  1. Providing Personal Information under RTI Act not Obligatory : Naveen Agarwal Workshop on RTI Organised in Kota University Nagpur. "RTI Act section 8(1) (J) provides that it is not at all a legal obligation on the information officer to give the personal information of any employee," informed Naveen Mahesh Kumar Agarwal, a well known RTI Act expert and trainer, Registrar of Dada Ramchand Bakhru Sindhu Mahavidyalaya, Nagpur while delivering his address as the keynote speaker in a day-long workshop on RTI Act organised in Kota University, Rajasthan. Quoting a verdict of the honourable Supreme Court in this regard, Agarwal added that it is not binding on the information officer under the act to provide the information about the memos, show cause notices issued to the employees, their property, loans taken from any bank, income tax deductions, financial investments and gifts received or given in service period of the employees. But he further added that if the personal information of the employees is in the larger interest of the public, the Public Information Officer may decide to provide such information. The workshop was inaugurated with the lighting of the traditional lamp by the Chairman of the inaugural function Prof. N K Jayman, Chief Guest Dr. R K Choubisa, Keynote speaker Shri Naveen Maheshkumar Agrawal, Registrar Dr. Rajkumar Upadhyaya and Dr. Vikrant Sharma. Dr. Choubisa in his address spoke on all the important aspects of the RTI Act. Dr. Jayman opined that the RTI act should be included in the syllabus for the benefit of the students. Shri Agrawal was earlier felicitated with shrifal and shwal at the hands of Registrar of Kota University, Dr. Rajkumar Upadhyaya. The program was compered by Dr. Vikrant Sharma whereas Dr. H.S. Shaktawat proposed a vote of thanks. The program was largely attended by the teachers, employees, high ranking officers and students of the university.
  2. Information under RTI cannot be Refused even if the matter is sub judice : Naveen Agrawal Workshop on RTI organised for officers of primary schools 320 people trained in 4 days Nagpur. "Information sought under the RTI act 2005 cannot be denied on the pretext of the matter concerned being sub judice as per the provision of the act under section 8 (1) (b)" observed Mr. Naveen Maheshkumar Agrawal, recognised trainer of YASHADA , Pune and Registrar, Dada Ramchand Bakhru Sindhu Mahavidyalaya. However, he further added that the Section 8(1) (b) of the RTI Act exempts from disclosure "information which has been expressly forbidden to be published by any court of law or tribunal or the disclosure of which may constitute contempt of court". Naveen Agrawal was addressing the primary school officers during the workshop organised to train them in RTI act jointly organised by the Education Officer (Primary), Gondia and YASHADA, Pune. In the four day long workshop 320 Primary School Level State Public Information Officers and Appellate Authorities of the Gondia district were given the training. Naveen Agrawal said that some authorities refuse to give the information on different grounds which are basically against the provisions of the Act. Even Delhi High Court also upheld the provision of the act that even during judicial pendency also the information sought under RTI must be provided. The workshop was attended by the RTI officers from places like Tiroda, Gondia, Arjuni Morgaon, Devri, Sadak Arjuni, Goregaon, Amgaon and Salekasa Panchayat Samiti of the Gondia district. Mr. Rajesh Rudrakar also guided the participants. Mr. Anand Manusmare compered the program whereas Mr. Deoram Maladhari proposed a vote of thanks.
  3. प्रकरण न्यायप्रविष्ट असल्याचे कारण देऊन माहिती देण्यास नाकारता येत नाही: नवीन अग्रवाल प्राथमिक शाळांच्या अधिकाऱ्यांसाठी माहिती अधिकार कार्यशाळेचे आयोजन 4 दिवसात 320 लोकांना प्रशिक्षण नागपूर. "मागितलेली माहिती संबंधी प्रकरण न्यायप्रविष्ट असल्याचे कारण देऊन अर्जदाराला माहिती देण्यास नाकारता येत नाही, कारण माहितीचा अधिकार अधिनियम, 2005 च्या कलम 8 (1) (ख) नुसार न्यायालयाने जी प्रकाशित करण्यास स्पष्टपणे मनाई केली आहे किंवा जी प्रकट केल्यामुळे न्यायालयाचा अवमान होऊ शकेल फक्त अशी माहिती नाकारली जाऊ शकते." उक्त प्रतिपादन दादा रामचंद बाखरू सिंधु महाविद्यालयाचे रजिस्ट्रार आणि महाराष्ट्र शासनाच्या शीर्ष प्रशासकीय प्रशिक्षण संस्था, यशदा, पुणे येथील अतिथी व्याख्याते श्री नवीन महेशकुमार अग्रवाल यांनी केले. यशदा, पुणे व शिक्षण अधिकारी (प्राथमिक), कार्यालय, गोंदिया यांच्या संयुक्त विद्यमाने गोंदिया जिल्ह्यातील प्राथमिक शाळांमधील राज्य जन माहिती अधिकारी, सहाय्यक जन माहिती अधिकारी आणि प्रथम अपीलीय अधिकारी यांच्यासाठी आयोजित माहिती अधिकार अधिनियम, 2005 कायद्याचे प्रशिक्षण कार्यक्रमात उपस्थितांना मार्गदर्शन करताना ते बोलत होते. श्री नवीन अग्रवाल पुढे म्हणाले की, जन माहिती अधिकारी अनेकदा असे कारण नमूद करून माहिती देण्यास नकार देतात, जे उचित नाही. दिल्ली उच्च न्यायालयाने सुद्धा आपल्या एका निर्णयामध्ये प्रकरण न्यायप्रविष्ट असल्याचा आधारे माहिती देण्यास नकार देणे चुकीचे घोषित केले आहे. या चार दिवसीय प्रशिक्षण कार्यक्रमात गोंदिया जिल्ह्यातील तिरोडा, गोंदिया, अर्जुनी मोरगांव, देवरी, सड़क अर्जुनी, गोरेगांव, आमगांव आणि सालेकसा पंचायत समिती भागातील शाळेच्या एकूण 320 लोकांनी प्रशिक्षण घेतले. श्री राजेश रूद्रकार यांनीही कार्यक्रमात योग्य मार्गदर्शन केले. माहिती अधिकार केंद्र, यशदा येथील संचालक श्रीमती दीपा सडेकर-देशपांडे व संशोधन अधिकारी श्री दादू बुले यांच्या मार्गदर्शनाखाली आयोजित कार्यक्रमाचे संचालन श्री आनंद मानुसमारे व आभार प्रदर्शन श्री देवराम मालाधारी यांनी केले.
  4. मामला न्यायप्रविष्ट होने का कारण बताकर सूचना देने से इनकार नहीं किया जा सकता : नवीन अग्रवाल प्राथमिक शालाओं के अधिकारियों के लिए सूचना अधिकार पर कार्यशाला 4 दिन में 320 लोगों ने प्रशिक्षण प्राप्त किया नागपुर। "मांगी गई सूचना से संबंधित मामला न्यायालय में विचाराधीन होने पर मामला न्यायप्रविष्ट होने का कारण बताकर आवेदक को सूचना देने से इनकार नहीं किया जा सकता, क्योंकि सूचना का अधिकार अधिनियम, 2005 की धारा 8 (1) (ख) के अनुसार न्यायालय द्वारा किसी सूचना के प्रकट करने पर यदि स्पष्ट रूप से रोक लगाई गई हो अथवा जिसके प्रकट करने से न्यायालय की अवमानना होती हो केवल ऐसी सूचना देने से मना किया जा सकता है।" उक्त उदगार दादा रामचंद बाखरू सिंधु महाविद्यालय के रजिस्ट्रार एवं महाराष्ट्र शासन की शीर्ष प्रशासनिक प्रशिक्षण संस्था यशदा, पुणे के अतिथी व्याख्याता श्री नवीन महेशकुमार अग्रवाल के हैं। वें यशदा, पुणे एवं शिक्षणाधिकारी (प्राथमिक), कार्यालय, गोंदिया के संयुक्त तत्वावधान में शिक्षण विभाग (प्राथमिक), गोंदिया जिले के अंतर्गत आनेवाले कार्यालय एवं प्राथमिक शालाओं के राज्य लोक सूचना अधिकारी, सहायक लोक सूचना अधिकारी एवं प्रथम अपीलीय अधिकारियों के लिए आयोजित सूचना का अधिकार अधिनियम, 2005 के प्रशिक्षण कार्यक्रम में उपस्थितों का मार्गदर्शन करते हुए बोल रहें थे। श्री अग्रवाल ने आगे कहा कि कई बार लोक सूचना अधिकारी द्वारा ऐसे कारण बताकर सूचना देने से मना कर दिया जाता हैं, जो न्यायसंगत नहीं है, दिल्ली उच्च न्यायालय ने भी अपने एक निर्णय में मामला न्यायप्रविष्ट होने का आधार बनाकर सूचना देने से इनकार किए जाने को गलत ठहराया हैं। चार दिनों तक चले इस प्रशिक्षण कार्यक्रम में गोंदिया जिले की तिरोड़ा, गोंदिया, अर्जुनी मोरगांव, देवरी, सड़क अर्जुनी, गोरेगांव, आमगांव एवं सालेकसा पंचायत समिती क्षेत्र की शालाओं से कुल 320 लोगों ने हिस्सा लेकर प्रशिक्षण प्राप्त किया। कार्यक्रम में श्री राजेश रूद्रकार ने भी उचित मार्गदर्शन किया। सूचना अधिकार केंद्र, यशदा की संचालक श्रीमती दीपा सडेकर-देशपांडे एवं संशोधन अधिकारी श्री दादू बुले के मार्गदर्शन में आयोजित कार्यक्रम का संचालन श्री आनंद मानुसमारे ने एवं आभार प्रदर्शन श्री देवराम मालाधारी ने किया।

    RTI – A Fundamental Right : Naveen Agrawal One Day Workshop on RTI by Regional Labour Institute, Government of Maharashtra Nagpur. “Constitution of India, under its Article 19 (1) has entitled the Right to freedom of Speech and Expression as fundamental right, but if people do not have access to information, they cannot express their opinion. Hence Right to Information is at the core of the Right to Speech and Expression. This has been expressed time and again in the decisions given by the honorable Supreme Court”, said Mr. Naveen Maheshkumar Agrawal, Registrar, Dada Ramchand Bakhru Sindhu Mahavidyalaya, Nagpur and Guest Faculty, Right to Information Centre, YASHADA Pune while speaking to students in a one day workshop organized by Regional Labour Institute, Government of Maharashtra. Prof. Shri Prakash Nimje, Course Coordinator Regional Labour Institute has emphasized the need to make people aware about Right to Information. The workshop organized for the students of Master of Labour Studies was inaugurated at the hands of Prof. Shri Prakash Nimje , Chairman of the programme, Chief Guest Mr. Naveen Agrawal and a special Guest Neha Gaikwad. The workshop dealt in details about how RTI can be used for benefits of people and what information can be or cannot be given under this act. Ms. Tanvi Deshpande, Sharmila Kuntiya, Tushar Jaitgude, Krushnakant Mishra, Rakshit Bansod, Swapnil Patil, Sandip Mane, Mugdha Deshpande, Vinay Sawarkar, Snehal Palandurkar, Sukanya Dorle, Radhika Joshi, Snehal Nakhate and Pranjal Manwatkar worked hard for the success of the workshop. Ms. Sonali Bhagat conducted the programme while Mr. Siddarth Meshram proposed the vote of thanks.

On International Right to Information Day Copies of Guide Book on The RTI Act Sent to 1500 People Naveen Agrawals novel effort to create Public Awareness Mr. Naveen Maheshkumar Agrawal, Registrar, Dada Ramchand Bakhru Sindhu Mahavidyalaya, Nagpur has made a very novel effort to bring about the awareness about RTI Act 2005 in public by sending Guide Book on the RTI Act to 1500 different people from various walks of life on the International Right To Information Day and has created a history. The Book has been prepared by YASHADA, Pune and it contains 466 pages highlighting the contents of the act in a very lucid language. Naveen Agrawal has sent the soft copy of the same to 1500 people and greeted them on the International RTI Day. The Guide Book also contains some of the important Court Decisions, Government Resolutions and Model Correspondence in regard to RTI cases. Naveen Agrawal, who is an RTI trainer identified by YASHADA, Pune and various government and non government organisations has created a record in 2017 by sending application under RTI Act seeking information from 101 organisation and in 2018 by sending the Copies of RTI Act to 1000 people with a view to creating awareness about the RTI Act and its provisions. On the invitation of YASHADA, Pune which is the Apex body set up of Government of Maharashtra for imparting training to state level officers, Mr. Naveen Agrawal has so far imparted training to more than 1000 government and semi government officers in the RTI Act. Dr. S.V. Kasbekar, Officiating Principal, Dr. S.V. Tewani, Dr. A.G. Thadani, R.R. Shimpi, Vice Principals, Raju Gehani, Shyam Shende, Milind Ambade, Dinesh Gupta, Ram Tejwani, Rajesh Tharwani, Shailendra Hanwate, Mulchand Mohadikar, Mahesh Asudani, Jai Keswani, Ashok Sharma, Dipak Pardesi, Kapil Kukreja, Vicky Datre, Anil Madke, Jyoti Jeswani, Jamuna Hirani, Poonam Sadnani, Devi Methwani, Jaya Hingorani, Megha Korde & Sarika Narayani congratulated Mr. Naveen Agrawal for his grand efforts in this direction.

Can the General Diary of the police station where particulars of "All the details in r/o criminals arrested and entry of arrival/departure of all enrolled police officers on duty with nature of their duties, duty performed and places visited etc." are maintained be inspected and photo copies sought from a particular police station under RTI? Is there any particular clause/section that needs to be quoted for inspection under RTI? Any format available for inspection under RTI?

    Information denied under 8(1)(d)

    I had sought details of loan and copies of agreement entered with World Bank, JICA etc. of IT Expressway Chennai (created in partnership with Govt of TN) However the PIO has replied that they have moved out of world bank loan and taken loan from other banks details of which cannot be disclosed under 8(1) d of RTI Act citing "commercial confidence". However the IT Expressway is a public limited company having entered into agreement with Govt of TN and others for developing and maintaining a particular stretch of road.   9. Hello, I require help on co-operative issue. I had filed the RTI with the PIO, Dy registrar of co-op societies seeking information on affairs of society. The PIO has replied stating that the information I am seeking is available with co-operative society. My query is: 1] Can PIO direct an applicant to private body for information? 2] The society in question comes under the jurisdiction of the PIO, since PIO is public authority and co-operative society a private body, is it not duty of PIO to seek information from society and give it to me? How can PIO direct me back to society? This is RTI application, either I have to appeal or I have to forego. I cannot complaint against reply. So I want to approach FAA, under what grounds can I? 3] What kind of violation PIO has committed by directing me back to private society? 4] Does co-operative society come under the purview of RTI ACt? Your views are appreciated. I am fighting lone battle with corrupt system.

    Sir/madam , there is a gas godown already constructed adjacent to gram Tana but it is in survey no_ .     PIO Sends a staff to my house

    The person in the article below is me. I had a corporation official visit my house with the RTI and asking for my whereabouts. However the PIO has sent a reply on 8/5/19 stating that AE Div 170 is the person responsible for inspecting the banners on the particular stretch. It is after finalising this reply that I had got a call from AE Div 170 on 8/5/19 evening and a person visited my house on 9/5/19. The reply sent by PIO dated 8/5/19 was received on 11/5/19. Further The AE has stated that he has inspected the stretch and removed illegal banners immediately. However I have material evidence that the banners remained in the same place from afternoon till late night. Only the persons who kept the banner had removed them. So can I penalise the PIO for providing false and incorrect information.
  13. I had been taken to govt hospital to get report before being lodged in jail in a false case. Now my RTI to the govt hospital seeking copy of Accident Report/OP Ticket/Medical Examination report has been replied stating no such report available in my name on the date of occurance of the said incident. But I was lodged in prison only after submitting the report given by hospital to prison authorities. Now I would like to inspect the records available with the govt hospital on that day from 8 pm to 12 am. Can I go for first appeal seeking clarification as incorrect information is furnished and a report has been given by the hospital ? What Are Grounds clauses to be included? I have not asked for inspection in the original RTI. Now can I request inspection in the first appeal or should i file a new RTI for that?

  20. Critical Analysis of Supreme Court Judgements on the RTI Act, 2005 By Shailesh Gandhi, Former Central Information Commissioner Judgment : Thalappalam Ser. Coop Bank Vs. State of Kerala (2013) 16 SCC 82 The issue before the Court: Whether a co-operative society falls within the definition of "public Authority" under Section 2(h) of the RTI Act and be bound by the obligations to provide information sought for by a citizen under the RTI Act. The observations of the Court: Para 37: “We often use the expressions “questions of law” and “substantial questions of law” and explain that any question of law affecting the right of parties would not by itself be a substantial question of law. In Black's Law Dictionary(6th Edn.), the word 'substantial' is defined as 'of real worth and importance; of considerable value; valuable. Belonging to substance; actually existing; real: not seeming or imaginary; not illusive; solid; true; veritable. Something worthwhile as distinguished from something without value or merely nominal. Synonymous with material.' The word 'substantially' has been defined to mean 'essentially; without material qualification; in the main; in substance; materially.' In the Shorter Oxford English Dictionary (5th Edn.), the word 'substantial' means 'of ample or considerable amount of size; sizeable, fairly large; having solid worth or value, of real significance; sold; weighty; important, worthwhile; of an act, measure etc. having force or effect, effective, thorough.' The word 'substantially' has been defined to mean 'in substance; as a substantial thing or being; essentially, intrinsically.' Therefore the word 'substantial' is not synonymous with 'dominant' or 'majority'. It is closer to 'material' or 'important' or 'of considerable value.' 'Substantially' is closer to 'essentially'. Both words can signify varying degrees depending on the context. Para 38. “Merely providing subsidiaries, grants, exemptions, privileges etc., as such, cannot be said to be providing funding to a substantial extent, unless the record shows that the funding was so substantial to the body which practically runs by such funding and but for such funding, it would struggle to exist. The State may also float many schemes generally for the betterment and welfare of the cooperative sector like deposit guarantee scheme, scheme of assistance from NABARD etc., but those facilities or assistance cannot be termed as “substantially financed” by the State Government to bring the body within the fold of “public authority” under Section 2(h)(d)(i) of the Act.” The Court held that: Cooperative Societies registered under the Kerala Co-operative Societies Act will not fall within the definition of "public Authority" as defined under Section 2(h) of the RTI Act unless they are substantially financed. The Court ruled that Cooperative Societies are not Public authorities covered in RTI unless they are substantially financed. It defined the word substantial finance thus: The Court after looking at the various dictionary meanings-‘material’, ‘important’, ‘of considerable value’, ‘not illusive’ decided that it means essential only, when it says, 'Substantially' is closer to 'essentially' . But, there are instances, where private educational institutions getting ninety five per cent grant-in-aid from the appropriate government, may answer the definition of public authority under Section 2 (h)(d)(i)” Effectively this states that the finance must be essential to its functioning that it would struggle to exist without it. No Information provided. Our analysis of the judgment: The conclusion of the court that cooperative societies are not public authorities unless they are substantially financed is correct. However in defining the phrase ‘substantial finance’ it appears to have narrowed the scope of the RTI act by claiming that ‘substantial finance’ means ‘essential’ finance without which the body would struggle to exist. Thus even if a NGO or private body receives 100 crores annually it may not be deemed to be substantially financed if its total budget is around 500 crores and it argues that the amount from the Government is not essential for its working. The Court did not choose the words ‘material, important, of considerable value, not illusive’ which would have expanded the scope of the Act.   22. एक शहीद सैनिक के जान की कभी भी क्षतिपूर्ति नहीं हो सकती । फिर भी, शहीद सैनिकों के परिवारों के लिए किया हुआ ये एक छोटा सा प्रयास । A small effort for the families of martyred soldiers: Since last 2 years, I have been filing series of RTI applications related to Indian Armed Forces and Central Armed Police Forces (CAPF) for ensuring ex-Gratia etc. to families of martyred soldiers or soldiers declared as battle casualty from Central level. Also, filed different grievance applications for giving ex-Gratia to families of martyred soldiers from State level as required. Attached photo copies are just some of the responses received to the different applications. During above long process, responses and actions were taken by various departments like Ministry of Defense (Navy), Department of Ex-Servicemen Welfare (DESW) MoD, IHQ of MoD (Army), Air Head Quarters and many Zilla Sainik Welfare Offices and many District Collector offices and also Mantralaya at state level. Note: The RTI applications were primarily around Indian Armed Forces and Central Armed Police Forces (CAPF). 1) Indian Armed Forces: This includes below 3 professional uniformed services: i] Indian Army, ii] Indian Navy, and iii] Indian Air Force. 2) Central Armed Police Forces (CAPF): This includes forces like: i] Border Security Force (BSF), ii] Central Reserve Police Force (CRPF), iii] Central Industrial Security Force (CISF), iv] Indo-Tibetan Border Police (ITBP), and v] Sashastra Seema Bal (SSB). and others.   24. Dear sir , My Daughter took admission in (Govt College)Agra College, law Faculty under B.R.Ambedkar University, in July 2016. Till today ie. August 2017 no formality has started for conducting of exam whereas college has completed course and classes closed till exams are not conducted.   25. Respected sir , I had opened an demat account in Axis bank named Axis direct . In 2015-16 . In February 2017 I had given an application regarding the closing of my demat account but bank rejected my application saying that I have some dues pending so I clear all my dues an applied again for the closing of my demat account in the same week...but bank didn't close my account and now I have been charged with the year amount of account maintenance so sir please help me in this issue...I have meet the manager and have given complain regarding this but they are not showing any interest in solving my problem...pls help me sir.....thank u...!
