A PM report given by an expert is confidential and not a public document as held in State v. Gian Singh (1981 CRL.L.J.538) of Delhi High Court. Copy of the PMR/MLR may, however, be given subject to fulfilment of three conditions, (1)NOC must from police clearly stating that the issuance of copies of PMR/MLR will not hinder the investigation (2) written application from the relative of the deceased person stating relation by paying prescribed fee.

 

Alternatively, the applicant shall produce order of the court directing the medical officer concerned to provide copy of the PMR/MLR.

I got my own reservations but before Hon.Manoj, himself a Top Police official, I dare not differ but the truth is any blood relation can seek and get such information or record.

you have not specified what exactly is your relation with the dead person whose post mortem report you wanted to get. normally post mortem report will be given to the kids and kins on the same day as a mandatory provision. if you are somebody else , you may not get it.

Unless you establish larger public interest.

We advise all members first file application seeking information without doubts, and then start further probe as what can be done if information is denied.

Maximum PIO may not reply, but they can not cut the head of applicant and the expenses are just Rs.32
