Cross Verifying my drafted First Appeal Application

Hello,

 

Attached is my draft of first appeal that I need to send. Request you to please cross verify the same and suggest modifications, if any. Format for the same was downloaded from this website itself.

 

I would also like to draw your attention to point number 13 and suggest if it is at all needed considering that this application is concerned with a state department.

 

First Appellate Authority Name: Not Available. Neither was it mentioned in the RTI reply I received

 

Background:

 

I filed an RTI application in February this year asking for marks and answer sheet copies. However the information was then delayed saying that such information cannot be provided till completion of examination process and the same will be provided later without requiring any fresh RTI application. I quote below the exact reply (last paragraph) below

 

"...access to information sought is regretted at this stage, which however, without requiring any fresh RTI application would be furnished after declaration of final result of CC examination on the strength of the present RTI application"

 

Final result was declared on 12th May, 2015. So it is more than 30 days today and there is no communication from the RTI authority even asking for the cost of photocopies.

 

Please verify the application and suggest.

Did you mean wait for the RTI reply? I'm planning to send this first appeal by end of this week, which will be around 40 days after the date of declaration of result. Should I wait for some more time?

 

Moreover I was expecting a letter mentioning the cost of copies that I'll have to sent which has not arrived yet.

 

Can you kindly wait for reply?

There is nothing wrong, if we appeal. FIle first appeal, enclose copy of PIO information, and inform that PIO has not provided information as assured and pray for directing PIO to provide the information as expeditiously as possible, free of cost.

You need not know FAA address, just write to FAA (RTI)..............and enclose the sent (Self attested RTI Application, PIO response, your first appeal) and request PIO to forward the same to concerned FAA under intimation to you at the earliest. You may mention Grounds of Appeal: PIO has neither provided information nor denied stating exemption within 30 days from date of publication of result, hence treating the information a deemed denial, filing first appeal. Prayer: Please direct PIO to provide information free of cost.

@manoj sir.. I've included the same in point number 8.

 

It is not an actual delay but a deemed one. Results were out on 12 th May and information was expected 30 days from then.
