government (but it is not a Govt. College). The college also receives grants from the government (both State and Central). This type of college is often referred to as a 'Govt. Sponsored College'. I would remain much obliged if someone were to confirm if this format is still valid today. My queries to the forum: 1. The college does not have an RTI Cell. If I use a ten rupee value Indian Postal Order, how would I fill the order? What should I write in the sections 'PAY TO ...' and 'AT THE POST OFFICE AT' (the post office where I got the postal order from or the post office which will receive my application?). 2. While the court fee stamp is affixed to the RTI application, it may be difficult to do the same with the postal order. Is it possible for the other party to make false claims that the application was invalid because it did not come with a postal order? I am going to send by registered post. 3. I do not expect a reply to my application from the college. In which case, who should I send my first appeal to? The college comes under the Department / Directorate of Higher Education and is affiliated to the West Bengal State University. Thank you!

I am still missing: Goa Pondicherry West Bengal Assam Nagaland Manipur Tripura Mizoram Sikkim Meghalaya Himachal Pradesh Bihar Uttar Pradesh Uttarakhand Jharkhand Chattisgarh Delhi Attached is a word doc. Members are requested to go through the attached word .doc and recheck the fees, in case any changes/amendments in the rules/fees, etc. If anyone knows about Fees in various State High Courts and Legislatures, please also inform here along with the relevant GO number and date. Those having information about the missing States, please give the fees so that the document can be updated.   4. Recently, I filed four RTIs to the AG office in Puducherry with IPO for Rs. 10 in the name of Public Information Office/Accounts Officer. The PIO hs returned the RTI stating to file again after changing to The Pay and Accounts Officer. I request the Hon'ble members to kindly enlighten me whether i was wrong in addressing to Public Information Office/Accounts Officer or the PIO is wrong. Also, i remember seeing CIC decisions that rejecting RTI on these silly issues amounts to harassment. Please enlighten me in this regard also with judgements.
  5. The CIC has once again ruled that prescribed fees for getting information will prevail over RTI fes. That means if the public authority has already prescribed fees for disclosing some information, the RTI applicant cannot get the same info by paying fees prescribed under RTI Rules and Fees. The Commission in the matter of Shri K. Lall Vs. Ministry of Company Affairs in case No. CIC/AT/A/2007/00112 dated 14.4.2007 held that the fees prescribed under any other Act for disclosure will prevail over the fees prescribed by the RTI Rules in the case the public authority has already decided to disclose the information. The High Court of Delhi vide its order dated 1.6.2012 in W.P. © 11271/2009 in the matter of Registrar of Companies & Others Vs. Dharmendra Kumar Garg & another also upheld the aforementioned order of the Commission. The full order is attached to this post. Prescribed department fees prevail over RTI fees.pdf
  6. How to make a request for information under the RTI Act 1. The request shall be in writing or through electronic means in English or Hindi or in the official language of the area in which the application is made. 2. The full name, address, particulars of information required and other relevant reference, if any, are to be clearly specified in the application. 3. The application shall be accompanied by the prescribed fee. Govt. has prescribed the Right to Information (Regulation of Fee and cost) Rules, 2006. The application fee is Rs.10/- The application fee shall be paid in any of the following manners. a. by affixing court fee stamp; or b. by remitting the amount in the Government Treasury, under the head of account " 0070 other administrative services - 60 other services - 800 other receipts - 42 other items" ; or 36 - Receipts under RTI Act, 2005. As per this clause since the accounting for the ten rupees is done under the head of "administrative services", HENCE AS PER THE CONSUMER PROTECTION ACT: " service" means service of any description which is made available to potential users and includes the provision of facilities in connection with banking, financing, insurance, transport, processing, supply of electrical or other energy, board or lodging or both, 1[ housing construction,] entertainment, amusement or the purveying of news or other information, but does not include the rendering of any service free of charge or under a contract of personal service; 1. Ins. by Act 50 of 1993, s. 2 (w. e. f. 18- 6- 1993 ). As per the RTI ACT section 2 covers the legal meaning of the word "information". " information" means any material in any form, including records, documents, memos, e- mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force; consumer" means any person who,-- (i) buys any goods for a consideration which has been paid or promised or partly paid and partly promised, or under any system of deferred payment and includes any user of such goods other than the person who buys such goods for consideration paid or promised or partly paid or partly promised, or under any system of deferred payment when such use is made with the approval of such person, but does not include a person who obtains such goods for resale or for any commercial purpose; or (ii) 2[ hires or avails of] any services for a consideration which has been paid or promised or partly paid and part by promised, or under any system of deferred payment and includes any beneficiary of such services other than the person who 2[ hires or avails of] the services for consideration paid or promised, or partly paid and partly promised, or under any system of deferred payment, when such services are availed of with the approval of the first mentioned person. 1[ Explanation.-- For the purposes of sub- clause (i)," commercial purpose" does not include use by a consumer of goods bought and used by him exclusively for the purpose of earning his livelihood, by means of self- employment;]
  7. Many members on this forum have made posts/threads on the issue of: 1. Abnormally high application fees / further fees prescribed by some States / Courts 2. Different modes of payment of fees from state to state It now seems that the Government has finally woken up to these complaints and DoPT has issues a circular to all States and Competent Authorities requesting them to consider harmonising the RTI Rules and Fees with those of the Centre.   8. Please tell me whether we need to pay for the Rs. 25 speed post charges (for sending us the reply of an RTI Application) to the concerned PIO? Till now I have been sending Rs. 35 Postal Orders with my RTI Application of which Rs. 10 was the fees for the reply and Rs. 25 were for the speed post charges of the reply. However I have received information that the Rs. 25(speed post charges) are not necessary to be sent to the PIO as the cost is borne by the Government.Please tell me whether this is true. Also give me details of all charges that can be incurred in filing and receiving reply of an RTI Application.?

  10. 1. It has been stated at some sites/blogs that a PIO/CPIO is duty bound to accept IPOs towards payment of RTI application fees even if 'pay to' column is left blank in the IPO. This is incorrect. There have been series of decisions by the CIC of late upholding rejection of RTI applications by PIO/CPIOs on the grounds that the pay to column has been left blank. These decisions seem contrary to the spirit of RTI but I guess once DoPT has ruled that IPOs payable to the account officer of an organisation should be accepted by PIOs there is little room for dicussion.

One First Appellate Authority of Orissa State council for Technical Education & Vocational Training, Orissa was sent 4 different appeals for 4 different RTI applications not being provided to the appellant; was disposed up by saying that the appellant didn't turn up after 3 letters of summons . Is it right on the part of First Appellate Authority to act in such a manner? Can it be sent to the State Information Commission and will have merit ? If the First Appellate Authority will be fined as per procedure ?

As reported by ENS in expressindia.com on 24 March 2009: HC notices to Centre, Chandigarh on promulgation of RTI rules - Express India HC notices to Centre, Chandigarh on promulgation of RTI rules Chandigarh The Punjab and Haryana High Court, on Monday issued notices to the Ministry of Home, Ministry of Personnel and the Chandigarh Administration, on a civil writ petition filed by social activist Hemant Goswami. The writ has been filed on the issue of promulgation of separate rules under the Right to Information Act, by which the Chandigarh Administration increased the RTI application fee and the cost of documents, to be obtained under RTI, by 500 per cent. The case will come up for hearing on May 21. The petition states that the action of promulgating new RTI rules under Section 28 of the RTI Act, by the Chandigarh Administrator, is illegal and creates a parallel governance system outside the purview of the law . "Such an action is against the spirit of the constitution and the RTI Act. By deliberately extending his brief, the Administrator and the Home Secretary of Chandigarh have clearly bypassed the provisions made by the Parliament," argues the petitioner, while adding: "The said action has the effect of reducing the faith of people in the system of governance and attempts to excite disaffection towards the Government ." Contending the non-applicability of the provisions under which the new rules have been made, the petition further reads, "It is amply clear from the layout of the RTI Act as well as the manner and procedure laid out for making rules, that the rules made by the 'President of India,' the 'Governor of a State,' the 'Chief Justice of the Supreme Court and the High Court,' the 'Speaker' and the 'Administrator appointed under Article 239' will apply only for the specified office of the 'Competent Authority' and shall not be applicable for the rest of the government." The petition mentions that while the UT Administrator made a new set of rules for his office using Section 28 of the RTI Act, earlier, replying to a complaint before the Chief Information Commissioner, the same Administrator had claimed that no office of the Administrator actually exists and thereby the Administrator had refused to follow the RTI Act and/or publish the necessary proactive disclosure as mandated under the provisions of Section 4(1) of the RTI Act Then and now * While the RTI application fee earlier was Rs 10, it has been increased to Rs 50 * A document's photocopy, earlier provided at Rs 2 per page, will now be available for Rs 10 per page * While the inspection of records under RTI was earlier available free of cost for the first hour of inspection, now the same comes at a price. For every 15 minutes of inspection of records, Rs 20 is levied as charges

An official spokesperson said the fee had been reduced from Rs 10 to Rs 2 per page. No fee would be charged from below poverty line families for providing the required information.

As reported in thestatesman.net on 28 September 2008: The Statesman Cabinet approval KOLKATA, Sept 26 : The state Cabinet yesterday approved the amendment to the West Bengal Right To Information Rules 2006. allowing other forms of payment like non-judicial stamp paper, demand draft and postal order to be used in addition to “court fees” amounting to Rs 10 which a person wishing to get information under these rules has to furnish with his application. Mr Sandip Srimani, government counsel informed this to the Division Bench of Mr S S Nijjar, Chief Justice and Mr Justice Sanjib Banerjee of Calcutta High Court today. The Division Bench suggested that the proposal of paying cash of this amount for the application be also considered. The amendment follows a Public Interest Litigation (PIL) by Human Rights Law Network seeking that non-judicial stamp paper, demand draft and postal order be taken with such application as fees beside “court fees” which are only available in the court premises .
