    Information denied under 8(1)(d)

    I had sought details of loan and copies of agreement entered with World Bank, JICA etc. of IT Expressway Chennai (created in partnership with Govt of TN) However the PIO has replied that they have moved out of world bank loan and taken loan from other banks details of which cannot be disclosed under 8(1) d of RTI Act citing "commercial confidence". However the IT Expressway is a public limited company having entered into agreement with Govt of TN and others for developing and maintaining a particular stretch of road.   3. A RTI application filed with NHAI from Karnataka has helped recover Rs. 1.827 crores of extra toll chrged by the toll plaza operator. Decision: After hearing the parties and on perusal of record, the Commission is of the view thatinformation was provided to the complainant, at the very first instance and no further action isrequired in this case. However, the fact that the appellant’s RTI application made the officialsof the NHAI to investigate into this matter and to stop the excess collection of user fee frompassengers, is commendable. This not only led to the recovery of the amount of 1.827 Crsalong with interest to the NHAI but notice boards came up on all toll booths, displaying thatthe excess user fee of Rs. 5/- can be collected by the passengers, after producing proof ofidentification and excess fee charged. The Commission, therefore, appreciates the fact that thecomplainant has raised a very pertinent and an important issue involving public interestthrough his RTI application, which has been promptly redressed by the public authority. The contractor at Thane-Bhiwandi bypass has earned more than thrice the amount till date which it was supposed to make by 2017. The government allotted Thane-Bhiwandi bypass, also known as the Maziwadi junction toll naka, to the Ideal Road Builders in 1997 for Rs104 crore for the collection till 2017. The project included expenditure towards building, maintenance, management and operation of the national highway and the reasonable profit for 20 years. The income to the operator was based on the traffic load on the highway, per year rise in the number of vehicles and the per year increase in the toll rate. However, figures obtained under RTI by Srinivas Ghanekar of Thane have revealed that the operator has earned Rs306.49 crore till March 2011. The activist claimed that the government estimate in the number of the vehicles plying on the road at the time of allotment of the contract and the rise in the number of vehicles were much below the actual number. “The government had stated that 28,000 vehicles plied per day on the road in 1998 and that the annual rise of vehicles would be 5 to 7%. But the actual increase has been nearly 25%. The vehicles expected in 2017 are plying on the road today,” he said. Thane city MLA Eknath Shinde (Shiv Sena) took the issue to chief minister Prithviraj Chavan and demanded that toll recovery from vehicles be suspended with immediate effect. “The operator has earned money three times more than he was supposed too. In remaining 6 years, the earning will go up by another Rs300 crore. This is the broad daylight loot of public money,” Shinde said.

  9. As reported at daily.bhaskar.com on 9 May 2011 Pune: Activists have given a clarion call for initiation of a people's movement to rein in what they alleged a "toll scam of Maharashtra". This call was given at the monthly citizen's meeting organized by the NGO, Sajag Nagrik Manch (SCM), in the city on Sunday. Activists Vivek Velankar, Jugal Rathi, Vinod Jain and member of the Professional Party of India (PPI), Girish Deshpande, spoke on the arbitrary increase in road toll in the state. Based on information procured under Right to Information (RTI) Act, 2005, Deshpande noted that the Maharashtra State Road Development Corporation (MSRDC) had not conducted an audit for the toll collected by IRB, on the Mumbai-Pune expressway, in the last 10 years. "The cost of laying the expressway was Rs 900 crore. As per documents given to us, the toll collected exceeded Rs2,000 crore long back. Yet MSRDC is increasing the toll on the expressway on a regular basis," he said. He also pointed out how the contract between the MSRDC and IRB had no clause for reduction of toll. Vishwas Sahasrabuddhe, member of SNM, narrated his experience of invoking the RTI Act to seek information about toll increase on the Dehu Road-Kagal highway. He stated that when he asked for the minimum distance between two toll plazas, the results were shocking. "In the past few years, the National Highway Authority of India (NHAI) has been reducing the minimum distance between toll booths. Also, there seems to be a distinct lack of coordination between the various authorities such as MSRDC and NHAI when it comes to increase in toll," he stated. "Unfortunately, when it comes to societal support for individual activists, the scenario is abysmal. We had been fighting against the increase of toll on Pune-Ahmednagar Road for the past five years, but no one came to help us," said Ahmednagar-based activist Pramod Mohole. He and other activists had filed a public interest litigation (PIL), against the public works department (PWD) and other government agencies, which led to a freeze on further increase in toll.
  10. Recently there is an increase in the number of Government Departments using social networking sites like Facebook and Twitter to help citizens out with their grievances and suggestions. Would like to know whether the questions, suggestions posted by public and the reply/reference number provided by the concerned department or any of its authorized representatives on any such social networking sites be challenged under the RTI Act. In the instant case I had asked the National Highways Authority of India about the applicability of toll being collected by M/s Soma Isolux on Panipat to Jallandhar stretch of NH-1 which is still under construction. Though a reference number was provided to me no further intimation/update is being provided by the concerned department. As reported by Aditya Dev at timesofindia.indiatimes.com on 05 October 2010 GURGAON: The quality of services on the Delhi-Gurgaon expressway might be getting worse but revenue generation from the project has been very healthy. DSC Ltd, the project's concessionaire, has earned Rs 381 crore from toll collections in the 31 months between January 2008 and August 2010, while the National Highways Authority of India (NHAI) has earned Rs 20.29 crore as its share of toll revenue from the project. In August 2010, DSC earned Rs 16.3 crore from toll collections. NHAI revealed the information in an RTI reply. In the RTI application, TOI Gurgaon had sought information on both revenue and service-related issues. NHAI said the project, implemented on a build, operate and transfer (BOT) basis, would be maintained by the concessionaire for 20 years from the date of appointment (signing of the concession agreement). Of the expressway's three toll plazas, at the Delhi-Gurgaon border, Kherki Dhaula, and Indira Gandhi International (IGI) Airport, the highest toll collection was recorded at the first toll plaza. The 32-lane Delhi-Gurgaon border toll plaza generated Rs 231.95 crore between January 2008-August 2010, while Rs 145.56 crore was collected at Kherki Dhaula. The lowest collection was recorded at the IGI toll plaza. The 32-lane toll plaza, which falls between Delhi and Gurgaon, is the most crowded of the three. The plaza not only processes a major share of local traffic but all long-distance traffic also passes through this point. As per the NHAI-DSC agreement, if more than 1.20 lakh passenger cars pay toll tax on the entire 28-km stretch in one day, the revenue earned from the additional vehicles will be shared with the NHAI on a 50:50 basis. This is where the NHAI earned the Rs 20.29 crore from. The toll collection report supplied by NHAI shows that the concessionaire's revenue generation has steadily increased over Rs 10 crore a month from March 2008 to May 2009, barring a few months when collections were less. A significant increase was noticed since June 2009, when the toll collection was over Rs 11 crore. NHAI also revealed in the RTI reply that current toll rates for different types of vehicles will remain in place till March 31, 2011. Though NHAI recently floated a tender inviting consultants to carry out a study after it found services on the stretch were deteriorating, NHAI's reply to the question "have services deteriorated because of an increase in the volume of traffic", was NA or not applicable. NHAI also said traffic growth on the stretch has been similar to what was projected by the DPR consultant (RITES) in June 2002. On its part, the developer has invested over Rs 1,100 crore in the project, after raising debt and has been paying interest on that amount. Its working expenses include expenses incurred on running the toll plaza and on maintenance.

As reported by Ninad Siddhaye at dnaindia.com on April 26, 2010 Traffic on the Bandra Worli sea link has not improved even after the north carriageway was opened a month back, raising concerns for not only the existing bridge but the next phase. The MSRDC had estimated, in a reply to an RTI query (reported in DNA on April 15), that by 2012 once the sea link is extended to Haji Ali, as many as 2 lakh vehicles will be plying on it. Forget 2 lakh vehicles and 2012: the present situation is rather bleak for the toll operator who after nine months is still struggling to reach the breakeven collection of Rs20 lakh per day; the daily toll revenue hovers around Rs15 lakh, and at best Rs17.5 lakh. “I am afraid we have not reached the figure of Rs20 lakh even on a single day in all these nine months of the opening of the sea link,” MEPL managing director Jayant Mhaiskar told DNA. As per the toll contract with MSRDC, MEPL paid upfront Rs74 crore for a period of 52 weeks ending in the first week of July. It is evident that the opening of the north carriageway has not helped the numbers to increase. According to the data of toll collection, the average increase after the north carriageway opening on March 24 up to March 31 was a mere Rs1.21 lakh (an average increase of 2,500 vehicles daily). Mhaiskar said the MSRDC projections on the number of vehicles plying on the sea link has gone wrong somewhere. About the reasons, he said the sea link needs to be considered as a premium asset similar to the Mumbai-Pune Expressway. “When the expressway was thrown open, many eyebrows were raised about the high toll rates. However, now motorists have realised the importance of it. I guess people will realise the importance of the sea link too in a while,” said Mhaiskar. A reason for the lower toll collection was a big chunk of users taking return pass at Rs75. “It was always a problem and will continue to pinch any toll operator in future.” Mhaiskar said the base price for next year’s bidding for a new toll operator should not exceed Rs5 crore a month (as against Rs6 crore-plus presently). MSRDC begs to differ. “We will go for tendering the same way as we did last year. This will be a one-year contract with an option of foreclosure. The agencies which constructed these bridges have already collected double the amount they have spent on them. Expresso takes a close look at the issue. The National Highway Authority of India (NHAI) constructed bridges at Aroor- Kumbalam and entrusted the state PWD to collect toll. The information collected by M B Sathyan, general secretary, Private Bus Owners Association (PBOA), under the RTI application proves that the state PWD has already collected more than half the amount spent for constructing these bridges. “I have filed a petition before the Kerala High Court for issuing orders to stop toll collection at these bridges. The Court has admitted the petition but is yet to start the hearing,’’ M B Sathyan said. The state PWD has already requested the NHAI to stop the toll collection as the amount spent for constructing these bridges has been recovered. “We have requested the NHAI to wind up toll collection. But we are yet to receive any information from them,’’ said PWD superintendent engineer. The government justifies the unending toll collection at Aroor-Kumbalam bridges. The NHAI has almost completed the construction of a permanent toll booth at Kumbalam. “Once the four-lane on the Aroor-Chalakudy stretch is complete we will start collecting toll. We will stop collecting toll at Aroor, instead we will start collecting toll for the bridges as well as NH widening from the new permanent booth at Kumbalam,’’ an NHAI official told expresso. The government’s justification for the toll collection in the case of bridges in remote areas is that the amount spent on them will not be regained through toll collection. So it has been decided to introduce perpetual toll collection so that the revenue generated from such centres can be used for constructing bridges at non-profitable areas. The Mattanchery BOT bridge has always been the centre of controversies ever since its opening in 2001. When the bridge was opened in August 2001, the Cochin Bridge Infrastructure Ltd - the subsidiary of Gamon India Ltd which constructed the bridge on BOT basis - declared excessive toll rate. It was a breach in the agreement between the company and the government. According to the agreement, there should be multiple pass and single pass for vehicles. But the company decided to issue single and return passes. This would have caused significant loss to those using vehicles including the buses. The locals protested against the move and demanded to withdraw the revised rates, and the authorities heeded. Then the company demanded to extend the period of toll collection by six years and an annual compensation of Rs 1.54 crore from the state government. The move by the then government was foiled with the private bus operators challenging it in the court. According to the agreement, the company can collect toll for a period of 13 years and nine months. The construction cost of the bridge was around Rs 12 crore. But the information collected under the RTI Act by Kerala State Private Bus Owners Federation president Khalid Mundappilly reveals that the company collected more than double the amount by July 2009. According to the agreement, they should stop toll collection once they get Rs 30 crore. “The information I got as per the RTI Act is that they crossed that amount by December 2009,’’ said Khalid. “I will move the court praying that the toll collection should be stopped immediately and the state government should take over the bridge from the company,’’ he said.

  15. Hi, I would like to know the toll rates paid by Inter-State Sleeper Passenger Buses in Maharashtra, Andhra Pradesh, Karnataka and Chennai. I have the following questions: 1) Do these buses pay toll for every trip they make? 2) Is there an option to pay toll in advance for say a quarter, half year, etc. 3) I have tried contacting the RTO offices in the above mentioned states but have not managed to obtain any information.     PIO office in Pune

    I am a resident of Bavdhan, on Pune-Paud Road. Inspite of this area being under the Pune Municipal Corportion, a few days ago, work for a PRIVATE TOLL PLAZA has started on this road, close to Chandni Chowk. I and some fellow residnts have been opposing the work, but without any positive results. On completion this Plaza is going to create a chaos & nuisance in the laready over congested road. Inspite of the Corporation owning land a kilometer further down this road, near the Octroi Post outskirts of Bavdhan, the officials do not want to change the venue. I want to know, isnt it mandatory for the Corporation to ask for suggestions / objections from residents around the proposed Toll Plaza???? How should I gather information about this project??? Whom do I write to, for asking about the authenticity for proposal of the site of the Toll Plaza???
