Need support how to move further.

 

There was income certificate issued as 260000 in December and 160000 in January after she caught an broker to make her income certificate to gain government subsidies. I filed an RTI application seeking information for January certificate which includes her educational records and bank details. However, I got a reply from the Department saying we have asked her representation and she denied to furnish the information to 3rd party. I have the copies of the both income certificates but wanted to know on what basis issuance is done although record for both of them will be same.

Is it just a lame excuse as there was nothing written by her and stating denial? Because I don't know whether she was called or not as no copy was marked to me.

I do not know how your Sunday post appeared in the forum suddenly to-day.

The information sought for you is in the larger public interest and connected with welfare measures of Government.  You can go for the first appeal, seek hearing of the appeal.  Clearly state the facts that their income certificate references, amount, dates with more clarity.  This amounts to falsification and corruption.

Clearly inform that any application filed voluntarily by citizens becomes a public document and not third party information and SPIO is misinterpreting a well-laid norm.

If FAA fails to give the opportunity of personal hearing, enclose copies and report the matter to collector and state as to how Government schemes are being misused, abused by those undeserving citizens and how officials are corrupt and issuing certificates as they like for reasons not known.

Please always seek guidance by posting exact query.

As far as income query is concerned, there is larger public interest involved like abusing govt. subsidy and information can not be denied and you need no judgment for establishing larger public interest.

Coming to educational qualifications  and Bank details they are treated as personal information.

You have to establish that such certificates are fake.  You can never get information on bank details as it is strictly personal.

What exactly you wish to establish through such judgment, please post.

I have checked online Sonia Gandhi income tax RTI which was filed by an activist and denied in 2012 stating 3rd party. Moreover couldn't find judgment of Anil Galgali and Sachin Tendulkar BMC penalty RTI as it was also denied stating 3rd party.
