  1. Greetings comrades, i had made an rti to trai for providing me with my own incoming and missed call and message history from private cellular service provider Airtel. I am in an impression that if airtel has already refused my multiple requests to provide same information then trai will be a good option for me to obtain this info. So I sent rti application to TRAI office in Delhi. TRAI then transferred my application to ministry of telecommunications in Delhi, and ministry then transferred it to local state PIO in Gujarat. PIO HAS REPLIED IN THESE EXACT WORDS - " the requested information is not available with this office under section 2(f) of rti act 2005." I WOULD LIKE TO MAKE A FIRST APPEAL IN ORDER TO PURSUE TRAI TO GET MY ACCOUNT INFORMATION FROM AIRTEL AS REQUESTED. Please help me to frame a counter argument that can get me a strong case. Also, requesting to provide me with sample first appeal sentences in my case if possible. Many thanks and stay blessed! vandan

After repeated protests by the public against the telecom towers coming up in their neighbourhood without seeking their consent, the State government has finally prepared a draft byelaw as part of its telecom policy. In response to a two-year-old RTI application, BBMP came out with information that the government had prepared a draft byelaw for telecom towers, optical fibre cables and installation of other basic infrastructure.   4. Hello sir, GREETINGS To start with,a number of years back, a huge bunch of wires consisting mostly telecommunications cable belonging to Army was placed in front of my residence. Initially is was not so much of a bother, but now with new construction happening around, It has really become a daily bother while driving in and out of my residence. I have posted many letters to post & telegraph, maintenance section regarding the same but without success. I would be very much obliged if someone briefs me as to how to frame RTI to Indian army here in our state and to whom should I addressed my application. Thank You. Karson.

  6. Hi, I'm a reliance gsm user from last 5 years. 2 years back I'm shifted to Bhubaneshwar and the problem starts here. My mobile number XXXXXXXXXX is a pre paid number, which automatically get converted in post paid on 1st Sepetember 2012. When I called in customer care and asked them the reason they put my phone on hold for 15 minuted and then cut the phone. On 6th Sep 2012 I got a message asking the Bill Amount of RS.850 to pay as soon as possible. It is very common in Reliance that paid services get activated, and when you call in Customer care then they deactivate the service but you will lose your money for a month. But It's very new thing that a prepaid number is get converted in a postpaid number. I want a final solution. I want to know what I can do at my level? Dear All , i have one simple query , where i can apply for RTI to know if Telecom company like airtel , reliance Activate their Default caller tune on customer mobile no. without confirmation of customer . as now day Reliance company has Activated their default 3G caller tune , and when i asked them to de-activate same , they raised their hands . . .
  9. Hi all, First of all i would like to thank you all members and seniors for guiding me/us with such great dedication. By searching over google, I found thousands of complaints related to Telecom Operators, Broadband Internet Service Providers etc. This is where most of people know nothing about how to move forward using RTI. I found many websites where innocent people keep posting their complaints several times with all their emotions and seeking for reply, but what... its just a complaint site, running for ads revenue. There is nobody to reply. I myself used RTI against BSNL and solved my issue several times. Yes, I know RTI is for getting information (From Govt Body) and not for Complaints. But i do know that we can launch our complaint to concerned Govt Body and then can follow up filing RTI (by asking complaint status) These private companies are here for making money/profits only, Nobody cares for customers. So i hereby request all the senior members to create one post with all the details step by step including sample complaint letters & RTI applications, specially to solve Telecom/Broadband related issues. I know many posts are there, but even i was unable to understand few things as it was posted by several other senior members. I saw This success story, Which was solved by RTI then why not others.. Af far as i know, You first need to contact Customer Care, then Nodal officer, then Appellate Authority then TRAI & DOT, in addition we can file case at Consumer Forum. Now i have few questions...Pls reply. 1. I know the best way is to send your complaint/RTI application via Registered post, I would like to know if Email or Fax is equal to Hard copy complaint or RTI application OR filing complaint (with a xerox copy) and getting RECEIVED stamp on it is better? We get delivery receipt in FAX, is it valid ? Nobody responds to email, I heard that Emails can be presented as evidence, is it ? 2. Can we file RTI application to Nodal Officer asking the status of our complaint registered at Customer Care ? 3. Nodal Officer (of such private company) are covered under RTI rules ? If not, then who is this Nodal officer, what is the difference between customer care and nodal officer ? 4. Can we file RTI to Appellate Authority ? If not, then who is this Appellate authority, is he a Govt servant ? 5. What is the email address of TRAI. What is the better way to send our complaint to TRAI (email or fax or registered post, email or fax is easy and less time consuming), Will i get any complaint/Docket number from there ? 6. What is the email address of DOT, Will i get any complaint/Docket number from there ? 7. Where i can find Consumer Forum in my city (Ahmedabad), any link ? 8. I know this is off topic question, but is there any procedure to follow while filing complaint at Consumer Forum, any guidelines? What if i cant afford a Lawyer ? Any link or document explaining the whole process to win the case in layman's language ? I know some questions are out of RTI subject but if answered will help us for lifetime. Afterall RTI is the only weapon with us. What i learnt from this forum is ...Proper Documents is the only thing we need to make case via consumer forum. Almost every day we get cheated by somebody like this, Nobody has that much free time to fight such cases in consumer forum or Court. One gets satisfaction if their problem/complaint gets solved, no matter if the information/questions asked by RTI is received or not. Overall this is the basic funda of RTI. You get the solution OR Answer in written (which is the evidence). I hereby request again to all senior members to Make a seperate post specially for Telecom/Broadband operators based complaints. Which includes all the details/procedure step by step with all the contact information to various concerned Govt bodies, including sample complaint letter & sample RTI application in 1 post only. All seekers will get the full information at 1 spot only. This will help everybody. Thanks to all team members of RTIINDIA.ORG for their great support. I am currently fighting/seeking/struggling with Reliance Appellate Authority, waiting for his reply.

Information is requested about rules and regulations regarding operation / commissioning of telecom towers on rooftop of private row house having common wall / continous roof as well as for installation and operation of large DG sets on roof tops. Also information is requested for any precedents regarding removal of such functional towers from residential rooftops in Uttar Pradesh. Whom to contact and what to do?? Thanks and regards Sanjay
  11. As reported by Himanshi Dhawan at timesofindia.indiatimes.com on Nov 15, 2010 NEW DELHI: The department of telecom is playing coy about the 2G spectrum case in Supreme Court. Faced with an RTI petition about the embarrassing case, it batted aside the query taking shelter behind technicalities, and passed the buck to the PMO. On the flip side, the PMO replied — with uncharacteristic promptness — within hours to the very same query stating clearly that PM and his office were aware of the matter relating to allotment of 2G spectrum before the SC. RTI activist S C Agrawal had asked DoT if PM or PMO was aware of the 2G spectrum case, the names of the parties in court, whether Union minister A Raja was party to the case in his official or personal capacity and whether advocates representing him were being paid for by the minister or by a public authority. In a reply dated November 9, the telecom ministry's CPIO R K Gupta said, "It is observed that no specific court case has been mentioned for which the information has been sought." Using the plea that the information sought pertained to the PMO, Gupta said "information can be provided by this office only after the information furnished by PMO". Significantly, PMO in its reply dated the same day said, "The PM/PMO are aware that the matter relating to allotment of 2G spectrum is before the SC." The response from telecom department comes at a time when a CAG report submitted recently estimated that the public exchequer incurred a revenue loss of Rs 1.76 lakh crore.
  12. Monday, March 19, 2007 By Sam McBride The Northern Ireland Office has been ordered to respond to a Belfast Telegraph Freedom of Information (FOI) request made more than six months ago. A judgment by the Information Commissioner has given the NIO 35 days to provide a response and warned that failure to comply with its decision may lead to High Court action. The request, for details of official entertainment by Secretary of State Peter Hain, was made on August 22, 2006. The Commissioner's decision notice states that, as well as not answering the initial request, Mr Hain's department twice failed to answer written communications from the Information Commissioner in January. The legal document states: "The Commissioner wrote to the NIO on January 30, advising that he had received further complaints from this complainant regarding unanswered requests made to the NIO. "The Commissioner again asked the NIO when it would respond to the complainant's outstanding request. No response was received." In October, the NIO said the request had not been received and asked for it to be resubmitted. It later claimed the request in August may have been identified as junk email. But the Commissioner's judgment notes: "This does not account for the fact that the complainant did send other emails to the NIO email address which were received." The order, signed by Assistant Information Commissioner for Northern Ireland Marie Anderson, concludes the NIO has not supplied the information or a refusal notice and has therefore failed to comply with the law. Last month, the Information Commissioner said that, following several failures in handling FOI requests, the NIO's compliance would be monitored. Dec. 29: The email lying on the desk of the information commissioner isn’t the classical hate message, but its sender has no love lost for the Central Information Commission. “You won’t get away with this,” reads a line in the anonymous message. The information commissioner the email is addressed to dismisses it as an “empty threat”, but concern is writ large on his face. It’s not the first case, after all. Central information commissioners have been at the receiving end of several “personal slanders” — from “empty threats” to allegations of “motivated judgments — in the past two months. “While most mails are anonymous, some government officials have been brazen enough to reveal their identities,” says a joint secretary at commission. Initially, some information commissioners laughed it off. “It’s ugly, but you have to shrug it off. After all, they are bureaucrats, not goondas (thugs) and it didn’t seem a major cause for concern,” said an information commissioner who received two mails where the sender identified himself. But now, there are worries. The increasing frequency of such mails has led chief information commissioner Wajahat Habibullah to consider legal action against those who have named themselves. “The slanders are shocking and unacceptable,” he says. Officials at the commission see the mails as intimidating, intended to scare commissioners into giving more lenient judgments against them in the future. “In the larger picture, intimidating us will help all those in the bureaucracy with skeletons to hide,” said commissioner Om Prakash Kejriwal. Those who have identified themselves include registrars of two central universities. They have accused an information commissioner of “personal enmities”. Both registrars had been sent notices from the information commission after they violated the time frame within which they were supposed to respond with information sought by appellants under the Right to Information Act. “I’ve never met the two officials who accuse me of personal vendetta,” the commissioner facing the accusation said. To deal with the mails, including those that come with “threats”, the chief commissioner is seeking help from the National Informatics Centre, which handles software facilities for most central government officials. The centre has asked IBM — about to provide new hardware for the information panel’s computing facilities — to ensure that products are compatible with software to help track email senders.
