Civic panel for sunshine law Reported by Linah Baliga in timesofindia.indiatimes.com on May 23, 2013 Civic panel for sunshine law - The Times of India MUMBAI: The civic body's first technical advisory committee (TAC) involving citizens and activists who will work for efficient implementation of the Right to Information (RTI) Act will be functional from Thursday. The TAC will hold its first meeting on Thursday at the Brihanmumbai Municipal Corporation (BMC) headquarters under the chairmanship of former chief information commissioner Shailesh Gandhi. Deputy municipal commissioner (general administration) Kiran Achrekar, deputy municipal commissioners Kishore Kshirsagar and Vasant Prabhu, director (engineering services and planning) L S Vhatkar, and RTI activists Bhaskar Prabhu and Milind Mulay will participate in the meeting. The objective is to reduce the number of RTI applications by voluntarily making routine information available on the BMC website, besides making the RTI process citizen-friendly. Bhaskar Prabhu said it was the first time a public authority had involved citizens in the implementation of the RTI Act. "The TAC role is to see that implementation of the RTI Act 2005 is done according to the requirements of the act by public information officers (PIOs)," he said. "We will ensure there is a training programme for PIOs, who disburse information. There are various trainers in Mumbai, or we will network with Yashada, a state government body, to set up an internal training system. "There is a lot of information, like work orders released by the BMC, allotment of plots and lands, and permissions granted by the building proposal department of the BMC, that can be suo moto published on the BMC website," Prabhu said. "That's the intent of the RTI Act and TAC will ensure that this happens to reduce the number of RTI applications." He said there are various process manuals which are present for every BMC department that are not followed in toto. "We will discuss the bottlenecks that prevent PIOs from giving information and filing correct replies," Prabhu said.

  10. On Friday, the Supreme Court collegium said it would upload its decisions on the appointment and transfer of judges of the apex court and High Courts on the Supreme Court’s website. These details would be available as collegium resolutions. This is the first significant step towards opening up a process heavily criticised for its opaqueness. The criticism had grown after the Supreme Court struck down the National Judicial Appointments Commission as unconstitutional in 2015. The National Judicial Appointments Commission was proposed as a replacement for the collegium, which is made up of the chief justice of India and the top court’s four most senior judges. In contrast, the Commission included the chief justice of India, the Supreme Court’s two most senior judges, the law minister, and two “eminent persons” – who would be nominated by the chief justice, the prime minister and the leader of the Opposition in the Lok Sabha. The idea behind it was to make appointments to the higher judiciary more transparent. The collegium’s decisions were a closely-guarded secret and beyond public scrutiny. They were also kept out of the purview of the Right to Information Act. The collegium’s decision on Friday to make its resolutions public comes 11 days after Justice Jayant Patel of the Karnataka High Court resigned in the wake of his transfer to the Allahabad High Court, which cost him the chance to become chief justice in the southern state. Senior lawyers such as Dushyant Dave have alleged that the reason Patel was sidelined was because he had ordered a Central Bureau of Investigation inquiry in the Ishrat Jahan case – in which the college student from Maharashtra was deemed a Lashkar-e-Taiba operative and shot dead by the Gujarat Police allegedly in a staged encounter in 2004. The names of several of its top officials cropping up in the investigation had embarrassed the Gujarat government, which was then led by Narendra Modi as chief minister. The Supreme Court’s transparency move is also expected to lead to demands that the government make public its role in the judicial appointment process. The collegium sends its recommendations to the Centre, which can send them back for reconsideration. However, the collegium has the final say in the matter.   11. CIC’s Swachhta Abhiyan also includes disposal of pending files! Prime Minister Narendra Modi’s Swachh Bharat Abhiyaan has now percolated from the streets of India to the government buildings as Department of Personnel & Training (DoPT) issued an order on 10 July 2017 to chalk out a calendar of Swachhta related activities with ‘measurable indicators’ for next one year. This has spurred the Central Information Commission (CIC) to make a month-by-month cleanliness campaign schedule from July 2017 to June 2018, which, by the way, also includes clearing up of pending cases. (One would have thought this is part of their duty and should not require a special scheme!) CIC’s Swachhta Abhiyan also includes disposal of pending files! No surprise, they have launched it long time back to dump all pending files as garbage.

  21. On the lines of the facility available with the Central Information Commission (CIC), appeals can be registered online. Also, complaints against officials even after the State commission has passed an order can be registered through the portal. The #onlineportal expected to be made available for users by this year end, is currently being developed by the National Informatics Centre. On an average, the #TamilNadu Information Commission, with its office at T Nagar, receives 50 appeals a day. As much as 80 per cent of those appeals are from outstations and are posted to the commission. There are also instances of petitioners coming to the commission from faraway places just to file an appeal in person. It is in this regard, the proposed online facility would help users. Tax officers to maintain digital records of summons, notices MAS Team 10 February 2017The government has taken concrete steps to reduce the discretionary powers of taxmen and improving efficiency in the Income Tax Department. The Income Tax department has asked its field officers to maintain digital records of summons, notices and special audit ordered by them. In the new 'Assessment Module’ for Income Tax Business Application (ITBA), an electronic platform for regular operations, the department has laid out functionality for issue of summons, notices and special audit. As per the module, income tax authorities will now have to create online digital records or entries issuing orders, the required approvals obtained in this regard, enquiries made and responses received from taxpayers. For ordering summons under Section 131, the tax authorities will now be required to enter the details of the person summoned, along with the time and date. He will then have to record the statement of the summoned person and documents submitted and submit the record as an attachment. With regard to serving notice under Section 133, tax officers will have to give details of the entity from whom information is requisitioned, along with the date for compliance and then issue the notice. The officer will then upload the details of information received in response to the notice and place on record the documentary evidence so gathered, as an attachment.Section 142(2A) of the Income Tax Act provides that special audit can be ordered by the Assessing Officer in case of complex accounts. The recent instruction provides that an Assessing officer can issue a show-cause notice to the assessee, record the response, capture details of approval for referring the case for audit. On submission of the audit report, the officer should capture the details and place on record the special audit report by way of an attachment, it added.
