Any authentic report on what exactly was solicited by her and what was provided with such dates and as to whether state govt., can add further exemptions through orders at state level.

The denial appeared in local news papers, but the notification exempting that dept., is dated one day prior to the date of her RTI Application. She is an affected party, and has a right to know of her security arrangements, can the information be denied on the ground that the dept., is exempted. In case the dept., is exempted, is it not the duty of SPIO atleast to meet her and explain orally ?

The information has not been denied because it relates to security issues !

 

But by a reasonable inference, it seems that it has been denied on the grounds that the organisation from which the information has been sought, is exempt from providing information under section 24 read with Schedule II to the RTI Act, 2005

 

(that the PIO has sought an exemption u/s. 24 can only be confirmed by referring to Gujarat Home Department's Resolution Number SB.1/1020018203/GOI/62 dated November 25).

 

However, the denial u/s. 24 is appealable under section 19(1) on the ground of human rights violations i.e. the information sought pertains to the security of the person herself !

 

It remains to be seen whether sec. 19(1) is exercised.

According to the RTI Act, the exemption proviso is meant only for "intelligence and security organisations"

 

Section 24 (1) of the RTI Act says, "Nothing contained in this Act shall apply to the intelligence and security organisations specified in the Second Schedule, being organisations established by the Central Government or any information furnished by such organisations to that Government. "Provided that the information pertaining to the allegations of corruption and human rights violations shall not be excluded under this sub-section."

The denial is on the basis of intelligence and security clause as per the news papers though she has asked VERY CLEAR INFORMATION about her security which they could have given but denied for their own reasons.
