New File- CIC cannot order Disciplinary action against appellant

If I remember well CIC has not ordered and only suggested that PA is free to recover costs from appellant for misuing RTI Act and that is not definitely an order by CIC and certainly a provocative suggestion.

That was the other case involving Railways - where costs were ordered to be recovered. That order was also struck down by court.

 

This is a different one regarding disciplinary action - the PA is Salt Institute/Commissioner

Hon. Ansari is one , who wishes that Appellant must visit personal hearing as a "must" and refuse to go by material available on Secon Appeal for taking a decision. Unfortunately, due to several reasons his decisions in absence of appellant are very bad in law. To cite an example, he has received a fax on some other matter from CPIO, and appeal hearing of against CPIO is pending. Hon.Ansari has even without reading the four pages of submission and relevancy concluded and disposed the file stating that CPIO has provided information. Unfortunately appellant can not afford to go to HC against the direction, and CIC (Transparency Officer) though agreed orally that there was a great miscarriage of justice, said they can not comment and review the decision. But if appellant is calm and patiently explain him the case in brief and precise manner, certainly he delivers very good judgment and he is seldom worried about CPIO;'s absence but concerned with physical presence of appellant who is concerned with the case. If appeallant is absent, his decision is that appellant is not interested in further follow up and hence disposed.
