TO obtain Encumbrance certificate

Question

Hello,

how to file rti to get EC certificate for the years 1950-1972 from tamilnadu registration department(salem district).

i have applied a month before for this ec but officers replied they lost the documents.

give me details how to file RTI to get this doc.

If they have replied that documents lost/ not available then RTI will not be useful. Yet you can file RTO application to the PIO of concerned department with a request to provide information which you need.

Hello,

ENCUMEBERANCE CERTIFICATES will be issued in the SUbRegistrar Office of your area and IN AP AND TELANAGANA STATES you can get them in MEE SEVA COUNTER also.This is RTI forum dedicated to RTI matters and therefore try in the SRO office where you can get it without any difficulty.

Encumbrance certificate's are not issued through RTI, pls visit .:: HOME - TNREGINET ::. web site, you can view online without any cost from the period 1-1-1987. The certified copy can be get from the concern office on payment of prescribed fees. for the certificate prior to that period you need to apply in the District Registrar Office, situated at Salem Collectorate.

What DOCUMENTS THEY LOST is it your application or the REGISTERED DOCUMENT COPY WHICH THEY HAVE KEPT AS OFFICE COPY, if your application is lost you cn try to submit again and if the origiona document is MISSING THEN YOU can apply to the DISTRICT REGISTRAR who may prhaps have a copy with them

Revenue Records are permanent in nature and must be preserved. There is some missing link, file RTI Application to PIO, Sub-Registrar, the circumstances under which documents were lost (The records in fact are not documents, but bound registers), Steps taken for reconstruction of records, alternatives being followed by dept., for issue of ECS, Action taken on such missing records like reporting etc.,

Your RTI application format/fees as applicable to TN State.

That is what I have written above anf for getting any cerrtifcate there will be payment of prescribed fee which is common knolwdge

Unless and until prescribed fee and search fee for old records is paid in the prescribed form, E C will not be issued by the Sub-Registrar. Inspite of receiving application and fees required, EC will not be issued, then you can file RTI application to know the status or the reasons for non-issue of EC.

Why round about method,let him apply for EC and pay fees rthey willo give it and there is no problem if he can give the ocument No. and year of Registration it ill be opnly 10 minutes times if the records are COMPUTERISED and in kost of the states this is computerised.

You can make attempt wioth DISRTICT REGISTRAR office and if they also say rthe same thing then yuou go ahead as suggested by Prasad ji above

Can you please share with the forum the following, so that the members can guide you appropriately:

 

1. A month back you had applied for Encumbrance Certificate (EC) under RTI Act OR you have applied under some other relevant Act ?

 

2. Have the Officers replied to your in writing (stating that the requested documents are lost) OR have they replied to you orally ?

Upto 1965 records will be with sub-registrar office, for older records you have to apply EC to collectorate office. Finally if they responded like document missing then, you can file a case in court requesting for EC/any document.

@Pravin doss.  Registration dept is separate and Revenue dept is separate.  Now all the revenue records and registration records were uploaded, and any one can get such copy from the website and if a certified copy is required, he can go for E Seva or Register office or Revenue office at Tehasildar office.
