  1. My flat owner (Gurgaon) is pressurizing me to pay rent completely in cash, with strict deadlines else we has warned to lock up the flat. He has refused to accept any cheque /only transactions. He has also put up a notice at the building entrance for the same. I am pretty sure he has a lot of black money too and now is finding out new way to save rather escape taxes. Can someone help me or redirect me on how to complain against such threats.

GAYA: Gaya DM Sanjay Agrawal has taken serious note of the reported threat to RTI activist and 'Save Falgu' campaigner Brajnandan Pathak and asked the SSP and SDO (sadar) to inquire into the matter and take follow-up action to bring the guilty to book. Forwarding the RTI activist's complaint to the SSP and SDO, the DM has asked them to take the matter with due seriousness. Pathak, a petitioner in the PIL filed in the Patna high court to make the Falgu encroachment and pollution free, has complained that he was receiving threats from the encroachers.   7. It seems cases of suicide and fratricide are posing a bigger threat to the security forces than militants in the country. According to the latest statistics, more security personnel have died in such incidents than in militant attacks since January this year. In response to an RTI filed by Jammu Kashmir Coalition of Civil Societies, a non-governmental organisation, 24 jawans have killed themselves either by suicide or fratricide as compared to 15 killed in encounters with the terrorists across J&K. The security establishment is finding it hard to tackle this menace despite several measures to reduce incidents of suicide and fratricide. As the Valley is heading for normalcy and peace, strategists find the trend alarming.   8. Dear Sir/ Madam, I recently resigned from a firm. During my tenure at the firm, our salaries did not ever come on time (delayed by 15 to 20 days). After my resignation in february end, our salaries(pending) were again delayed by 16 days due to which my credit card bill was over due and interest was charged. Further, our reimbursements have been pending for over 4 months now. When I sent an email explaining my situation, one of the directors blackmailed me (mail withheld) and said that if I didn't apologize in 24 hours, he would put my pictures in the newspapers announcing that I have done bad things at the office and that I'm not worth employing. I have my salary account statements for proof of late salaries and the blackmail email that the director sent me as proof of blackmail and threatening. Kindly advise how I may proceed to take action against this firm. I need to take action against them at the earliest.
  9. Any bureaucrats on this forum? What practical difficulties do/have you faced or anticipate to face because of RTI? Has it increased work load? Has it caused diversion of effort from ongoing tasks/projects? Has it created any illwill? Has it brought out lacunae in administrative practices/procedures? Has it led to more orderly maintenance of records and artifacts? Has it led to more diligence in day-to-day work? Has proper training been provided to concerned officials on RTI? Has apropriate traing been provided for the staff in general? What has been the focus of this training? Did such training motivate people in the right direction? What steps were taken to sustain this motivation? Has any feedback on RTI provisions or new tasks it has created been taken? Has there been any counseling? Is there any real reluctance on account of RTI among staff? Is there any inertia? Is there any open or veiled attempt at subverting RTI which could be attributed to something other than inertia? Is there defensiveness in the face of RTI? Is there a general perceived threat? Thanks Mumbai Civic

However, the duo claimed to have received threatening calls, from unknown persons. The callers even threatened to kidnap their sons, if they did not withdraw the request for information from the authorities, the duo alleged. Gajjar reportedly received a threat call on Thursday evening. The two have now lodged a complaint with the 'B' Division Police Station, which has registered a complaint under sections 506(2) and 507 of the Indian Penal Code (IPC). No arrests have been made so far, though. Joshi, who is also the president of the NGO said, "We had demanded detailed information about 116 primary schools in the city, from the district primary education office, under the RTI Act. Nearly 98 schools failed to furnish their details." Joshi said, after a month long delay, he wrote a letter to the appealing authority, asking them to impose a fine of Rs 250 per day on the schools that had not furnished the details. He added that they had appeared before the office of the appealing authority to get all the details on March 13. However, the officials said that complete information could not be provided on the issue, as some of the schools were busy in the conduct of the exams. Even as the duo awaited details on the issue, Gajjar received threatening calls from a cell phone number, 9974036296. "We are fighting in the larger interests of the students, but we have received threats. These calls are being made, because schools are not being managed in accordance with government norms. Corruption is rampant in our education system," said Gajjar.

    Public's right to know under threat

    Suppression of court verdicts for lengthy periods; inordinate delays in Freedom of Information (FoI) requests, FoI chases abandoned because of spiralling costs, and journalists dragged through the courts for not revealing sources. These are some of the failings Irene Moss confronted in her audit of the state of free speech in Australia, commissioned by a collection of media groups acting under the banner of Australia's Right to Know Coalition. The former New South Wales ombudsman stopped short of calling it a crisis, but her report, released this week, paints a less than rosy picture. Take the case of Melbourne newspaper the Herald Sun, which had to abandon a two-year FoI campaign about federal politicians' travel, after being quoted a fee of A$1.25 million ($1.5 million) for the information. Or the trial and subsequent contempt of court convictions for journalists Michael Harvey and Gerard McManus, who refused to name a source behind a leaked story about a federal government proposal to slash war veterans' benefits. The Herald Sun journalists were fined A$7000 for their troubles. Then there is the federal government's refusal to give access to an opinion poll on the success of the federal government's A$32 million WorkChoices advertising campaign - at least until after the election. Restricted, flawed, hindered by secrecy and mistrust are just a smattering of terms Moss used. "The audit would broadly conclude that free speech and media freedom are being whittled away by gradual and sometimes almost imperceptible degrees," she said at the launch of her report in Sydney. "Many of the mechanisms vital to a well-functioning democracy are beginning to wear thin." The audit found 500 pieces of legislation and at least 1000 court suppression orders restricting media reporting in Australia, are still in force. There are 365 Acts of Parliament at both federal and state levels, with specific secrecy provisions blocking public access to information. They include the Commonwealth's Anti-Money Laundering and Counter-Terrorism Financing Act, the Australian Security Intelligence Organisation Act and, surprisingly, the NSW Gaming Machines Act, the Commonwealth Wool Legislation Act and Victorian Grain Marketing Act. Laws protecting journalists were also inadequate, while the flow of information from the court system was "found wanting", stifled by a raft of suppression orders, she said. One example cited in the report concerned Melbourne gangster Carl Williams, who is appealing a life sentence handed down early this year for the murder of crime patriarch Lewis Moran, his son Jason Moran and gangland identity Mark Mallia. According to the report, when Williams was convicted for another murder in November 2005, that of drug world identity Michael Marshall, the verdict was suppressed for two years because he was facing other charges. "Even though Williams faced later charges (including murder), the passing of time, together with the huge public interest in reporting his result, meant the suppression order should not have been made," the report said. Moss, who is also a former chairwoman of NSW watchdog the Independent Commission Against Corruption (ICAC), bemoaned the "growing culture of secrecy, defensiveness and mutual distrust" shown by governments and the courts. "The greatest loss in this battle is not to the media but to the Australian people and their right to know about important matters that affect them," she said. Also speaking at the launch, media company Fairfax's chief executive David Kirk called on the federal government to match a Labor promise to improve free speech provisions if elected. Two weeks ago, Opposition Leader Kevin Rudd pledged to review FoI, journalistic privilege, whistleblower protection and privacy laws. Kirk said he could not think of a better moment for "some me-too policies from the coalition". "I think it is incumbent on the prime minister and the attorney general to be fully responsive to the issues presented in the Moss report," he said. "It is a great opportunity to lock in these reforms now, on a fully bipartisan basis, before the campaign is over." Prime Minister John Howard has promised an announcement on FoI reforms during the election campaign, and Attorney-General Philip Ruddock said he would look at the Moss report "very closely". "I have the utmost respect for Irene Moss," Ruddock said. "Her ideas, I might not agree with all of them, but they are worthy of looking at and they will see proper consideration." However, Howard has already dampened expectations, saying any changes were unlikely to satisfy the media. Cameron Murphy from the NSW Council for Civil Liberties said the issues raised by the Moss report echoed his organisation's experiences, particularly with FoI requests. "We've put in hundreds of freedom of information requests to try to identify what the Australian Federal Police have done in relation to Australians who are facing the death penalty overseas ... and we simply can't get information out of them," Murphy said. "They cite operational reasons and other reasons which are nothing more than dubious excuses to hide embarrassing information." Murphy said action was needed to reform the system, rather than further reviews. "What we need is action, and what we need is a plan from the coalition that details what they're going to do to fix it," he said.
