RTI rejected citing writ petition 419/2007

I had applied for an RTI in Commercial Tax Office in Bangalore to know the details about the builder. But it was rejected citing writ petition 419/2007. I had asked questions such as:

1. Is Vendor under composition scheme?

2. What is the % of VAT can this builder collect?

3. Are there any abatements to this builder, if so I would need all the details for the same.

4. What is the current status of the vendor & the reason if applicable for the same.

I am not sure whether to file another RTI (if so, any help in framing is appreciated!) or shall I go for an appeal?

File First appeal against PIO stating that PIO has denied information without stating such clause under Sec.8 with justification through copy of such relevant writ barring the information providing under RTI Act.
