Non receipt of fee for information by SPIO

Hello,

For how long should I wait as an SPIO for the fees depostion by the applicant?Had intimated the applicant 3 months back to deposit the fee for the no. of pages of information requested. Can I officially reject his application now?

Just issue a Registered notice to applicant claiming postal charges for notices also, and state that application has to be treated as disposed, if RTI fees + Registered notice postages are not paid within 15 days, treating that applicant is not interested in getting copies.

(The Act prescribed no such limit of waiting--Responsibility of PIO ceases the day he demands for RTI copying charges)

Just keep quiet.

You have done your job by sending a notice of demand for additional fees.

It is now upto the applicant to pay those fees to get the information.

if pio failed to give to information notice about deposit fee's with in one (30day's)month after received rti application applicant able to get free information, now if you received notice after 3 month you can file appeal to FAA and ask them why you can pay fee information are not get with in 30's day.

Please read the contents of Post No.1. The thread starter is SPIO, who decided the RTI Application and advised the further charges to the RTI Applicant, who did not remit the further fee even after three months.

 

PIO is only required to decide the RTI Application either to supply information on payment of further charges OR reject the request for any of the reasons under section-8 or 9. In this case, PIO has rightly decided the application and advised the applicant the further fees in terms of Section-7(3). PIO's job is over. If the applicant wants information, he may remit the money and collect information.

 

You may send the Case file of the applicant to record room and keep quite as already suggested.

as expected of a PIO , you have disposed the application under section-7. and if the applicant desires to have the information, he need to pay the additional charges and if he fails to pay , you are not to bother and you can close the file and keep it aside as disposed.
