Action taken on complaint Information denied 2f

In response to my RTI seeking information on action taken on my complaint dt 30.6.2020 against employees of Taluk Office for  flouting covid rules , not wearing ID cards on duty,using middlemen in office for collecting bribe etc, the PIO responded as follows

 

1. Action taken on your complaint is pending. File pending. Under sec 2f, only available information can be provided.

 

2. provide the copies of all orders/circulars/directives that state the internal departmental procedure to be followed by various officials, for handling complaints against the employees of Taluk Office

Answer: I cannot collate or collect information about order s and circulars which are not readily available 2f. You are requested to visit revenue website and collect it under heading circulars.

No such solicited information available under circulars.

 

Nowadays PIO's are very smart in tackling RTI seeking action taken on complaints , using 2f and stating action pending.

Grounds for Appeal:  For point No.2, the appellant was asked to search for such circulars, and even after a thorough search, this applicant could not find the information. As per several CIC decisions, if  applicant seeks copies, those copies should be provided after collecting such prescribed fee.  Asking applicant to search website is not proper.  Further, PIO has misrepresented and stated that the information is available in website, without knowing facts himself. 

PRAYER: Appellant prays for directions to PIO for providing that information is available in the form of physical form as he is custodian of such information.

PIO  has kept my complaint long pending and providing replies that action on your petition is pending.Probably PIO must have some reasons on record for keeping complaints pending for more than 6 months. As per grievance redressal GO and citizen charter, such complaints should be resolved within a  mandated period.

 

Please advise on grounds of appeal for PIO stating 2f for action taken on petitions. Or should we file  another RTI seeking Why petitions are kept pending, respective GO's and circulars for speedy disposal of grievances
