PIO passes the buck on APIO

I have moved an application to get the information from the PIO. This is my thgird application.

There is only one PIO and it is a Sub Divisional Office ( SDO) with many villages under this office.

Every time you ask for information a reply comes that your application has been forwarded to Tehsildar for information and you may correspond directly with him,

The Tehsildar has been appointed an APIO ,might be to deal with population of villages from far off places during his tour.

The act clearly say that an APIO is to assist PIO. The PIO passes the buck on Tehsildar

Please suggest how to tacle this PIO

Read Sec.6.  Only designated officials as Public Information officers are under duty and statutory obligation under RTI Act to provide the information.  It is the duty of PIO to get the information from his subordinates within 30 days.

2. Immediately file First Appeal to officer superior and state such grounds of first appeal as follows:

 

First Appeal Dt.7th Nov,2018 under RTI Act.

Before: FAA,.....................

Against : PIO, Sub Divisional officer,...................

Appellant:

Brief facts: Applicant vide his application dt.............has filed an application seeking information under RTI to the designated authority of SDO.  Instead of providing information, contrary to stipulations stated under RTI, SDO has forwarded the application to his subordinate Tehasildar, who has also failed to provide information.

Grounds for Appeal: As per Sec.5 (2) It is the duty of Public Information Officer to provide the information as expeditiously as possible but within 30 days.  Asst. Public Information officer duty as stated in this section is "to receive the application for information or appeals under this Act and for forwarding the same forthwith to the Central Public Information Officer or the State Public Information officer or senior officer specified under Sub-section (1) of Section 19.....It is not proper on the part of SPIO to deal a stipulation under law as he pleases.   As PIO's Action is improper and illegal in law, this first appeal.

PRAYER: Appellants prays for directions to PIO for providing of information as expeditiously as possible free of cost.

Send the application by Regd. Post under copy to PIO by ordinary post.  Preserve postal receipt by pasting the same on your copy of the first appeal for the further second appeal process.

If grounds are same file three separate appeal with different dates, put all the first appeals in one envelope.
