The Law Commission is ready with a set of recommendations to make BCCI a 'public body' or, in the alternative, a private body amenable to queries from the public under the Right to Information Act. Sources told TOI the law panel unanimously concluded that given BCCI's monopoly over the most popular and cash-rich game in India and its public nature of work, coupled with substantial financing from governments over the years in the form of tax exemptions and allotment of land, it must be classified as a 'public body' and brought under the RTI Act. In its July 2016 judgment, the SC had asked the commission to examine the legal framework to bring BCCI under the RTI Act. A series of appeals filed under the Right to Information Act (RTI) by whistleblower Indian Forest Service (IFS) officer Sanjiv Chaturvedi when he was posted in Haryana had unearthed the scam involving senior Haryana politicians and bureaucrats have revealed how instead of going after corruption committed under the Congress rule, the Modi government has decided to stall the investigations and in doing so has sought to defend the DoPT order which has since been cited by the Haryana government to repeatedly stall a probe by the Central Bureau of Investigation into allegations of corruption involving top political leadership and bureaucracy in Haryana. Preliminary probe had indicted CM, minister, bureaucrats The case goes back to 2010 when on the basis of comprehensive representation of Chaturvedi to the then Cabinet Secretariat, the Ministry of Environment and Forest had constituted a two-member enquiry committee to look into corruption related to illegal mining, illicit filling, fake plantations, etc that had been unearthed by the officer. Finding prima facie substance in the case, the enquiry committee had severely indicted the office of then Haryana chief minister Hooda, then forest minister Kiran Chaudhary, then chief parliamentary secretary Prehlad Singh Hilakhera and senior officers of state government, for their alleged role in these cases of corruption and recommended a CBI probe. Subsequently, both CBI and Central Vigilance Commission (CVC) had given their concurrence for the investigation in November-December 2011 and the issue was under active consideration of MoEF.   3. The Assam Home department on Friday issued a notification saying N. Rajamarthandan an IPS officer has been reinstated and restored as commandant of the 21st Assam Police Battalion at Katlicherra in Hailakandi district, some 330 km south of Guwahati. The IPS officer of the Assam-Meghalaya cadre, who was suspended last year for allegedly revealing crucial information on an investigation in a reply to an RTI query is now back to power. Rights organisations in the Northeast have hailed the IPS officer’s reinstatement. “His crime was that he gave information under RTI Act as public information officer in the Assam Police. We salute this officer and hope and pray there are more like him,” social activist Agnes Kharshiing told The Hindu from Meghalaya capital Shillong. A massive cut of over 63 per cent in the funds for the transparency watchdog -- Central Information Commission -- and propagation of the Right to Information Act has been announced in the Union Budget. Finance Minister Arun Jaitley allocated only Rs 8.66 crore under the head "CIC and RTI" which is a drastic cut of Rs 14.95 crore (or a deduction of over 63 per cent) from the revised estimates of 23.61 crore for 2017-18.   5. “Right to Information is such a powerful law that it over-rides all other laws, says Shailesh Gandhi, former Central Information Commissioner, while explaining basics of RTI Act and its practical usage to students of Vaze College at Mulund in Mumbai. He says, “This is a right which can be used by any person irrespective of his or her economic or social background and one need not provide any reason to obtain any kind of certain information.” Mr Gandhi was speaking at a Seminar organised by Moneylife Foundation’s RTI Centre with support from Public Concern for Governance Trust (PCGT) and Kelkar Education Trust’s Vaze College.   6. A training cum workshop of public information officers and appellate officers was organised at the Simhasth Fair office on Monday. State information commissioner Hiralal Trivedi gave detailed information about various provisions of the Right to Information (RTI) Act and gave solutions to the questions asked.   7. A third-party audit by the Indian Institute of Mass Communications (IIMC) has revealed that the ministry of information and broadcasting’s (MIB) compliance of the new guidelines on Suo-motu disclosure is also partial and incomplete. The Suo-motu disclosure of more items under Section 4 Sub-section 4(2) of the RTI Act, 2005 requires every public authority to take steps to provide as much information suo-motu to the public at regular intervals so that the public have minimum resort to use the Act to obtain information. The aim of the audit was to study the information disclosed by the MIB proactively under Section 4(1) (b), examine the level of compliance of the detailed guidelines regarding implementation of suo-motto disclosure under Section 4 of the RTI Act, 2005, the quality of proactive disclosure made under the Act and the guidelines from layman’s point of view, and suggest measures for better and effective compliance and implementation of Section 4 of RTI Act, relating to proactive disclosures.   8. Public information officers are trying to brush aside Right to Information applications by questioning the purpose of filing them, or asking applicants to withdraw them. An applicant has complained against the TS home department for the practice, saying: “Public information officers, especially from the police department, contact the applicants and ask them to withdraw their RTI applications or first appeal.” Read more at: Hyderabad: RTI applications written off
  9. The training program on Right to Information (RTI) Act, for the officers of Indian Air Force from different parts of the country was concluded on Thursday. The training program, which was conducted by Centre for Public Administration of Dr. MCR HRD Institute of Telangana. Chief Information Commissioner, Telangana Information Commission S Raja Sadaram called upon the officers to process the applications received by them under the RTI Act with a positive frame of mind. He advised them to be proactive in the disclosure of information and underlined the need for adhering to the timelines and maintaining the relevant records. Minister for Public Works, Naeem Akhtar today said that the State Information Commission (SIC) is functioning smoothly with the State Chief Information Commissioner and the Information Commissioner in place. Giving details, the Minister informed that on the recommendation of the selection committee and with the assent of Governor, Chief Information Commissioner Khursheed Ahmad Ganai (IAS) and State Information Commissioner Mohammad Ashraf Mir have been appointed vide SRO-76 dated 27.02.2017 and SRO-427 dated 11.10.2017 respectively. However, the proposal for appointment of other State Information Commissioner as recommended by the selection committee is under consideration before the Governor. Thane’s Deputy Commissioner of Police (DCP) Sandip Valve, who is also First Appellate Authority under the Right to Information (RTI) Act, has allegedly slapped and threatened an activist for seeking information about education qualifications of police officers. According to Shailesh Gandhi, former Central Information Commissioner, during the first hearing, the DCP allegedly slapped RTI activist Kailas Avhad. This was also noted in an order passed by Thanksy Francis Thekkekara, State Information Commissioner for Konkan Division. On 31 January 2017, Avhad had asked information about educational qualification and certificates of Dr Rashmi Karandikar (DCP of Traffic). When he did not got any information within stipulated time, on 2 March 2017, he filed first appeal the First Appellate Authority. However, during the hearing, Mr Valve, the Appellate Authority, allegedly vent out his anger at RTI users stating that “You all RTI users harass us”.   12. RTI activist Kuldeep Singh Khaira was attacked by three unidentified persons at his shop in the Gill Road area. The incident was captured by CCTV cameras. Footage shows that three persons with faces covered barged into Khaira’s shop and attacked him with sticks and sharp weapons. Khaira suffered critical injuries and was admitted to Civil Hospital. The pictures of an injured Khaira were circulated on WhatsApp groups soon after the incident. After recording the statement of Khaira and scanning CCTV footage, the police registered a case against three unidentified persons and the proprietors of RK Construction Company for attacking the RTI activist. Khaira alleged that he was attacked by the henchmen of the proprietors against whom he had filed a complaint to the Vigilance Department. The MC had recommended an FIR in the case. Khaira alleged the builder was constructing flats on agricultural land at Ishar Nagar which was illegal. He had written to the Chief Vigilance Officer about it last week.   13. A 50-year-old police constable who has filed several RTI queries against some seniors has alleged threats to his life from his colleagues. The constable said it was his colleagues who got him transferred from Noida to Kannauj last month. Shushil Kaushik was transferred following a recommendation from Ram Pratap Singh, an MLA from Agra's Etmadpur. Singh admitted having recommended his transfer and said he had done so merely because some people had complained to him about Kaushik. Kaushik had, during his stint in the Noida police, filed many RTI applications against his bosses seeking transparency in the office. Sources said that his relentless crusade against corruption resulted in several inquiries against him, penalties and denial of promotion. A RTI filed by the Tamil Nadu Petrol traders association found that no government order was passed to enable the public to utilise the toilets in the petrol bunks and other public places if the need arose, in order to declare the city open defecation free (ODF).   15. Chief minister Devendra Fadnavis has ordered CID inquiry against RTI activist Rajesh Bele, his associate and two electronic media journalists. BJP corporator-cum-contractor Raju Goliwar had alleged that Bele and his accomplices were blackmailing him for money with the threat of airing false news about substandard work being done at Irai river. RTI activist Bele had earlier accused contractor Goliwar of doing substandard work while constructing wall along the bank of the river to protect the city from floods, which occurs every year during monsoons. As the allegations were made against him, Goliwar had allegedly threatened Bele to eliminate him. The audio clip of the phone conversation between Bele and Goliwar in which the latter is threatening the RTI activist had also went viral on WhatsApp. Later in a press conference, Goliwar had admitted to issuing the threat in fit of rage as he was mentally disturbed due to blackmailing by Bele.   16. The Aam Aadmi Party (AAP) unit in Punjab has requested the Governor VP Singh Badnore to restrain Captain Amarinder Singh-led Congress government in the state from allegedly unconstitutionally appointing six Punjab Public Service Commission (PPSC) members and two RTI Commissioners by violating all norms, rules and procedures. In a letter written to Badnore seeking his intervention into the said matter, Leader of Opposition (LoP) in Punjab Assembly, Sukhpal Singh Khaira has accused the state government of trying to bypass the rules and procedure so that the ruling party could go ahead without being transparent and fair in the matter . Khaira said that the procedure for these appointments required consultation of the LoP, and thus he was approached by the Special Secretary, Personnel Department in this regard, however, the official failed to give any satisfactory reply when asked about the criteria adopted to shortlist the names of said appointments.   17. The Karnataka Information Commission will be organising a three-day special hearing on pending Right to Information (RTI) cases from January 17 at the BBMP head office. The Trustee of Information Study Centre, B.H. Veeresh, which spreads awareness on the Right to Information (RTI) Act said that about 5,000 cases pertaining to the BBMP are pending before the Karnataka Information Commission. An RTI application from IPS officer D Roopa seeking information of the status of her complaint and a copy of the inquiry report of the alleged irregularities in central prison, has met with a ‘No’ for an answer. Six months after Inspector General of Police, Roopa blew the lid off the alleged bribery scam in prison, looks like the government is buying more time. Roopa, who is fighting a defamation suit for which she requires the status of the report as a supplement, was appalled when the government rejected her RTI application and denied information. Now, the officer is contesting the reply and going in for an appeal. “I am fighting the defamation case and I need information from the government,” says Roopa. “Since the government has not made the report public, I applied under RTI for information about the conclusions in the report. Recently, I got a reply stating that the report cannot be shared as it is under examination,’’ the officer told Bangalore Mirror.
