  1. Dear All, I had filed a RTI application on 22.08.2013 seeking information about indexing and cataloguing of documents in Police Department in Gurgaon as per Section 4(1)(a) of RTI Act 2005. The Gurgaon Police replied that their records are not indexed. Filed first appeal with Police Gurgaon but did not response. Filed second appeal under Section 19(3) of RTI act 2005 before Haryana State Information Commission which decided the appeal on 6th May 2014 ( case number 2507 of 2014) and directed the Commissioner of Police to Catalogue and index all its documents in four months. Waited till No 2014 but office of Commissioner of Police Gurgaon did not index and catalogue the records and thus filed Complaint against the Gurgaon Police on 17th Jan 2015 vide Complaint number 26 of 2015 and Hon'ble State Information commissioner Ms Urvashi Gulati (IAS) directed on 10/31st March 2015 to Director General Police Haryana to complete the task of maintain all records duly catalogued & indexed as per Section 4(1)(a) of RTI Act 2005. It is mention here that if records are indexed and catalogued then it becomes very easy to access the records in seconds and thus saves time, energy & resources of common man & of course also of department.   3. Dear All, CPIO/s beware. Now it is difficult to scare information seekers under RTI Act 2005 by quoting/asking for lump sum amount in response to RTI applications. The Hon'ble Mr. Sharat Sabharwal has come down heavily on CPIO of NCDC in undersigned second appeal by ordering free of cost information because no calculation was given for seeking the extra charges of Rs. 16500/-.     Complaint under section 18 of RTI

    Hello, I have prepared a complaint under section 18 of RTI to be sent to SIC, Mumbai. Do I have to send copies of this complaint to PIO & FAA. Senior Citizen

Dear All, I have had the privilege to communicate with various public authorities during my 4 and half years of learning in RTI & Human Rights matters and was shocked to NOTE that public was addressed in communication as slaves or at best subjects whereas the Chapter XV of "Manual of Office Procedure" mandates that every communication to each & every member of PUBLIC to be started with salutation/address as "Sir/Madam and end with subscription "yours faithfully". I wrote letter to PM, CM & CS, DGP, CP Gurgaon & of course Haryana Prisons which was the first one to implement it. AND now the Haryana Police has also followed the suit and undersigned has received a communication no.3611/G A 3 dated 12th June 2015 which is addressed as "Sir" and ends with "Yours Faithfully" Haryana Prisons has come out with clear directions to address the public in communication as "sir/Madam and end with Yours faithfully". I salute the brave DGP for breaking the tradition of treating the citizens as Subjects and acknowledging them as respectable members of the society. I may have differences with local Police but this step is indeed a step to be recognized and appreciated. Reported by Anahita Mukharji in timesofindia.indiatimes.com on Oct.18, 2013 Denied information on Ajit Pawar's I-T returns, former CIC moves high court - The Times of India Denied information on Ajit Pawar's I-T returns, former CIC moves high court MUMBAI: In a possible first for the country, former central information commissioner (CIC)Shailesh Gandhi has moved the Bombay high court after he was refused information under the Right to Information (RTI) Act on deputy chief minister Ajit Pawar's income-tax returns. Gandhi hopes to set a precedent for public servants disclosing I-T returns. "There is a general belief that politicians and elected representatives are corrupt and amass wealth at the expense of the public. There is also a common belief that I-T authorities do not check the returns of those who are elected with their declared affidavits filed at the time of standing for elections. If this is true, citizens will act as monitors and help correct such practices. But if citizens' apprehensions are not true, it would enhance the trust and respect for the elected representative, which is necessary for a healthy democracy," says Gandhi's petition, adding that this would also improve citizens' trust in the income-tax department. Gandhi was denied the information by the I-T department's public information officer. He appealed against the decision under the RTI Act, but the information was denied by both the first appellate authority and the CIC. Gandhi has now filed a writ petition in the high court against this decision. Gandhi, who was involved in framing the RTI Act, was denied the information on grounds that it was of a private nature. The former CIC, however, argued that the section under which he was denied information does not apply to Ajit's I-T returns. Information was denied under Section 8 (1) (j) of the RTI Act, which exempts personal information from being disclosed to the public to protect the individual's privacy. Gandhi said the exemption does not apply as there is a larger public interest in the disclosure of I-T details of elected representatives, which cannot be considered an invasion of privacy. "Even if it was claimed that there is some harm which could accrue to Ajit by disclosing his income, it is a fact that he has to publicly declare his assets when he stands for election. It would not be possible to argue that any further harm could accrue to him by disclosing his IT returns and balance sheets," says the petition. Despite several attempts, TOI was unable to contact Ajit for comment.
  8. Hon. Experts, Please inform me "Is the section 18(1) dealing with the right to Complaint in place? are there any changes or modifications made in Section 18(1) of RTI Act? If yes, what are the changes/modifications and their effect on the rights of a complainant? Secondly the Maharashtra RTI Act does not specify any fees for Complaint under 18(1), will you pleasae inform me whether there are any fees to be paid for an RTI Complaint under 18(1).   14. I think PIO needs to mention the section before denying any information. I have asked for few information about internal complaint committee constructed under sexual harassment act 2013. Every answer is being denied without mentioning section. Here are two question [My question] Please provide me the list of members as prescribed in Section 4(2) of the said Act including the presiding officers , members among non-government organizations or association committed to cause of women or a person familiar with the issue related to sexual harassment nominated to your “internal complaint committee” [PIO answer] : The committee to deal with complaints regarding sexual harassment is internal committee for staff member . Hence no public interest in large appears in declaration the name , telephones , number of member of committee. [My question] Whether your branch /organisation as per Section 19 , duties of employer of the said act in has formulated an internal policy or charter or resolution or declaration for prohibition , prevention and redresal of sexual harassment at work place? Supreme Court strikes down Section 66A of IT Act which allowed arrests for objectionable content online Reported by Amit Choudhary & Dhananjay Mahapatra in Timesofindia.indiatimes.com on Mar 24, 2015 Supreme Court strikes down Section 66A of IT Act which allowed arrests for objectionable content online - The Times of India The Supreme Court on Tuesday declared Section 66A of Information Technology Act as unconstitutional and struck it down. This section had been widely misused by police in various states to arrest innocent persons for posting critical comments about social and political issues and political leaders on social networking sites. The court said such a law hit at the root of liberty and freedom of expression, two cardinal pillars of democracy. The court said the section has to be erased from the law books as it has gone much beyond the reasonable restrictions put by the Constitution on freedom of speech. The Supreme Court said section 66A was vaguely worded and allowed its misuse by police. The court, however, upheld the validity of section 69B and the 2011 guidelines for the implementation of the I-T Act that allowed the government to block websites if their content had the potential to create communal disturbance, social disorder or affect India's relationship with other countries. However, the court watered down section 79 of the I-T Act making it further difficult for the police to harass innocent for their comments on social network sites. The SC delivered its judgment on a bunch of petitions filed in the light of misuse of the penal provision by government authorities against persons who allegedly uploaded offensive posts on social networking sites. The petitioners, including NGOs, civil rights groups and a law student, had argued that Section 66A violated citizens' fundamental right to freedom of speech and expression. The first petition was however filed by a law student Shreya Singhal. The government had opposed the plea for quashing the provision saying it is meant to deter people from uploading grossly offensive material which can lead to lawlessness by inciting public anger and violence. Justifying the retention of the provision, the Centre had told the apex court that the impact of the internet is much wider and restriction on this medium should be higher in comparison to print and TV. It had said, unlike print and electronic media, the internet did not operate in an institutional form and there was need for some mechanism to put checks and balances. The government had said the provision could not be quashed just because of its potential misuse. Posting pictures and comments on social networking sites which hurt religious sentiments could not be tolerated and people must be prosecuted, it said. Former attorney general Soli J Sorabjee, who appeared for one of the petitioners, termed the judgment a 'glorious vindication' of right to free speech. He spoke to the TOI after SC bench of Justices J Chelameswar and R F Nariman struck down section 66A as unconstitutional. Sorabjee said: "The judgment is well researched, well reasoned and erudite in expression. It is a glorious vindication of freedom of expression."

    Hi Team, When we give some application to any Govt office, if there is no reply from them then we can file an RTI for asking an status of that Requestion. I would like to know the section for that application...under what section from RTI Act 2005 we write that RTI application? Can someone help me

CWP No.11284 of 2014 (O&M) A bare combined reading of above said information sought by the petitioner vide Annexure P-1, Section 24(1) as well as Section 24(4) of the RTI Act would show that the information sought by the petitioner was not exempted and the Intelligence Wing of the respondent-State was duty bound to supply the information sought by the petitioner. Since, respondent No.1 has misdirected itself while completely ignoring the true import of provisions of Section 24 of RTI Act, therefore, the impugned order dated 22.05.2014 (Annexure P-8) is patently illegal and the same cannot be sustained In view of the above said provisions of the RTI Act, in case respondent No.2 was of the view that the information sought by the petitioner was pertaining to theIntelligence Wing, the Public Information Officer of respondent No.2 was dutybound to transfer the application of the petitioner to the concerned departmentunder intimation to the petitioner. Even this much was not done in the presentcase. Further, the respondents have been taking different stands at differentpoints of time as per their suitability. The only stand taken in Annexure P-3 dated 27.06.2013 was that the Intelligence Wing was exempted from the provisions of RTI Act under Section24(1) thereof. However, in the short reply filed by respondents No. 2 to 4, the stand taken was that information sought by the petitioner was not available on record of the Intelligence Wing. When a pointed question was put up to the State counsel in this regard, he had no answer and rightly so, because it was a matter of record. The respondents have taken contradictory stands at different points of time. No other argument was raised. Considering the peculiar facts and circumstances of the case noted above, coupled with the reasons aforementioned, this Court is of the considered view that since the impugned order (Annexure P-8) dated 22.05.2014 passed by respondent No.1 has been found to be patently illegal, the same is hereby set aside. The matter is remitted back to respondent No.1 to pass a fresh order in accordance with law. Let an appropriate order be passed within a period of three months from the date of receipt of a certified copy of this order. Resultantly,with the above said observations made and directions issued, the instantpetition stands allowed, however, with no order as to costs..

Dear Sir, Recently I applied an RTI seeking reasons from Recruitment Assessment Centre (RAC) of DRDO for not shortlisting me for their recruitment interview call since I suspected that the interview call was influenced by DRDO corrupt officials. In reply DRDO has taken shelter under section 24(i) and rejected my RTI query. Now I have to submit my first appeal. Kindly guide me for framing my first appeal. The reasons for my no interview call has nothing to do with national security and intelligence but section 24(i) is protecting DRDO and making it's recuitment process non transparent and provides room for corruption. Can I file my first appeal by citing suspicion of corruption in recruitment process hence reason for no interview call is sought. Do I need to provide any document to support my allegation of corruption for my first appeal. Please guide I'm new to RTI. regards,

Dear all!, Yesterday morning my friends house comes in the newly declared national highway, on 7.30 a.m city municipal council authority had with out public notice had demolished the compound, my protest went in vein, police had interviewed in the matter and they were able to demolish the compound, immediately i applied under the rti for the details under the section 7(1) accordingly they have to give the information within 48 hrs.
