Is BPL card for this ?

 

But BPL Card replaced by National Food Security Card so I do not have BPL card.

Submit the NFS card in lieu of BPL Card and claim fee exemption. Decision of PIO is not final. If he reject the request, please revert back to us for further guidance in filing appeal.

RTI Act has not prescribed any specific identification. Any information including income certificate and any card that shows that the applicant is below poverty line status of income is sufficient. Generally, no one is objecting about the type of such document, as it is attested by applicant himself.

(It happened several times with a PSU who demanded attestation of gazetted officer every time the card is filed from PIO. The applicant was advised to purchase Rs.10/- IPO without fighting with PIO on such trivial matter, as the cost is affordable, and any further correspondence on such simple issue is waste of time and more money.)

It is not the question of Rs.10/- application fee. Subsequently, applicant is also required to pay further fee. Everybody cannot afford huge further fee, often worked out by PIO to drive away the applicants from claiming documents.

 

When an applicant is really below poverty line and submits proof of NFS Card, which is a replacement of Ration Card, there is no justified reason for PIO to reject it, in absence of any stipulation that NFS card cannot be considered as proof of an applicant below poverty line. Simultaneously, you may apply to Tahsildar to issue you to certificate indicating that you belongs to BPL category, which certificate can be used every time.

When the monthly income is below Rs.1145 for Delhi (rural) and Rs.1134 for Delhi (urban) resident, he is considered as BPL i.e. daily earning below Rs.38/-. Calculating with this criteria, 9.91% of Delhi population are BPL.

 

World bank fixed $1.78 per day as on 2011 purchase power parity on US$ for deciding BPL across the world. This works out to an avg earning of Rs.108 per day which is nearly 3 times more than what we actually considered in India.

But what individual state stipulate has to prevail Sec. 7 (5) "as may be determined by the appropriate Government

As per AP (combined) the proof was that of a lowest grade ration card- White ration card.

Yes, this is a case of Delhi and circular dated 16/12/2014 is sufficient to establish NFS Card is replacement of BPL and the information cannot be denied on this ground. As already suggested in Post No.4, submit RTI Application along with NFS card along with a copy of circular dt 16//12/2014 and claim fee exemption being BPL.

 

Do not worry about what the PIO shall think or do. If you want information, file RTI Application. PIO's decision is not final. You have further right of First and Second Appeal.

As Inspection is offered by PIO, utilize the same with sincerity, select documents first, hand him a list of such documents with acknowledgment, show him the laid down stipulation, and then go for first appeal if you can not afford to pay such fees, inspite of importance and urgency of information.

Rs.2/- per copy is reasonable, and a citizen is paying only actual costs to his own Government. I have not seen any citizen going for second appeal only against such costs, unless he is a proxy for some other.
