Dahiben Narottamdas Modi who claims to be the aunt of Prime Minister Narendra Modi had filed an RTI application in December last year in which she sought to know details of lease, renewals, norms for fixing rent, reasons for not renewing her lease every five years and whether the department was ready to pay arrears for periods in which lease was not renewed after five years, among others. The matter reached the Commission after she failed to get satisfactory response of her Right to Information application and her first appeal before higher authorities remained unanswered, according to details submitted by Dahiben before the CIC. Dahiben claimed she was all alone and survived on the meagre rental income of Rs 1,500 from the building for which the revision of rent was pending. While hearing the matter on June 21, Acharyulu observed that while she claimed to be a relative of the Prime Minister, she had not used it to influence the authorities. It was only after not being provided a proper response that, in utter helplessness, she mentioned her relationship with the Prime Minister, he noted. He also asked some tough questions from the department about the ordeal faced by her and why penalty should not be imposed on the officers handling her RTI petition.

The latest directive assumes significance as some RTI activists have been killed in different parts of the country allegedly for seeking information related to some potential scams or irregularities in government departments. Transparency watchdog Central Information Commission (CIC) will now decide appeals and complaints even after the death of an appellant or complainant, the government has said. The Right to Information (RTI) Act allows information seekers to approach the CIC to lodge second appeal and complaint in case they are aggrieved with government departments over disposal of their application filed under the law. As per rules finalised in 2017, the proceedings pending before the CIC shall abate on the death of the appellant or complainant. The latest directive assumes significance as some RTI activists have been killed in different parts of the country allegedly for seeking information related to some potential scams or irregularities in government departments. Also, many RTI activists have opposed provisions of the 2017 rules, including the one that allows no action on appeals in case of the death of the appellant, saying they were aimed at diluting the Act. “Instances have occurred wherein appellant/complainant dies before their case is considered by the Commission,” said a statement issued today by the Personnel Ministry, the nodal department for RTI matters.

    Second Appeal not implemented.

    I had filed an RTI on 3-Nov-2016. It was not answered satisfactorily. I filed my first appeal on 13-Dec-2016. It was not answered. I filed my second appeal on 2-Feb-2017. During the hearing on 13-Mar-2018, the CIC ruled that I should be given the information that I had requested. I waited to get my information for a few weeks, but did not get the same. I sent an email to RTI officer, First Appellate authority(FAA) and CIC. I did not receive any reply from RTI and FAA. The CIC told me that RTI officer had filed a compliance report with CIC. I told the CIC in multiple emails, during last few weeks, that the CIC order was not implemented. I did not get the information that CIC commissioner had ordered during the second appeal. But now there is no answer from CIC. Now what should I do? My RTI exposes a fraud at a government organization. Multiple managers are involved in this fraud. So there is motivation to not give me this information.

    second appeal within 45 days from the date of filing The provisions of the Act and Rules do not prescribe any period within which a second appeal under s.19(3) is to be disposed of. Section 19(6), however, prescribes the period within which appeals under sub-ss.(1) and (2) of s.19 are to be disposed of. Such appeals are to be disposed of within 30 days from the date of receipt thereof or within such extended period not exceeding a total of forty five days from the date of filing thereof, as the case may be, for reasons to be recorded in writing. It appears that the second appellate authority has not yet decided the petitioner’s appeal mainly for the reason that the statute has not prescribed any period within which a second appeal is to be disposed of. As rightly submitted by counsel for the petitioner in the absence of any period prescribed for disposing of 2 a second appeal under s.19(3), the second appellate authority was under an obligation to dispose of the petitioner’s second appeal within a reasonable time. A second appeal arises from a decision in the first appeal under s.19(1), and a first appeal arises from a decision or a failure to give a decision under s.7. The sparkle of a strong strand of speed woven through the sections of the Act is abruptly lost in the second appeal that has been allowed to run wild. This open-ended second appeal scheme is bound to make the s.6 request go totally adrift generating a multi-tier avoidable and unwanted offshoot Court proceedings such as this case. In my opinion, keeping in mind the respective maximum periods fixed for deciding the first appeal under s.19(1) and disposal of a request for obtaining information under s.7, the second appellate authority should have decided the second appeal within 45 days from the date of filing thereof. In view of the scheme of the statute, I think this period should be considered the reasonable period for deciding the second appeal. I am of the view that this petition should be disposed of directing the authority to decide the appeal. For these reasons, I dispose of the petition ordering that the second appellate authority shall decide the petitioner’s second appeal within 45 days from the date of communication of this order.

Hello Experts, How do I make a "Second Appeal" on CIC website ( https://dsscic.nic.in/online-appeal-application/onlineappealapplication is the form on the link the right one?) after having made successful "First Appeal"?. Also, on the above form's second page, residing on the link, I am asked of " Second Appeal Application" what is that?. Does it mean I have to have made a "Second Appeal" like the "First Appeal" before coming to the above form?. Please find attached screen shot of the form. Advice please.
  15. I have been appeared before the commission 10 times but commissioner is not bring taken action u/s 20 of tract against respondent whereas, respondent have been appeared only 1 time. When I request to commissioner to take cogent action respondent he said first when respondent will come then I take any action even that I request many times to commissioner but he didn't.   16. I asked PMC Engineer for some information. On RTI application, I clearly mentioned that I require reply by registered post. I did not receive any reply for a month. I filed first appeal and today had the hearing in PMC office. The Appeal officer seemed to be a good friend of the PIO. I told the appeal officer that I did not receive any communication from PIO. To which, PIO said that wrt my RTI application, he replied back (by normal post) that I need to pay some amount for photocopying documents. Fine. But this reply never reached me. They just made some entry in their outward reply that it was sent. No postal proof. When I asked the appeal officer, he said it is not required that the PIO replies by registered post. I feel this is not right. Appeal officer also said I could appeal to SIC about this. So I need your opinion, can I appeal against the PIO for not sending communication through registered post? Any chances PIO will be punished? (I have no enemity with the PIO, but I know the PMC officials are extremely careless. That’s why I want to take this step).

Background: Relating to an RTI query to SEBI on 30th December 2015, I initially filed online a second appeal with CIC on 5th July 2016 (and received an online acknowledgment but only radio silence from CIC after that). The "provisional number" on the screen acknowledging my second appeal filed online was useless in searching for its status. After many months of back and forth (and some advice from Shri Karira who contributes a lot to this site) finally today, I received the following message from one of folks at CIC, Shri Krishan Avtar Talwar: "Dear Sir As per the available record, it seems that your second appeal dated 5 july 2016 on RTI application dated 30.12.2015 has been registered vide File No. CIC/SEBIH/A/2017/139953 on 12.06.2017. With regards" I'm trying to use this File No. above, in whole or in part, at the status-checking page = https://rtionline.gov.in/request/status.php (which requires not a file number but a registration number) and nothing so far based on the above File No. seems to be the registration number needed to check its status. Can anyone with experience with CIC and its registration numbers please help, and let me know what the registration number is. Thank you. Best, -Murgie
  19. I filed an rti application on 25.12.2015 result was incomplete information given . Then i filed first appeal result was same and no new information was given . I filed second appeal to which sic haryana fixed hearing date on 26.5.2016 . Result was same , show cause notice was given to apio/pio after which they gave some more information but still incomplete and hearing date was fixed on 23.02.2017 . On this date apio/pio was directed to give relevant information within two weeks and show cause notice was dropped . Apio/pio has not furnished any reply after that . Want to move high court , please advice WITH SAMPLE OF WRIT PETITION FOR P & H HIGH COURT CHANDIGARH

  21. Hello All, I had filled a 2nd RTI appeal online through Central Information Commission, it had been more than a month and no CPIO has been assigned to my case (as checked in status). Even, for the RTI first appeal also no CPIO had been assigned. And didn't get any response from the concerned dept. Please, guide me what action I can take next, it has been already about 5 months since I filed the RTI request and not getting any response. Looking for your suggestions. Thanks, Smit.
  22. Hello, Few days back I have submitted 2nd appeal to CIC (rti.india.gov.in) through online and send the singed copy though speed post. When I checked the speed post status, it is showing received date is 12th Jan 2015. But till now my application status is showing “Singed copy awaiting”. What to do now.

    Hello, No information/reply has been received from P.I.O. CPPC (SBT) Thiruvananthapuram on my application dated 21 Oct 14/First appeal dated 27 Nov 14.Now which Information Commission shall I approach, STATE or CENTRAL.
