Action taken report - can be furnished ?

Hello,

I want to know, whether Action Taken Report on particular grievance or Status of the grievance preferred can be furnished under RTI Act, 2005. Now a days, it is quite common, people referring their grievance first and after a lapse of some time, they are seeking the Action taken report/Present status of their grievance.

The public authority is required to settle the genuine grievances referred to it within reasonable time. If the action taken report or status is available on record, you must supply it to the RTI Applicant. Generally, the note sheet and decision of appropriate authority on such representation shall speak the action taken and status. You can supply copy of such note sheet.

 

You need not create an action taken report for this purpose. PIO is also not required to give his views and opinion about the action taken on the representation / grievance. What is available on record shall only be supplied.

 

If no such material is available on record or information sought is not held by your public authority, you can advise accordingly i.e. information sought by the applicant is not available with the public authority in material form.
