CIC finds hills dug up in Mumbai; notices issued to Environment Ministry

 

NEW DELHI: In a first, apparent environmental degradation in Mumbai has been treated as a complaint by the Central Information Commission which has taken suo-moto notice and issued notice to the Environment Ministry to explain if the digging of hills in the city was permitted by it.

 

 

The smoke over Mumbai sky and digging of hills in the city, observed by Information Commissioner Sridhar Acharyulu, while on a visit to Mumbai, was treated by him as a complaint under the RTI Act making ..

Read my earlier post on comments of Mumbai HC and I have said that IC SA is exempt from all such stipulations.

May be he exercised his right as a common citizen and sought information in larger public interest.

 

Any how, let us appreciate the motive behind it, though he is not concerned with Mumbai.

No, not as a complaint in this particular case, as reported.

 

But, in such a case where it appears to IC that the practice of a PA in relation to the

exercise of its functions under RTI Act does not conform with the provisions or spirit of

this Act, it may give to the authority a recommendation specifying the steps which ought in

its opinion to be taken for promoting such conformity. i.e suo-motu it can give recommendation u/s 25(5) of the Act.

 

Earlier, it happened too. Though commission had to withdraw it's order due to complaints filed by Sailesh Gandhi & Bhaskar Prabhu Sirs (order is embedded): Maharashtra SIC withdraws order on blocking access to building plan - Moneylife
