Third Party Info clarification

Question

Dear learned Members,

 

Kindly guide with citation,

Can the details of a beneficiary (under govt. scheme) can be considered as Third Party Information?

 

How to go about asking for information if the beneficiary has provided counterfeit documents to get the benefits?

Dear member,

 

Details of a beneficiary (under govt. scheme) can not be considered as third party information. You may file RTI application to the PIO of concerned govt. authority with a request to provide certified copies of documents submitted by the Beneficiary. Details of beneficiaries have to be suo-motu (ie on their own) disclosed by the public authority under Sec 4(1)(b)(xii) & (xiii) of the RTI Act 2005:

 

(xii) the manner of execution of subsidy programmes, including the amounts allocated and the details of beneficiaries of such programmes;

(xiii) particulars of recipients of concessions, permits or authorisations granted by it

For each and every level, quoting of citation is not necessary. Just file application. The implementation of subsidy involves several departments and information can be accessed from any dept., that is involved in the process. Infact they must voluntarily disclose such information.

The true fact is that NONE OF THESE LISTS of benifiearies under each SCHEME will never be seen on any NOTICE BOARD OF PANCHAYAT OR MUNICIAPAL OFFICE EXCEPT TENDER NOTICES.If one ask under RTI they may claim Third party indformation U/S 11

If subsidy or grant or any other amount is paid by govt to beneficiaries, then entire information of beneficiaries can be accessed by any citizen under RTI Act. Even if PIO denies under third party, then you may go for first and second appeals.

That may be thread starter's doubt and he has not informed any event/fact.

What are documents submitted for availing subsidy ?

The official who has verified the documents are material.

If you are confident file complaint and let them investigate into the affair. Let them do the home work. RTI is readily available without any doubt and you can have access to any such documents even if it is a bank through some public authority who disbursed subsidy. They can call for the documents from Bank officially in case of investigation/complaint.

NORMALLY he is THIRD PARTY however you can file RTI with PIO from whom the benificiary got govt.benifits and try what he REPLIES-instead of discusiing discussing again and again in this portal

The thread starter should in between react to say whether he needs any more advices are what was given by Members already is sufficient.Otherwise it becomes endless postings

As suggested I have filed the RTI & waiting for the response from the SPIO. Accordingly I'll upload the contents in case of rejection for further discussion and advice.

If you are SURE hat the BENIFICIARY produuced countefeit or false DOCUMENTS to get the govt.benift the option left to you is to file a formal complaint and then the govt. machinary make enquiry and cancel the same if found false.This is what going to happen and if your information is found to e false thn ig becomes a false complaint
