You have to pay the fees as you have discontinued in mid semesters and caused loss to the institution, and the institution cannot recover such fees as there can not be admission in IV year. Their demand is legal. But this is in no way connected to returning of original marks sheet etc., and this independent process. The certificates are given for verification and immediately after verification, if demanded those certificates must be returned to student. If the institution fails to return the originals it is a gross violation, and a complaint to UGC/AICTE/HRD/State Government may make the college lose the accredition given. Issue a notice under CP Act to the principal requesting for return of originals, mark this as copy to UGC, University, AICTE, HRD and to State Government. Be certain that you will receive your originals within a month.
