Gandhi hopes to set a precedent for public servants disclosing I-T returns. "There is a general belief that politicians and elected representatives are corrupt and amass wealth at the expense of the public. There is also a common belief that I-T authorities do not check the returns of those who are elected with their declared affidavits filed at the time of standing for elections. If this is true, citizens will act as monitors and help correct such practices. But if citizens' apprehensions are not true, it would enhance the trust and respect for the elected representative, which is necessary for a healthy democracy," says Gandhi's petition, adding that this would also improve citizens' trust in the income-tax department. Gandhi was denied the information by the I-T department's public information officer. He appealed against the decision under the RTI Act, but the information was denied by both the first appellate authority and the CIC. Gandhi has now filed a writ petition in the high court against this decision. Gandhi, who was involved in framing the RTI Act, was denied the information on grounds that it was of a private nature. The former CIC, however, argued that the section under which he was denied information does not apply to Ajit's I-T returns. Information was denied under Section 8 (1) (j) of the RTI Act, which exempts personal information from being disclosed to the public to protect the individual's privacy. Gandhi said the exemption does not apply as there is a larger public interest in the disclosure of I-T details of elected representatives, which cannot be considered an invasion of privacy. "Even if it was claimed that there is some harm which could accrue to Ajit by disclosing his income, it is a fact that he has to publicly declare his assets when he stands for election. It would not be possible to argue that any further harm could accrue to him by disclosing his IT returns and balance sheets," says the petition. Despite several attempts, TOI was unable to contact Ajit for comment.

I file RTI to public information officer cum Taluka development officer he ignore it, I file first appeal to FAA (district development officer) he ordered to PIO give INFORMATION with in 10th day's at the time of hearing, PIO failed to give information I file appeal to state information commission state commissioner ordered by notice to PIO give information with in 1 month PIO FAILED to give info. I file second appeal to commission, up to all in sufficient time limit but the period between filling second appeal and first hearing it's so large about 2.5 year's these information are related financial matter suffered officer in this matters is retired . hearing on 1 April 2015

  5. Hello, About one month ago, I have started filing applications seeking information under RTI Act. I have some doubts/clarifications/comments from RTI Activits. 1. As per DOP&T letter No.1/1/2013-IR dated 21.10.2014, all PIOs are required to upload (from 31.10.2014) RTI Applications/appeals and the replies on their respective websites. Some PIOs have not started so far. Which authority is required to monitor implementation of these requirements. 2. What is the provisions under RTI Act regarding replies to applications/appeals are to made in the same language (Hindi/English/local language) in which the RTI Application was received. 3. Whether hard copy of reply would be received from for the RTI Applications made on online (in spite of the fact that reply has already uploaded on their website). 4. RTI reply would be sent by the PIO – By ordinary post/By Regd. Post/Speed Post/By courier. 5. Section 4 of RTI Act require All PIOs to disclose/upload certain information on suo moto basis on their website. What are the provisions relating to upload information in respect of a specific activities of a Department (UPSC & SSC examination related information, Ministry of External Affairs related to issue of passports, visas and revenue collected etc.). 6. In my RTI application, I requested for information a) how many RTI applications received in Hindi and replied to Hindi b) Number of RTI applications received from residents of Delhi . The reply received from PIO says – Information not maintained in the desired format. 7. What is the provision under RTI Act to provide facility for applicants who wish to submit the application in person (I requested whether a sign board/notice board was available at the office of Public Authority giving relevant details – PIO contact details, fees payable, mode of payment, time frame for reply of RTI application etc.) 8. I requested for total number of RTI applications received in 2014 – under sub-head a) received by post b) online. They have provided details of online applications. Separate information of applications received by post and in person could not be provided by them. 9. There are cases of RTI applications transferred (fully or part of information) to other Public authority and likewise RTI applications received from Public authorities. How such RTI applications are included or not included in the total RTI applications received in a year. 10. In my two RTI applications I have received reply on 21.3.2015from the concerned PIO. Question: Total number of RTI applications received in 2014 Reply : 1720 Question : Number of RTI applications received by post, online and in person in 2014 Reply : 1877 (Online 433 and By hand & by post together 1444) The questions were same, however total number of applications mentioned in their reply is different. Which one is correct and what next I can do. 11. I requested for how many RTI applications could not be replied in the time frame of 30 days. The PIO informed : Information not maintained in the desired format. I am a beginner and I have many more questions relating to RTI. I do not have the intentions to put any pressure on the PIO, who are supposed to RTI related work in addition to his/her routine duties. RTI Act would be completing 10 years in October this year. India is world leader in I.T. Sector. The software provided by DOPT for RTI related work would be in a position to generate reports/replies to such routine queries by click of a button. Or DOPT may invite public suggestions for the improvement of system/software for handling RTI work.

    Seeking information from AMC

    Hello, I really need your help from you guys. I had made online complain to Ahmedabad Municipal Corporation regarding some "Patch Work (repairing of road using Coal Tar) in our area. After 2 or 3 days, surprisingly they closed my complain without taking any action. I called customer care 155303 and requested them to reopen my complain. After 2 days or so, again, they closed the complain without any action OR without any communication to me. I called customer care one more time and reopen the same complain again. Already 4 days has gone, i have not heard anything from AMC, my request is still open status and no any action has been taken by the AMC till right now. Now, what i plan is to use our RTI weapon to solve this issue. Can somebody please let me know the procedure of drafting the RTI for the above problem ? Which format do i need to use to draft for seeking information from AMC ? To whom do i need to send RTI application ? How much fees do i need to pay ? What are the mode of payment.   7. If you are looking for information under RTI Act in Uttar Pradesh, just tread carefully. If the state information commission has its way, it could penalise you and make you pay compensation to the government department you wanted the information from.   9. Hello, In view of difficulties faced by me at Voter Center at Delhi in connection with time frame for issue of Voter cards etc. There was no board giving details of senior officer to contact. Apart from this I felt there should be some board in that giving details how and to whom application under RTI to be submitted. Similar board should also be there in the Deputy Commissioner office. In this connection I sent an e-mail to DC. What is the provision for such arrangements in the RTI rules

What would be the actual fees to be collected from the students from class V to class X for the recognised schools in GHMC Limits, as per the right to education act and respective provisions of the Govt. rules. Also, kindly let me know the List of Schools along with the addresses at which the recognition for that particular school is availed. 2. Kindly provide the information pertaining to the Prirvate Schools, whether all the requirements, such as rules and regulations relating to amenities, open ground, play area, parking place etc., are fulfilled or not. 3. List of new schools waiting for the recognition. I state that the information sought does not fall with in the restrictions contained in section 6 of the Act and to the best of my Knowledge it pertains to your office.
  11. NEW DELHI: The provisions of RTI Act apply on private schools also which are governed by a law such as the Delhi Education Act, the Central Information Commission has held. The case relates to an ex-employee of Jindal Public School who filed an RTI application with Directorate of Education seeking a certified copy of service book and other details from her past employer. The Directorate provided the information available with them but the school refused to furnish the reply saying RTI Act does not apply on it. information sought by its ex-employee, Information Commissioner Sridhar Acharyulu said the school is duty bound under sections four and eight of Delhi Education Act 1973 to abide by the regulatory conditions of service, payment of salaries as prescribed for which school has to maintain records which provide an "inherent and implied" right to information to their employees. Jhajjar, August 2 Naresh Kumar Joon, a head constable of the Delhi police, hailing from Noona Majra village near Bahadurgarh, got the shock of his life when he was directed to deposit a whopping Rs 5 lakh for availing information from the senior medical officer (SMO) at Bahadurgarh community health centre, who also acts as public information officer (PIO). He, however, filed an appeal with the State Information Commission (SIC), following which the SIC directed the PIO to allow the applicant access to the records. But when I scanned the records most of the documents were missing, he said, adding that he would complaint to the SIC. He also alleged misappropriation of funds of the health centre. Joon, husband of staff nurse Darshna, who is posted at the CHC, Bahadurgarh, filed an application with the civil surgeon, Jhajjar, on December 12, 2006, seeking information on nine points regarding various kinds of fees being charged at the centre. After dithering for about four months, the civil surgeon entertained his application and directed the SMO to provide the information and charge the requisite fee. The SMO dispatched a letter to the applicant on April 20, asking him to shell out Rs 492,100 as the cost of providing the information. It includes Rs 375,200 as charge for providing copies of 3,750 medical legal reports (MLRs) at a rate of Rs 100 per MLR and Rs 40,650 for issuing 813 post mortem reports at a cost of Rs 50 per report. Significantly, this amount excludes the charge of photocopy of these documents that totals about Rs 76,250. He, however, appealed to the SIO against the unreasonable fee. The commission after summoning the applicant as well as the PIO directed the former to personally examine the files and shortlist the information that he wanted. Joon alleged that his application was put under wraps for about seven months on one pretext or the other. Firstly, the civil surgeon requested the SIC to give three months’ time, citing transfer of officials as reason and then rejected the application saying that the applicant had not signed it. But after he took up the case with the SIC, the civil surgeon in his capacity as first appellate authority directed the SMO through a letter dated April 12 to provide the information to the applicant. Civil surgeon O.P. Hooda refused to talk on the issue. Joon alleged that his wife was being harassed on account of his sustained efforts to seek information, as she was sent to a village in Mewat district on deputation. It may be mentioned that the normal charges are Rs 2 per page for the photocopy of documents while in Haryana Rs 10 per page are being charged. Moreover, as per section 7 of the RTI Act, the applicant shall be provided information free of charge where a public authority fails to comply with the time limit, i.e. one month.   13. NAGPUR: A farmer was allegedly beaten up by the sub-divisional agriculture department officials on Monday evening in Yavatmal district. The farmer had reportedly gone to the department office to seek details about the prime minister's relief package. Sandesh Rathod of Gawli Heti village (Yavatmal), wanted to know whether electrical agriculture pumps were included in the PM's package or not. Rathod also claimed that despite there being a provision for agriculture pumps in the PM’s package, the farmers were yet to get Rs 5,000 as subsidy to install the same on their farms. The farmer got into an argument with an employee for not providing details of the scheme. Later, he was allegedly beaten up by officials. The police have registered an FIR.   14. Government bodies are devising ingenious ways to discourage lay people from using the powerful Right to Information (RTI) Act. In the latest instance, the Greater Hyderabad Municipal Corporation (GHMC) has asked an applicant to pay a whopping Rs 1.29 lakh for seeking a certified copy. Though the RTI Act was passed by Parliament in 2005 to provide information to the general public, the government bodies seem to be dissuading people from approaching them for certified copies of official documents. In the latest case, Dr K Jhansi Rani, a resident of Yellareddyguda, sought a certified copy of the layout of the Jubilee Hills Co-operative House Building Society Ltd. under the RTI Act, but got a shocker from the GHMC in the form of a letter (Lr.No.305/TPS/GHMC/HO/RTI/07/2731 dated December 6/7, 2007) asking her to "remit Rs 1,29,389 in the GHMC treasury so as to take further necessary action in the matter (issuing of certified copy)". The GHMC’s town planning officials scanned old records and worked out a fee structure as the RTI Act allows the information provider to collect ‘actual cost’ from the applicant. As Jhansi Rani sought a certified copy of the layout of the 1,173.26 acre Jubilee Hills Co-op Housing Society, the GHMC officials invoked an old rule to collect the fee. Of 1173.26 acres plan, they charged Rs 550 for the first two acres and the rest (1,171 acres) at Rs 110 per acre which works out to Rs 1,28,839. As per the Right to Information Act 2005, the government departments can charge ‘actual cost’ for providing information in the form of photostat copies. But the GHMC has been collecting exorbitant charges as per the scheduled rates mentioned in the Hyderabad Municipal Corporation Act, 1955, which were being adopted for RTI-related applications. Incidentally, this is not the first time that the corporation charged exorbitant rates from the applicants. The town planning wing charged Rs 72,000 to NGO Forum For A Better Hyderabad to provide information on some illegal constructions in the city. The Forum approached the State Information Commission against the charges being collected by the municipal corporation."The GHMC cannot collect charges as per the scheduled rates of the HMC Act. The corporation seems to be discouraging people from seeking information from them. They should provide information by collecting minimum charges,’’ Forum For A Better Hyderabad general secretary O M Dabera told ‘TOI’. "We have taken up the appeal filed by the Forum For A Better Hyderabad on the issue and even completed hearings of both parties. The matter has been sent for some legal clarification," State Information Commission sources said. "We have been charging scheduled rates for certified copies as they will be signed by officers concerned and will be treated as duplicate copies. For general information and photostat copies, the corporation is collecting only paper charges,’’ GHMC additional chief city planner K Balakrishna said. Photocopies of documents have no legal value, but certified copies have legal bearing, even one can take legal course based on the information.   15. SHIMLA: Seeking information under the Right to Information (RTI) Act in Himachal Pradesh is about five times more expensive than the fee charged at the Union government level. After paying an application fee of Rs 10, a person seeking information under RTI has to pay Rs 10 per page for photocopy of an a-4 size sheet and Rs 20 if the size of the paper is more than this, sources in the Information Commission here said. The charge per page of photocopy of a-4 size sheet at the Union government level is only Rs two, they said. Besides, information available in the form of printed publication will be made available at printed price, they added. For information available in electronic form and supplied in the same form, CD or floppy disk, the charge is Rs 50 per floppy and Rs 100 per CD, the sources said. The fee for perusal of government files is Rs 10 for 15 minutes and the amount will multiply for every additional 15 minutes, they said. Chief Information Commissioner of the state Prem Singh Rana maintains that the fee is not a hindrance to people seeking information under the act. "The amount (Rs 10 per page) is not for generating revenue but is aimed at spreading awareness about the act from the money acquired from the applicants," Rana said, adding that so far, nobody has objected to the fee amount.     Govt. functionaries seeking information.

    Can a Govt. functionary, in the capacity of a citizen of India, ask the higher authorities of his own department for information that involves any priority issue of public interest?
  17. An individual gives certain information against another person to the department. Then, he seeks information in this regard. My query is: (a) If the information has not been used by the department yet or is not useful at all, can the information be given regarding the status thereof? Will the 'third party clause' be invoked? (b) If the information has been used, can then the information be given without invoking the third party clause?
