Information on housing for all scheme

Tamilnadu Slum clearance board has constructed housing projects at two places in our district

I would like to know the various schemes under which housing or tenements are granted to beneficiaries,list of applicants for free housing scheme ,number of sanctioned applications , field verification details,list of applications rejected etc

List of beneficiaries under VIP quota.

Sir,

 

RTI Application received by PIO on 22.04.2019.

First Appeal received by FAA on 28.05.2019

Today I received reply from PIO dated 21.05.2019 stating that he cannot reply to questions in RTI application raised in impetus as per section 2(f).

Pls advice on grounds of SA.

Got the reply from PIO as follows

 

1. Please provide name ,designation and official mobile number of all the officers & employees working at SCB, Tiruvallur Division in accordance and in compliance of the provision of section 4(1)(b)(ix) of the RTI Act. in accordance and in compliance of the provision of section 4(1)(b)(ix) of the RTI Act.

2. Please provide the Brochure/Booklet/Circular that states the norms for allocating such houses.

First Appeal and Addendum to FA are already submitted. Should I go for first Appeal or second appeal? No Reply from FA still.

PIO is providing wrong information. I called the AE and asked him for application. He said there is no vacancy and all houses are allotted

This reply from PIO is classic example of defiant attitude of PIO and levels of knowledge both in running his department and on RTI.Any how it is not our concern for the present.

You have to go for appeal within maximum 30 days within in receipt of FAA orders or maximum 45 days in case FAA orders are not delivered.

Now ask a friend or relative to seek information as follows:

1.Please provide number of vacant houses for allocation as on date in

2.If allotment closed, such date of final closure of allotment. and certified copy of that memo/notice/report on finalizing the list.

3.Please provide copy of such list of selected beneficiaries.....................................................

Then go for second appeal.  Certainly you can get a befitting order, if IC applies his mind.

Sorry I am not finding a link in between what you have sought guidance and on which you have sought guidance.  To refresh this is your  first query.

This is the actual  you have solicited from PIO.

. Time and again we advise members not to seek that information which is not useful but still some state unnecessary quotes of sections and ask those questions which are in fact not relevant not necessary, not helpful.  Honestly, what do you want to do with that employees of SCB address book list.

You can also file grievance before the TOP authority of SCB requesting him to upload the beneficiaries list in their website as the selection is not proper.

Sir, Thanks for your guidance.

The first query was 1. Please provide the status of various projects undertaken by the board for construction of houses in the .......District. PIO has provided no information on the ongoiing constructions at various places in the district.He has skipped the query.

I  added the query employee information. Reason being,very often PIO's do not provide the name and designation in RTI reply.Someone in their office signs across it and the PIO escapes.As expected they did not provide employee information for tmy RTI application stating that employees change from time to time ( Its the office of Executive Engineer).

Lot of SCB allotment of tenements did not got to poor and needy.They have allotted Houses on basis of recommendations, bribe and to their families

Please let us not go into that not relevant now. Forget it.

Let us not bother about which is not required.  Let there by any PIO, applicant is not concerned if some one signs above such designation.

Pios are lethargic in implementing DOPT guidelines on format of reply and invite unnecessary issues.

         I did not go for second appeal as suggested and filed another RTI through my friend as per your suggestion

Now ask a friend or relative to seek information as follows:

1.Please provide number of vacant houses for allocation as on date in

PIO has given a irrelevant reply " Houses have been constructed under The XIII Finance Commission of Government of India and 12th finance commission"

2.If allotment closed, such date of final closure of allotment. and certified copy of that memo/notice/report on finalizing the list.

As per RTI act, information cannot be given on a file which is not closed and allocation stil in progress

3.Please provide copy of such list of selected beneficiaries.....................................................

No need of providing voluminous information . PIO has quoted an irrelevant TNSIC judgement  11576/ / F/ /2014

On this RTI, the PIO has stated his designation as Estate Officer and FA being Executive Engineer.

Immediately go for first appeal.

First Appeal dt 16th Nov, 2019 under RTI Act

Before: First Appellate Authority, Executive Engineer,......

Against: SPIO, Estate Officer,....................

Appellant:

 

Brief Facts: Appellant has sought information on....................and SPIO has not provided the precise and pin pointed information and evaded providing information vide his letter dt........................

Grounds for Appeal: 

Point No1:  When asked for the Vacant position of the quarters, SPIO has stated that they were constructed with funds of commission.

Point No.2: For the query 'If allotment closed, such date of final closure of allotment. and certified copy of that memo/notice/report on finalizing the list., SPIO  has invented such exemption that was never stated in RTI Act and denied information with remarks " RTI act, information cannot be given on a file which is not closed and allocation stil in progress".  PIO has not provided such Section and sub section of Sec.8 with justification for denial of information.  There was never such exemption in RTI Act, and SPIO has deliberately misleading applicants with false exemptions that were never stated in RTI Act.

POINT No3: When sought for list of selected beneficiaries, SPIO has further invented that the information is voluminous which is false and absurd.  There was never such an exemption under RTI Act that information can be denied if the information is voluminous.  With ulterior motives, he has quoted an unrelated judgment.  SPIO can deny information by stating such number of Section and sub section of Sec.8 and should justify his reasons for application of that exemption.

Finally without application of mind, without basic knowledge and fundamentals of RTI, SPIO has deliberately and with malafide intentions purposefully evaded providing information.  Knowing that there were never such exemptions in RTI Act, deliberately SPIO avoided mentioning such section and sub section of 8 in RTI for exemption, leave alone such justification for applying exemption.

PRAYER: Appellant prays for directions to SPIO for providing precise information for the pinpointed query as expeditiously as possible free of cost.  In the interest of the Government, please depute SPIO for training on fundamentals and provide him RTI Act in that language he is familiar with and atleast one section Sec.8.may be explained to him for the present.

Will send this Appeal tomorrow.

PIO  actions makes one fishy about allocation of houses. May be a large scale scandal could have happened.
