  1. In an exparte case of land grab I got the details of the case through RTI and appeaed aginst the exparte order of the tehsildar who was reluctant to trial but I appealed with documents received through RTI in the MRT who directed Tehsildar to reopen and try the case. Success.

RTI Act 2005 Success Story: I had submitted RTI application to Income Tax Department asking them to show me the documents I submitted, the form I had then filled in 2009 for PAN card application. But they made a mistake in my father's name in the PAN card, then, and I had to pay Rs 100 to make necessary changes. I had asked them through RTI to show me my original form and refund my money if not my mistake. And guess what? They have refunded my money. The question is not about money. It is about they accepting their mistake. This is the power of RTI Act 2005. Use it!!!!!

Implementation of Section 4 of The Right to Information Act, 2005, by providing updated information on government websites and the constitution of The State and Chief Information Commissions was the urgent need of the time and the government need to expedite, the long overdue process, to achieve the state of seamless Good Governance and Zero Tolerance to Corruption in Goa, was the unanimous tone expressed at the convention at Madkai Goa. The one day 1st Rural All Goa Right To Information Convention was organized by Madkai Nagarik Kruti Sangh and Parampai Citizens Forum in collaboration with the Goa RTI Forum on Sunday. Nearly 250 delegates from all over Goa registered their attendance for the program. The Empowerment of the citizens, transparency in administration and containing of the corruption are the three main objectives that are envisaged through the formation of RTI Act and that it shall be the responsibility of the government to deliver the same to the people in the right perspective for good governance in the true spirit of the participatory democracy, was the core concern expressed by Major General ( Rtd.) Mr. S C N Jatar, from Pune, who is heading an NGO by name Nagarik Chetana Manch. He was delivering the Key note address, as the Chief Guest, at the function. He further elaborated that the trend of non -providing of the true information to the public by the government has been inherited from the foreign rulers in India who looted our country by way of various taxes and took shelter under Official Secrets Act, so that their misdeeds are not exposed. This is got to be stopped, he said. With the help of the case studies of the issues sorted out through RTI by his NGO in Pune, he urged the NGOs in Goa and the media groups to come forwards in the RTI field and bring good governance to the people, as he expressed that the individual efforts on many occasions become nondeliverable. Mr. Vishwas Sahastrabudh, an Electronics Engineer, from Pune, was the guest speaker at the session. He sighted many of his experiences in the field of RTI that delivered good governance and social justice to the people and curbing corruptions at the government levels, by ensuring implementation of Section 4 of the RTI Act, which deals with the obligation on the part of the government for disclosure of the information to the public. He is heading the Sajag Nagarik Manch, Pune, an NGO involved in social activities and which was instrumental in making the government to implement the Section 4 effectively. Mr. Motilal S. keny, an upright Ex-Goa State Information Commissioner, shared the session with his thread bare analysis of all the sections of the RTI Act. He also shared some of his experiences while in his position as Commissioner by terming the Act as a powerful tool in the hands of the citizens. He also explained vital importance of the Section 4, which if implemented judiciously, will avoid wastage of time energies of the public and NGOs in obtaining the information under Section 6 and save government time and energy in providing such information too and would avoid litigations as well. Madam Nandini Sahay, the director of the International Centre Goa and the president of The Goa RTI Forum, presided over the Inaugural session. She explained her struggle, along with Aruna Roy and others, in the direction of bringing the statute, The RTI Act, 2005, into existence. She stressed that it is the right of the citizens to get the accounts for the money they pay to the government in the form of taxes etc. and she said that it is possible to do that by exercising the right under RTI Act. She also expressed confidence that the RTI would transform the electoral democracy into participatory democracy. The vote of thanks was proposed by the secretary of Goa RTI Forum Mr. Shrikant Barve. The session was compeered by Prof. Namdeo Naik.

    Recieved TAX REFUND in 15 days.

    Thanks to all our Senior members for their expert advice, My Income tax refund was balance from last 3 years, even my CA was fed up from the Income Tax Authorities and showed his inabiliity to tackle these guys........ Then I filed RTI to the Income Tax Dept, within 15 days received call from Income tax office that my Refund has been creditied to my Bank A/c. Thank you very much for your help. Thanks

    RTI Anonymous Strikes

RTI Anonymous is an online service, through which any Indian citizen can file Right to Information (RTI) applications anonymously. They DO NOT HAVE TO REVEAL THEIR IDENTITY. The RTI Anonymous community will file those RTI applications in their name and upload the documents obtained as a reply on this website. The original requester will get an email when this happens. The original requester just has to draft the RTI application as best as he/she can and the RTI Anonymous community will take care of the rest. How Does RTI Anonymous Work Step 1: So person A, who is based in say, Kanpur has a problem with a particular road in his locality and needs to file a RTI Request. He submits a request to RTI Anonymous, with the details of the Public Information officer and his set of questions. Step 2: An expert in drafting RTI (in our case, for example, an ex-PIO and retired registrar from Bangalore or a RTI Activist in Pune) will draft the RTI. Few other experts in drafting RTIs based either in different parts of India or concerned NRIs from different parts of the world, review and draft the RTI.The RTI request is then moved to the Drafted RTI Request category. If the experts decide that the request is frivolous or does not need anonymity or just too vague and needs more information, then its moved to its appropriate category (Non RTI, Non-Anonymous RTI or unclear RTI category). Step 3: Once drafted, a concerned citizen from say, Chennai takes a printout of this drafted RTI and puts in the IPO for the required amount and speed posts it.He then updates the website with the speed post number. The RTI Request is now moved to the Filed RTIs category. Step 4: Once the Chennai guy receives the reply, he just takes a picture of the documents received with his cell phone or digital camera, uploads its to his PC and then to the website. At times, he just does a normal post to one of the RTI Anonymous’s core team member and they would then upload these documents to the website. Step 5: Once uploaded, the original requestor (from Kanpur or wherever) gets an automated email and he can then download the documents that he had recieved. Also any public interest litigation (PIL) lawyers or journalists/reporters can also download these documents from this website. Remember: The RTI is filed by a guy from say, Chennai Drafted in say, Pune or London Reviewed in USA/Sweden/Hisar-Haryana, etc. And the original request is to some government office in say Kanpur And the government documents are uploaded to a website by either the guy who filed or RTI-A team member All done by REAL PEOPLE with REAL ADDRESSES
  9. This format of RTI application format looks complete, and covers all legal aspects to catch hold of PIO in case of appeal or complaint. PIO called me and discussed with me regarding each point, before sending the requested information.
  10. I used to receive Rs 373.00 as Monthly Interest on 9th of every month. I did not receive the interest for June 2011 (9th June 2011). I waited for sometime and sent a letter by Speed Post on 05 July 2011. I have also not received interest payable on 9th July, 9th August. My visit to the Post Office and letter to Chief Post Master General, West Bengal Circle did not evoke any response. I filed an RTI Petition on 08 October 2011. MIS Interest for four months amounting to Rs.1492/- has been credited to my SB Account on 27 Oct 2011. Reply to RTI Petition has also been received on 05 Nov 2011. The primary purpose has been achieved. Some information has not been provided. Examining the replies for a possible first appeal.     Cess Collection

    Dear Sir/Madam, RTI Application has been submitted with Department of Labour related to an Construction of Housing Project in J P Nagar 9th Phase, Anjanapura, Bangalore, Karnataka. After obtaining details from Labour department, it has been found that the said organization has violated so-many applicable Labour Norms and with d continuous effort made by us through our organization "Karnataka Karmika Kalyana Prathishtana", the Department of Labour has collected a amount of Rs.8 Lakhs towards Cess Amount. 1% of the amount on Construction Cost of the Project which is excluding Land Cost, the Principal Employer has to pay within one month of completion of the Project.   13. I filed a RTI application to dept. of forest asking copy of estimate ,Measurement Book,NIT called in news papers, etc. At First they did not respond. When i filed the complaint to State Information Commission (SIKKIM) they gave me information. When i got home and read the information, i found it was all wrong information. Instead of Measurement Book, they supplied me office notesheet, and NIT were not called as the department carried the work itself amounting Rs. 22,000,00.00. I again filed the rejoinder to State Information Commission. The State Information Commission called the SPIO and warned him setting the deadline to furnish information in three days.Next date, the SPIO furnished the information i.e. Measurement Book. By going through the M.B, I found that the estimated cost of work was 22,000,00 and the department drew 79,000,00. lacs of rupees. i circulated the information to news papers and the sms channel of our Forum (Sikkim RTI Forum). When news broke out, the SPIO (DFO) called me in the office DFO-"Why did you published in paper"? Me-"Why should not i"? DFO-"Do you know what will come upon you" Me-"Are you threatning me?" DFO-"What other dept. you have filed RTI"? Me-" Its none of your concern". DFO-"You dont know our power" Me-" Instead of calling me here you should have used it". DFO-"You really dont know" Me-"I know ,you have all resources and power and i have this RTI Act containing only thirty pages and it not less lethal for you". I am preparing for PIL, does any one has idea how to??????????????????

A good piece of Info from the Income Tax Dept website It was helpful for me... _______________________________________________________________________________ Income Tax Department facilitates a PAN holder to view its Tax Credit Statement (Form 26AS) online. Form 26AS contains - Details of tax deducted on behalf of the taxpayer by deductors Details of tax collected on behalf of the taxpayer by collectors Advance tax/self assessment tax/regular assessment tax, etc. deposited by the taxpayers (PAN holders) Details of paid refund received during the financial year Details of the High value Transactions in respect of shares, mutual fund etc. The Tax Credit Statement (Form 26AS) are generated wherein valid PAN has been reported in the TDS statements. Tax Credits Statement (Form 26AS) can be viewed/accessed through 3 ways : 1. View Tax Credit from https://incometaxindiaefiling.gov.in'>https://incometaxindiaefiling.gov.in Taxpayers who are registered at the above potal viz. https://incometaxindiaefiling.gov.in can view 26AS by clicking on 'View Tax Credit Statement (From 26AS)' in "My Account". The facility is available free of cost. For "New Registration", Click on 'Register' on the portal. The registration process is user-friendly and takes minimal time. 2. View Tax Credit (Form 26AS) from bank site through net banking facility The facility is available to a PAN holder having net banking account with any of authorized banks. View of Tax Credit Statement (Form 26AS) is available only if the PAN is mapped to that particular account. The facility is available for free of cost. List of banks registered with NSDL for providing view of Tax Credit Statement (Form 26AS) are as below 1. Axis Bank Limited 2. Bank of India 3. Bank of Maharashtra 4. Citibank N.A. 5.     Freedom from corruption Little light can brighten the world. We voted for our leaders. We expected that they will put control on illegal activities, will bring down corruption. But over the years we also have realized that menace of corruption is threatening more and more. We can do something. We can follow at least one case till the end. every year. Few of us follow up one case with the help of law. We have Right to Information Act to help us. Basis of corruption as per me starts from tender process. The tender which will be opened soon can be know from the advertisement appeared in local news paper. Identify one that which you can follow up easily. If you are eligible to file a tender then please file the tender Please go the office you have identified and find out the practice of tender process that followed in the office. Although as per law tender opening process is laid down however it differs from office to office and person to person. Find out nitty-gritty of the tender opening process followed in that office. Please try to remain present at the time of opening the tender, if not allowed, please note to be be around that hall. After Tender is allotted, file your first RTI asking details. A time schedule is always mentioned in allotment of tender. Please ask through RTI, status of the project after every scheduled date. . Please also note to ask the names of every person Govt. official, Contractor, Supervisor, supplier etc. Please also file a RTI to get the list of staff with designation in the office concerned. Write your own report. You must write names of all the persons wherever possible but be cautious you have some documentary evidence. Publish your report it in your Blog, give copies to relevant persons, release a press note etc. Make the thinks known to public, this is where one must stop. Legal action is not our cup of tea. Live it to experts. Please follow the process till the office says that project is completed and bill settled file closed. If we vigilant citizens use RTI to best of our societies use, we will be able to curtail corruption silently.

In a landmark judgement the a Bench of National Commission observed as reported in Times of India "The commission observed that the settled law was that even if a particular law barred the jurisdiction of courts, a complaint could still be filed under the provisions of CPA as it provided an additional remedy. The RTI Act did not bar the jurisdiction of the consumer fora. Also the provision of appeal under RTI Act was restricted to the failure to furnish information sought, but there was no provision to claim compensation for deficiency in service. An applicant under the RTI Act has to pay fees for getting the information, and hence he aquires the status of a consumer. If there is any deficiency in service in respect of providing information, a complaint could be filed under the CPA for claiming compensation. The commission as such upheld the award of the forum amounting to 500.00 as damages cost of 100.00

    RTI reply by IIT

    By using RTI, I was able to get the information that IIT Delhi doesnt do any kind of SITE INSPECTION for giving the Structural Stability Certificate for the building for erection of MOBILE TOWERS on the roof top of the building. IIT just gets the drawing of mobile tower structure only and stamps the certificate. On my first application to the PIO, IIT simply replied that Site Inspection was not under the scope of job work carried out and also refused to give the copy of a Structural Stability Certificate of a building and made excuses that "record is not available." 1st Appelate authority also took the same stand. But on 2nd appeal to CIC, I got the Certificate and the mobile tower structure drawings.
