Income and service details

Question

Hello,

I want to know how can I obtain income and service records of my wife via RTI who works for a private firm. In addition to the RTI format for the same are there any judements to support this particuar RTI ?

Your right under the RTI Act is to seek and obtain information held by and under the control of the public authorities. Private firms are not covered under RTI Act. However, information held by the regulatory authorities under the regulatory rules and norms can be obtained by filing RTI Application before such regulatory authority, subject to exemptions u/s section-8. E.g the details of teaching staff in a private school including their scale of pay, date of appointment etc are required to be submitted to Dist Education Officer or Dy. Director of Education of the District by each private school periodically, which information can be obtained under RTI. Similarly, list of employees working in a factory is required to be submitted to the Factory Inspectorate by private factory establishment periodically which information can be obtained under RTI.

 

If your wife is an income tax assessee, you can try by filing RTI Application before CPIO of the concerned Income Tax Office.

In case any dispute is pending in court, you or your advocate can pray for supply of salary details on oath by your wife or court can even order school to file her salary details in court. Since for deciding maintenance amount, present income of wife has also to be taken into account by court.
