Obc certificate




Can I seek OBC Certificate of a Government Employee that were submitted at the time of recruitment process

First of all PIO can not provide that information which is exempted under RTI.   Caste is a personal information and this may amount to invasion on privacy.

However there is no bar for a citizen in seeking information from public authorities under RTI Act.

The applicant must go for such larger public interest involved and establish this to satisfaction of PIO.

In other words you can seek such information.....Your query is answered.

The query you have not asked is whether PIO can provide such information.

The reply is NO, he can not provide such information and applies exemption 8 1 (j).

Incase if you are sure that the employee used foul means and secured such employment illegally through back door.  Make a complaint with such details and provide a prima facie evidence that state his original caste.

Wait  for a month and then commence application, first appeal and second appeal process and try your luck.

I am sure that lf that certificate is really fake, you can get it atleast in second appeal stage.
