Delay in filing second appeal

Hi Team,

 

There was some delay in filing second appeal.

The response from Second Appellate Authority is:

Quote

 

Madam/Sir,

        Reference your Second Appeal dated dd-mm-2020 received on dd-mm-2020 vide above Diary Number.

2. On scrutiny of the Second Appeal, it is seen that the same has the following deficiencies, which are required to be removed.

         It is noticed that the Second Appeal is time-barred as the same has not been filed within the prescribed time limit and you have not filed any request for condonation of delay.

        Your above mentioned Second appeal is therefore returned, for removing the deficiencies. You are requested to send Second Appeal complete in all respects.

        While sending the Second appeal a copy of this letter may also be enclosed.

So, what should I do to file second appeal and get a response?

.Just pray for condoning the delay as it missed your attention as you are not feeling well and for admitting the same.  If the delay is nominal they may admit.  File the entire set with a request to condone the delay

Otherwise commence fresh process.

Invariably state dates, grounds for appeal and information requested. Some issues worth going for appeals and some may be mere waste of time without any scope for further positive development.

Please refer to the provision of section 19(3) of the RTI Act, the same is reproduced below (emphasis added):
 

Quote

 

Section 19(3) A second appeal against the decision under sub-section (1) shall lie within ninety days from the date on which the decision should have been made or was actually received, with the Central Information Commission or the State Information Commission:

Provided that the Central Information Commission or the State Information Commission, as the case may be, may admit the appeal after the expiry of the period of ninety days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.

Thanks Suil.

I will take this case to consumer court or else I can file another RTI online for ₹10 and take this case also to the same level.
