Guwahati, May 9: The Krishak Mukti Sangram Samiti (KMSS) today demanded a CBI probe into the alleged multi-crore scam in the allocation of construction material to private companies engaged by the National Highways Authority of India (NHAI) in the state for the East-West corridor project. The KMSS said RTI applications submitted by it had revealed that the Assam forest department has been providing sand, stones and boulders to private companies engaged by the NHAI at government rates. MADURAI: A petition has been filed in the Madurai bench of the Madras high court seeking its intervention to get information under the RTI Act on the appointment of 23 district judges in Tamil Nadu.   9. #Lucknow #Uttar Pradesh The Uttar Pradesh State Information Commission (UPSIC) - the RTI watchdog body - has directed the Akhilesh Yadav-led Uttar Pradesh government to furnish information related to the preventive steps taken by it during the recent ‘ghar vapsi’ campaign by Hindu outfits across the state. The commission has written to the state’s Information and Public Relations Department (IPRD) for providing information in this regard. The Hindu, 18 Jan 15, New Delhi, Mohammed Iqbal RTI reply supplied to lawyer Amit Sahni reveals that there is no written guidelines regarding installation of ACs in Tis Hazari and Patiala House court complexes. However, the RTI reply said the work in this regard was in progress. Mr. Sahni said he had noticed that in Tis Hazari court, ACs were installed in the offices of almost all the clerical staff, but surprisingly, not in all the court rooms. The issue relating to the need for installation of ACs in the two important court complexes in the Capital, visited by thousands of litigants every day, has been brought to the Delhi High Court by a lawyer, who had earlier sought information in the matter through the Right to Information Act. CIC seeks change of Govt officials' attitude CIC seeks change of Govt officials' attitude Pioneer News Service | New Delhi They resent public demand for 'too much' information for 'too less' a fee: Report The first annual report of Central Information Commission (CIC), the final appellate body for the Right to Information (RTI) Act, has sought a change in the attitude of Government officials for better implementation. The report, which was tabled in the Monsoon Session of Parliament and would be released at a conference of State Information Commissioners on Tuesday, says that Government servants think that they have a monopoly over records. Calling for a change of mindset amongst officials in effectively implementing the RTI Act, the Commission has observed: "An attitudinal change is needed among public officials who still believe that they have a monopoly over records and resent the public demand for 'too much' information for 'too less' a fee." The report points out that several departments and Ministries, including Delhi Metro Rail Corporation (DMRC), UPSC, CBI, have sought exemption from the Act. "The Supreme Court (Ministry of Law and Justice) has sought exemption from the Act for any information, which, in the opinion of the Chief Justice or his nominee, may adversely affect or interfere or tend to interfere with independence of judiciary or administration of justice," the annual report has said. Similarly CBI, UPSC and DMRC have also sought exemption from coming under the purview of the Act on one ground or another. The CBI has wished that it be included in the Second Schedule of the RTI Act, which grants immunity to intelligence and security organisations of the country. Organisations under the Second Schedule of the Act are not obliged to provide any information to applicant unless they (information) belong to corruption or human rights violation cases. While the UPSC has asked for exemption from disclosure of information relating to examination and recruitment cases, the DMRC have sought total exemption from the provisions of the Act. The DMRC feels that it has a very tight schedule for Phase II and future phases and handling RTI applications would unnecessarily burn it with administrative work. Apart from the exemptions sought, the 2005-2006 report also finds a host of suggestions made by public authorities. Consumer Affairs, Health and Family Welfare, and Mines Ministries amongst others, have suggested that fees charged under the RTI Act be increased in case the information sought covers large periods of time and is not in a format as maintained by the offices. Concerned over the growing 'misuse' of the transparency law, public sector undertakings (PSUs) - Bharat Heavy Electricals Limited (BHEL) and DMRC - have called for putting up adequate safeguards in this regard. Some other offices have expressed concern over their lack of proper infrastructure in catering to timely disbursal of information. National Buildings Construction Corporation Limited (NBCC), which is under the Urban Development Ministry, has suggested that the RTI Act also bring within its ambit the private sector, in failure of which PSUs should also be granted exemption from complying with the Act.     I-T dept seeks exemption of RTI Act

    NEW DELHI: The income-tax department has asked the department of personnel and training to amend the Right to Information (RTI) Act to shield itself from unsolicited queries on its investigations. The RTI Act has exempted the department of revenue intelligence, Intelligence Bureau, Central Excise Intelligence Bureau and the Enforcement Directorate, which are in the Schedule-II of the Act. The Central Board of Direct Taxes has written to the department of personnel and training that its investigation wing should also be exempted as its nature of work was similar to these agencies, a government source said. “Most of these agencies exchange information with the income-tax department, which could be very sensitive in nature. Since these agencies have been exempted from the purview of the RTI Act, it is logical the income-tax department’s investigation wing should also be exempted,” he said. The investigation mainly involves search operations to nab tax evaders. These searches, and any other investigation activity, usually involves department’s trusted network of informers, whose information is crucial to cases. These informers could get into trouble if exposed under the RTI Act and could be harassed by the affected parties, the source said. Recently, the Central Information Commission had turned down an appeal by First Global’s Shankar Sharma seeking details of investigations carried out by the income-tax department. The department had raided the stock broker’s premises in 2001 after the Tehelka sting. Though the department draws comfort from the decision, it wants to prevent anyone filing an application under the RTI Act to find out details about its investigations. RTI: Education dept seeks refuge in ‘secret’ clause Chandigarh, December 17 In What can be called a mockery of the Right to Information Act, the UT Administration’s Education department has denied routine information to a local resident citing its secret nature. While the Education department has denied information to the applicant, it has allowed him to inspect the “secret” documents on any working day. Jagdish, a resident of Sector 22, Chandigarh, asked for information about the criterion adopted by the Education department to select yoga instructors. The UT Administration had recently advertised the post. Jagdish’s daughter had applied for this post. Though she had the highest marks in graduation and other requisite courses for the post, she could not get through. Her father, Jagdish, filed an application under the RTI Act. These were the questions he put to the Education department 1. What was the selection criterion for the post of yoga instructor? 2. Supply the details of marks obtained by me under different heads of the criterion 3. Kindly supply the marks obtained by the following candidates under different sub-heads of the criterion 4. Please supply me the marks obtained by other candidates in graduation and yoga instructor 5. Kindly supply how many candidates applied in OBC category and how many candidates have been selected in that category In its reply, the Education department submitted, “As the information sought by you is of a secret nature, the copies of the same cannot be supplied. However, you can inspect the documents on any working day”. The reply does not even mention the section and sub-section of the RTI Act under which the information is denied. The reply gives no legal explanation as to how the information regarding selection criterion is termed secret. “The selection criterion has to be given in advance even before the posts are advertised. They have denied me the information yet allowed me to inspect it so that I can use their documents in any court. Such misconduct certainly smells foul.     SIC seeks proactive disclosure

    THIRUVANANTHAPURAM: The State Information Commission (SIC) has urged the government to instruct public authorities, as defined under the Right to Information (RTI) Act, to go in for proactive disclosure of information relating to them. In its annual report to the government, the commission points out that even though proactive disclosure is mandatory under the Act, many public authorities are not doing so. Such disclosure, the commission feels, would reduce the number of requests for information. Keeping in view the cost and time elements involved in publishing and updating information through the print media, it is advisable to immediately publish the information on the official web sites of the government and the organisations concerned. Organisations can be encouraged to develop their own web sites and provide information through them. Funds available under e-governance may be profitably utilised for the purpose, the report says. Call to publish lists The commission also recommends publication of lists of public authorities under each administrative department in order to remove any ambiguity in the matter. Under the RTI Act, public authorities include institutions and non-governmental organisations which are controlled or are substantially financed by the government. However, some institutions such as cooperative banks, aided schools and colleges, management of religious institutions and places of worship, libraries, etc., which are either controlled or are substantially financed by the government, are under the impression that the provisions of the RTI Act are not applicable to them, the commission says. It reminds the government that though many public authorities have designated assistant public information officers, public information officers and appellate authorities, some are yet to do so. This is especially so in the case of non-governmental organisations substantially financed by the government such as private aided colleges and schools and cooperatives. The commission recommends designation of more than one public information officer in major offices such as corporations and municipalities, Directorate of Health Services, Directorate of Education, Directorate of Public Instruction, Police Department, etc. to receive and dispose of requests under the RTI Act. New Delhi: On the basis of the information obtained under the RTI Act, a special court in Indore, directed state government to register a case of corruption, forgery and cheating against MP DGP. The information provided three months ago, led to a complaint alleging that Ex. DGP had filed a false certificate in order to obtain admission for his son in 2001, under 'NRI-sponsored quota' in an engineering college of MP. It led to a series of events, forcing government to take action against the DGP. June 9: On an RTI application filed by a journalist, the public information officer of Govindram Sakseria Institute of Technology and Schiece, registrar Mahipal Singh, said that a police officer's son, was given admission in 2001 under NRI-sponsored quota and, accordingly, he paid fees of $16,500 or its equivalent in rupees in five years.
