Complaint Format for Non Compliance of CIC Decision

Hello,

 

Please send me format of complaint and guide what reliefs should I sought (including getting information, and penalty u/s 20) for non compliance of CIC Decision.

Not possible . If you are a senior citizen or suffering with physical disability you may seek such priority as CIC rules permit. But, making a request costs just Rs.5/-. Send e mail to IC, giving some urgency and importance to the information.

The complainant herein submit that  PIO has to provide the information within............days but PIO has not provided information as per the above orders of the Commission and hence this complaint on non compliance.

PRAYER: Complainant prays for directions to PIO and FAA also to implement the decision forthwith and prays for imposing of penalty on PIO and recommending for disciplinary action against the PIO, as the non compliance amounts to willful disobedience of reasonable orders of a superior and failure in his statutory obligation, in true spirit in implementation of RTI Act.

Do not be too happy.  The appellants generally pray all reliefs and PIOs get offended for the prayers of appellants  for penalty and recommendation of disciplinary actions.   When compared with an appellant without a background and influence, ICs naturally being bureaucrats in less than 1% of cases impose penalty (Even in those cases where there may be some misunderstanding in between that dept., and him personally) and gets credit from 99% of PIOs.  The appellants who request for such other prayers than information were told that they have a right for information alone, and the discretion of other actions under Sec.20 rests with IC, and they can not insist or influence IC on such decision for penalty etc.  PIOs always are always on  WIN situation and because those penalties are not imposed, they think that are correct and that grudge continues if the applicant files some more application.  

Unless the penalties are mandatory for deliberate and malafide denials, the RTI always remains a toothless tiger.  The stand of many PIOs are that let IC decide, then only we provide that information .  (They are aware that it takes minimum 2 years to maximum 5 years for getting a decision from IC)
