MANOJ B. PATEL

No action/warning/reprimand to the defaulter PIO.

Appellant had sought the list of J & K migrants whose names were forwarded to the SDM. No response from the PIO and FAA. During hearing respondent PIO requested for six weeks time to provide information. The commission, accordingly directed the respondent PIO to provide information within six weeks.

In this matter why IC did not utter a single word against the PIO who violated provisions of RTI Act? Why did not IC even warn or reprimand the defaulter PIO? If such liberty will be given to the violator of RTI Act what is future of this Act?

Are you asking this question to your most favourite IC, whom you have great reverance and respect. Providing of information is important. Is there any harm if the information is provided late, or is the applicant using it for any larger public interest of helping them ?

Hon IC considers many points and he has several perceptions, which we can not understand.

Defaulter PIO should be punished and that is the moral duty of IC. IC should follow the RTI Act.
