Sir, commission direct us for explain the reasons on following in the shape of affidavit 1) how sec 8(1)(g) invoked 2) why information not supplied within stipulate period, Please let me know the sample of affidavit tender before the commission because I have.no idea to make affidavit. Briefy detail:- Sir I.invoked a section 8(1)(g) on inspection of selection committee and screening committee file as it contains the names and identity of subject experts and evaluators which may lead to physical danger of life. And the delay of 20 days for supplied the information. Please give me or tell me th wording I.used for commission. Very thamkful

PATNA: The irony could not have been more pronounced: When this newspaper asked Bihar State Milk Cooperative Federation Ltd (Comfed) MD Harjot Kaur why milk was being sold @ Rs 33 to 43/litre in Bihar and Rs 25/litre to a private dairy at Joya in Moradabad, she banged the phone. When the report got into print on May 29, the MD of Vaishal-Pataliputra Milk Union (VPMU) - one of the milk unions under the cooperative - presumably took it upon himself to deny the report, of which VPMU is only a small part. 'Presumably' because the denial is on plain paper, not on letter head, and the signature is also illegible. It does not have even a letter number. The gist of the three-page denial, which has used terms like 'baseless', 'misleading' and their synonyms at least 36 times, is that the TOI report is bunkum. Kaur, on her part, held a press conference to trash the TOI story. This newspaper was not invited to the presser. We exercised our RTI (right to information) to know who is misleading whom. And according to documents procured under the RTI Act, the state animal husbandry and fisheries department received complaints earlier this year, alleging milk unions under Comfed were sending lakhs of litres of milk to private dairies in Delhi and Moradabad for processing the same as powder. Thus, the milk powder plants, opened by the Bihar government investing crores from the state exchequer, are not being utilized. This causes losses worth crores to the state every month, the complaints alleged and added one private party was selected in violation of tender rules. Cops have recovered RTI documents from a training camp of the People's Liberation Front of India, once a faction of the CPI(Maoist), in Torpa forests, which have details of 30-odd government projects under Khunti district rural development agency, with names of contractors and estimated costs. "The Maoists use RTI documents as proof of a contractor's worth and then extort the 'due amount' from them," said Khunti SP M Tamil Vanan, who made the last such seizure on September 8. They usually demand between 10% to 30% of profit margins, said the police adding that they have resorted to such tactics in the past as well. "In the last two years, I have come across four such RTI documents with Maoists and their sympathisers," said Vanan. Last month, the rebels had beheaded some contractors in Gumla when they refused to pay. "RTI applications from rural areas revolve mostly around government tenders. Applicants want to know who has been awarded tenders and what is the cost of the tender?" said Jharkhand's chief information commissioner D K Sinha. The government is bound by laws to provide such information, he added. Documents recovered from an insurgent camp revealed how the rebels have organized themselves, said the police, adding that they maintain records of their targets. The information is segregated according to zones, sub-zones and areas, and the Maoists deploy armed cadres for collection of levy. "They must have deployed some white collar supporters to file RTI in this particular case (in Khunti). I will get it investigated," said Ranchi zone IG M S Bhatia. Bokaro IG M L Meena said misuse of RTI by Maoists could be happening. Police occasionally come across documents with details of contractors and their targets at rebel camps, he said. Latehar SP Michael S Raj was also not surprised to learn about the RTI route taken by Maoists. "In the past too we've recovered similar documents," said Raj.

Most of the times the attendants at DELHI METRO RAIL CORPORATION parking sites fleece the motorists and charge the higher rate of parking fees even if there is a negligible delay of say 5-10 minutes, to extract this additional amount at times they get into arguments or even foul language with the parking users. At times paper coupons(slips) are issued by the parking attendant in place of using the computerized hand held machines to issue parking slips. Apparently this additional amount collected above the value of coupon issued is pocketed by these parking attendants. I had requested that the following information from DMRC, New Delhi under the provisions of Right to Information Act 2005: i. Please provide details of the process of awarding parking contracts at DMRC stations ie. Tender and bidding process etc. ii. Whether these contracts are assigned on one time payment basis to the highest bidder at the time of award of the contract or on the basis of revenue sharing as an ongoing process. Please provide details thereof. iii. Please give specific details of amount/revenue received, for which the contract has been awarded in respect of the 95 DMRC stations as per the list enclosed. Giving the periodicity ie. Annual/Quarterly/Monthly/Revenue Sharing. iv. If the contracts have been awarded on revenue sharing basis what measures are adopted by DMRC to keep a check on the amount of revenue collected by the parking contractors at the respective metro stations. Please provide details thereof. v. Whether any uniform or identity cards have been issued to the attendants manning the DMRC parking sites and whether it is mandatory for them to wear them. vi. Whether it is mandatory for the parking contractor at DMRC parking sites to use computerized hand held machines to issue parking slips. Please provide specific details. vii. Whether it is mandatory for the parking contractor to issue a receipt to the motorist for parking fees collected at the time of exit from the DMRC parking. viii. Please provide details of measures are adopted by the DMRC to ensure that the parking contractors do not park vehicles more than the allowed number at spaces earmarked to them. ix. Please provide details of surprise checks, if any conducted during the last five years at the DMRC parking lots across the city to ensure whether their directions are being implemented by the parking contractors or not. x. Whether the contract details along with the MoU between DMRC and the parking contractors have been provided on the Web site of Delhi Metro under the provisions of Section 4 of Right to Information Act 2005. Please give details thereof. And if not details of persons responsible for willfully not allowing this information in public domain. xi. Please give details of free medical aid, drinking water and toilet facilities being provided at these 95 metro stations. Strange are the ways that these Public Information Officers adopt to hide the wrong doings of their departments. The reply that I got from DMRC in response to my above queries goes as under : Kindly refer to your application seeking information under the RTI Act, 2005 received by PIO 2 cell on 29/08/2011. The information sought by you is voluminous in nature. Therefore, DGM/Civil & Structure who is the deemed PIO as defined under Sections 5(4) & 5(5) of the RTI Act, has informed that you may inspect the available records on 10.10.2011 between 15.00 hrs and 17.00 hrs in Metro Bhawan, New Delhi. May I request the members on this forum to help me in how to proceed further : i. I am not able to make it out that how can simply the information requested for (without copies of documents requested for) be voluminous in nature. ii. Is it mandatory for me to appear before the deemed PIO for a physical look at the information. Simply looking at the information may not help as answer to many questions need to be given by DMRC only. iii. Can I appeal to the Appellant Authority against this requesting for the information to be provided in written form.
  5. My company was a participant in a public tender floated by a state owned agency. The criteria was set very high, as a result of which we had to tie up with a foreign company to meet the criteria (adding to cost). There were 5 participants. In the tender, the state agency had set a "technical evaluation criteria" for which points (total 100) would be given to all bidders and minimum 70 required in order to qualify (technically). All 5 bidders were informed they were technically qualified - which is surprising because 2 bidders (from the knowledge I have as competitor) do not meet the criteria. Lo and behold, the state agency opened the commercial bids of the 5 bidders and the two bidders who I feel do not qualify were no. 1 and 2. I need someone to draft an RTI enquiry to see how the bids were technically evaluated. Of course, I will provide all the information and assistance to the consutant. I need a consutant and am willing to pay for this service since I need to get this done correctly and I don't have the experience. its in teh city of Ahmedabad where I am based but the consultant can be anywhere in India.

    As reported by Ashish Sharma in buisness-standard.com on 19 November 2009: Info commission raps RCF Info commission raps RCF The tender approving process in the government sector is bound to become more transparent and subject to public scrutiny after Central Information Commission (CIC) has passed an order in a case related to the Rail Coach Factory (RCF), Kapurthala that the information about the minutes of the tender committee, performance report and technical scrutiny notes should be furnished under the RTI Act. Applicant Bankey Bihari Sonthalia had sought access to the decision making process and the documents relied upon to take a final decision for procurement of certain material. He had specifically asked for minutes of the tender committee, performance report, technical scrutiny notes etc. However, he was denied information by the Public Information Officer of RCF on the ground that the information asked for, related to commercial confidence and its disclosure “would harm the competitive position of the third party”. In his appeal before the CIC he pleaded that he had only asked for the minutes of the tender committee and other documents on the basis of which procurement-related decision were taken by the authorities and he had not asked for the documents submitted by the third party. In its decision the CIC held that a citizen had the right to observe and scrutinise the decision making process by the public authority, particularly after action was complete. It held that there was no justification for withholding the information relating to finalisation of awards of tenders, bids which followed an established procedure.

Hi!Myself a flagholder for more than 35 years for Bihar State Electricity Board, Patna under Govt. of Bihar.I am doing Pole manufacturing works, civil and allied works for BSEB, Patna and 30 days back got a major setback from its some corrupt officials. I have been carrying out Pole manufacturing work for BSEB from 1990 and most experienced contractor so far. I have started such work for BSEB for the first time in Patna then Muzaffarpur and now in Madhopur Pole Unit, Motihari, Bihar. In a very recent tender in which they awarded the work to a contractor whose earnest deposit has once been forfieted by BSEB iself only on the pretext of his recommendation by an MLA. He has been permitted to change some of his tender papers even after submitting his papers and rates. His rate is not below my quoted rate, neither he has any prior experience of such work and he is also not a native to the place of work where I have been carrying it our from 1990(18yrs). His only qualification is that he has been recommended for the work by an MLA duly endorsed by a Member of BSEB, Patna. I have very strong objection to it and like to get your kind help. I am seeking only justice and anticipating cooperation from you all so that I may able to eradicate the rampant corruption with nexus of politicians. Pl extend your help!
  9. HYDERABAD: Information Commissioner under the Right to Information (RTI) Act R. Dileep Reddy on Wednesday said that the information on the process of tender evaluation must necessarily be in public domain. Mr. Reddy made this assertion in reference to information sought by S. Basu of Sumeru (India) Pvt Ltd of Kolkata from the public information officer (PIO) of the Singareni Collieries Company Ltd (SCCL), Kothagudem. Mr. Basu sought to know the details of minutes of tender committee meeting; copy of the visit report of the SCCL to Neyveli Lignite Corporation Ltd to inspect Promtractor Dozer/pipe layer/ and or any other equipment; names of officials with whom the SCCL team discussed at Neyveli and the date of opening of the price bid of different parties. The PIO and the appellate authority denied the information invoking Section 8 (1) (e) of the RTI Act, 2005. After hearing both sides, the Information Commission of the State upheld Mr. Basu's contention and felt that the public had a right to seek the information as it involved huge amounts and the aforesaid Section could not be invoked in this case.   10. Hi all, I had applied under RTI to a central government authority for details of a contract they have executed with a private software company. I was only interested in the commercial and contractual terms, and not any technical information. However, the authority has denied to me a copy of the contract using clause 8(d) of the RTI, which relates to protecting third party confidentiality. What would be the best way to frame my query in reply so that I get the contractual/commercial terms of the contract and the method with which it was awarded without falling into clause 8 (d)? Note that I am not interested in the software specifications or any intellectual property details? Look forward to any assistance. thanks in advance.
