Applicant asking for translated copy of his own RTI application




Sirji, I have received an RTI application from an application seeking copy of his own RTI application submitted earlier Gujarati Language. NOw he the copy of the same duly translation in Hindi Language. Kindly let me know, is it possible to provide Hindi Translation copy to applicant of his own earlier Gujarati RTI?

No, the PIO is not required to translate any documents to any other language, since this will be creation of "information".


You can provide the copy of the RTI application - in its original language, Gujarati - to the applicant.

The essence is you can provide that information as available on record. When you have an application in Gujarati, your records are not having application in Hindi. Hence you may reject and state that as per DOPT directive, information can be sought in the form in which it exists and can not be created because applicant has asked for it.

(To be more precise the comparison- Information is like a PDF formatted documents/Image photograph and Act will not permit for use of Photo shoppe or conversion of that formatted document)

The right to information of an applicant is only to seek and obtain information held by and under the control of the public authority. In this case, the information held by the public authority is in Gujarathi. Therefore, you must supply that Gujarathi copy of applicaiton, which is held by and under the control the public authority, copy to the applicant.
