I have filed a certain RTI application before Police Dept. to know the progress of a case related to corruption but the  RTI application was denied by the SPIO stating that the requested information falls under the purview of section 8(1)(a) RTI Act.

Please post the exact query as there is no relevance between Sec. 8 (1) (a) that is concerned with safety of the Country/ Relations with a friendly nation, and whereas you are seeking information on corruption.

Corruption being an evil on system and society is against public interest.  Larger public interest is involved in seeking information if it is a corruption.

As per Supreme court judgments denying information by copy paste of  Section is not enough and there should be justification by SPIO as to how the disclosing of  information on corruption affects the safety of the country, sans this essential justification, the denial has to be treated as malafide denial.   Go for first appeal immediately.

Brief facts: Appellant has sought information through his application dt.  on corruption which is in larger public interest where there can never be an exemptions.  SPIO has just quoted a section for denial without justifying as to how such disclosure of information is related to internal safety of the country and relations with other friendly countries.  Without justification the denial is treated as malafide and hence the first appeal.

PRAYER:  Appellant prays for suitable directions  for providing of information as information on corruption amounts to larger public interest issue and for application of mind while providing information to SPIO as denial  is not justified.
