CHENNAI: A public works department (PWD) official, G Parthiban, has threatened an RTI activist who in a plea had sought information about the public servant. The activist A B Saravana Babu, a lawyer in the Madras high court, recorded the abusive conversation and lodged a complaint at the high court police station. Hello, A few days back I had posted in the forum the threatening letter by the CPIO to the applicant.The complaint of which was registered with CIC. The threats of the CPIO is still continuing and breaking all the limits when he has written to the sp of the area to threat the applicant. Can some body suggest me a course to be taken now as the CPIO is rattled with the RTI application and the probable corruption coming to surface .
Attached is an order by IC Yusufi in the CIC wherein he has stated that the CPIO threatened him. The full order is attached. It simply means that after several years of complaining from RTI appellants, even CXPIOs are fed up and frustrated by the ICs in the CIC ! 2. At the outset, it is stated here that Dr. Ajitesh Radhakrishnan, Deputy Commissioner (Imports) & CPIO, appeared before the Commission without any case record. On being queried by the Commission, as to whether in the absence of the relevant records, how will you defend your case? On this very aspect, it is pointed out by Dr. Ajitesh, CPIO, that there is no necessity tobring the relevant record of the case, at all, everything are on my finger tips. Further, when Commission allowed him to proceed with the case. He started the arguments very aggressively and with a very rough & high tone which is not expected, at all, from the level of Dy. Commissioner of the department concerned. Dr. Ajitesh went on arguing the case illogically and on irrelevant issues. He was again requested by the Commission either argue the case on relevant issues only or file written submissions, in the matter. However, he failed to accede the Hon’ble Commissioner’s request in this regard and went on arguing the case at his whims and fancies, which is totally unwanted and uncalled for, from such officers of the level of Dr. Ajitesh Radhakrishnan, CPIO. However, later on, he submitted a written submissions dated 31.07.2014, in the case. . . . . 3. However, he has taken the plea of Section 8(1) (h) of the RTI Act 2005 while making oral submissions before the Commission. Furthermore, when he was again asked to justify his plea taken under section 8(1) (h) of the RTI Act 2005. On this very aspect, he replied very rudely in negative, in this regard. Not only this, he also kept mum, when he was further asked by the Commission, to give the details of appellant’s RTI application, FAA’s order etc. Dr. Ajitesh Radhakrishnan, CPIO also miserably failed to highlight the details of the investigation i.e. the date of starting, present status and the time period by which the investigation would be concluded. . . . . 4. Apart from above, Dr. Ajitesh Radhakrishnan, CPIO also started to issue a number of threats to the Hon’ble Commissioner (undersigned), such as, to make a complaint before the Chief Information Commissioner, today itself and even to lodge an FIR with the Police Station concerned, in case Hon’ble Commissioner fails to give its decision in accordance with his dictum, in the matter. However, later on, a good sense prevailed upon Dr. Ajitesh Radhakrishnan, and he submitted his unconditional apology dated 31.07.2014, before the Hon’ble Commission. Reliable sources revealed that "on Tuesday afternoon, the wife of a Minister made a call from her mobile number at the residence of the RTI activists and inquired about him. She wished to talk to him but the family members informed the woman that he is not at home." "Following this," sources further revealed, "the lady again during the late afternoon hours made a call and inquired if the activist had returned home or not. She was again replied not yet. When the family members of the activist asked that who is on the other end why she wanted to talk to the person in question, she immediately claimed to be wife of a Minister and wanted to know from activist why he is interested in gathering information against the department, which is headed by none other than her husband." "The family members cleared to her that their family head (RTI activist) is a known social worker and is fighting against corruption through Public Interest Litigations (PILs) and whatever decision he takes that are his own independent decisions and he does not involve family members in those issues," shared reliable sources further adding that "wife of the Minister immediately tried to influence the family members pointing out that Ministers are quite powerful and one should rather remain friendly with them instead of waging a war against them." "Later, during late evening hours, few persons in an inebriated condition visited the house of RTI activist and threatened the family members of dire consequences, if he moved further inquiring/seeking information under RTI Act," sources further disclosed. "Following pressure tactics and indirect threat by the wife of Minister and direct threats by some alleged goons believed to be the supporters of the Minister in question, the family members immediately called him up and narrated the entire conversation with a lady claiming to be a wife of a Minister. The activist without wasting time, in a written statement, informed the senior police officers and asked for thorough investigation into the matter," sources further shared and added "he also approached to his legal counsel who has suggested to file a written complaint before the Registrar Judicial, Jammu and Kashmir High Court, Jammu wing, so that when the PIL comes up for next hearing, it shall be prayed before the hon'ble Judges to discuss the said sensitive issue as well."
