New Delhi, Dec 23 (PTI) When it comes to deciding on prosecution for any violation of the State Emblem, two Union ministries seem to be in a quandary.

 

Correspondence between Home and Law ministries following an RTI application appears to bring out lack of clarity in dealing with violation under the State Emblem of India (SEI) Act, 2005.

 

Despite being the administrative ministry, the Home Ministry has asked the Law ministry to inform "the level of the officer in its (MHA) ministry who may be competent to give sanction for prosecution under the Act."

 

According to an RTI query, the Ministry of Home Affairs was asked to provide details of prosecuting authority in the Centre to sanction prosecution under the State Emblem of India (Prohibition of Improper Use) Act, 2005.

 

The RTI applicant also asked the MHA to advise the number of cases of prosecution instituted under the Act throughout the country along with details of convictions that may have taken place under the SEI Act.

 

The Home Ministry, however, sent the reply that said, "... Information sought by you (the applicant) is being finalised in consultation with the Ministry of Law and Justice".

 

It then forwarded a note to the Law Ministry asking advice, the reply included.

 

The MHA in the RTI reply has also asked the Law ministry "whether an offence under section 3 and/or 4 read with section 7 of the State Emblem of India (Prohibition of Improper Use) Act, 2005 is cognizable or non-cognizable?" PTI

'No authority named to prosecute State Emblem Act violators'

 

New Delhi (PTI): In what may be described as an omission in law enforcement, the Centre has admitted that it has not formed any authority to sanction prosecution for violation under the State Emblem of India (SEI) Act, 2005 as prescribed by the law itself.

 

The Ministry of Home Affairs which deliberated with the Law Ministry to respond to an RTI query for details regarding prosecution authority for SEI Act, has said no such authorised body has been formed in the Ministry.

 

According to Section 8 of the SEI Act, "no prosecution for any offence punishable under this (SEI) Act shall be instituted except with the previous sanction of the Central Government or of any officer authorised in this behalf by general or special order of the Central Government."

 

The ministry, in its reply to the applicant who also wanted to know the number of cases of prosecution instituted under the Act throughout the country along with details of convictions that may have taken place, said, "No such authorisation has been made in MHA so far for giving sanction for prosecution under Section 8."

 

"It is quite sad to know that the government has not formed any authority to sanction prosecution for the violation of State Emblem of India Act without which the Act does not have any teeth. It is an Act just for namesake," RTI applicant Rakesh Agarwal said.

नई दिल्ली. केंद्रीय गृह मंत्रालय ने कहा है कि राष्ट्रीय प्रतीक चिन्ह के दुरुपयोग को रोकने वाला कानून अभी भी ‘नख-दंत विहीन’ है। इस कानून के तहत प्रतीक चिन्ह का दुरुपयोग करने वालों को कोई सजा नहीं दी जा सकी। कानून में यह भी साफ नहीं है कि राष्ट्रीय प्रतीक चिन्ह का अपमान करने वालों का अपराध संज्ञेय है या नहीं।

मंत्रालय ने यह जानकारी सूचना के अधिकार कानून के तहत दायर एक आवेदन के जवाब में दी है। आवेदनकर्ता राकेश अग्रवाल ने यह जानना चाहा था कि राष्ट्रीय प्रतीक चिन्ह कानून का उल्लंघन करने वाले कितने लोगों को अभी तक देशभर में सजा दी गई है।

यह है सरकार का जवाब

गृह मंत्रालय ने अपने जवाब में कहा है कि राष्ट्रीय प्रतीक चिन्ह कानून 2005 की धारा 8 में कहा गया है कि सरकार इसके उल्लंघनकर्ताओं को सजा दिलाने के लिए किसी सक्षम अधिकारी की नियुक्ति करेगा। लेकिन अभी तक ऐसे किसी अधिकारी की नियुक्ति नहीं की गई है। मंत्रालय ने विधि मंत्रालय से यह भी कहा है कि वह ऐसे किसी सक्षम अधिकारी का निर्धारण कर उसे सूचित करे।
