CIC denies info on compassionate appointment since respondent has right to defend itself !

 

The CIC has ruled that info related to "compassionate appointment" can be denied under RTI since the respondent was defending itself in a court case and it has a right to defend itself.

 

Curiously, the CIC has not cited any sub section of Sec 8 to deny such information.

 

Initially the PIO denied the information under Sec 8(1)(h) which deals with " impede the process of investigation or apprehension or prosecution of offenders"

To deny information about Appointment on compassionate grounds is taking things too far away and Hon'ble CIC is doing no service to implementation of RTI Act 2005 by denying information without quoting section 8 or and 9 of RTI Act 2005 which is must as stipulated under Section 7(1) of RTI Act 2005.

 

Unfortunate.
