Maharashtra Govt circular on deduction of penalties

Can somebody translate the essence as to whether State Govt., has ordered for deduction of penalty from PIO's salary on receiving such IC order ?

Then one must congratulate the Commission and wait for other states to follow. At least DOPT should take a clue.

Gist is that responsibility of recovery of penalty imposed by SIC, is with Salary Disbursing Officer of the department to which the penalised officer is attached. Circular quotes sections 18.3, 19.7 and 20.1 of RTI Act. It also states that penalty should be recovered as directed by SIC or in maximum 3 instalments.

 

Good initiative and I will be mailing to CIC, DoPT and Gujarat Information Commission as best practices to be emulated.

But if he still does not do it, then what action is expected to be taken against him ?

 

There are hundreds of such circulars regarding RTI matters issues by centre and various state governments but NOT A SINGLE ONE lists the actions that will be taken against that officer.

this order may be likely to be challenged by the PIO's arguing that their furnishing information under RTI as per mandatory provision of RTI as a part of their official work and how far it is justified to recover it from the hard earned pay in which case the courts may perhaphs block it however in case of errant PIO's this is a good lesson.
